Ordinance 011-1998 BOCC ORDINANCE NO. 011-1998 AN ORDINANCE BY THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS RESCINDING ORDINANCE #025-1997 AND ADOPTING AN AMENDMENT TO THE OFFICIAL LAND USE DISTRICT (ZONING) MAP REQUESTED BY DAVID ETHRIDGE FOR A CHANGE ,FROM MARITIME INDUSTRIES (MI) TO URBAN RESIDENTIAL (UR) FOR PROPERTY DESCRIBED AS PART OF GOVERNMENT LOT 2, IN SECTION 9, TOWNSHIP 66 SOUTH, RANGE 32 EAST, TALLAHASSEE MERIDIAN, LOCATED AT 2111 OVERSEAS HIGHWAY, MARATHON, VACA KEY, MONROE COUNTY, FLORIDA, MILE MARKER 48. THE REAL ESTATE NUMBER IS 00102520. WHEREAS, Section 9.5-511(c), Monroe County Code of Ordinances (Code) , provides that the land development regulations (Chapter 9.5 of the Code), including the land use district (zoning) map, may be amended or changed at any time; and WHEREAS, the Monroe County Board of County Commissioners, during a public hearing held on June 18, 1997, adopted Ordinance #025-1997 approving a map amendment filed by David Ethridge to change the land use district (zoning) designation from Maritime Industries (MI) to Urban Residential (UR) for the above-described property; and WHEREAS, it has been determined that Ordinance #025-1997 is not in compliance with Florida Statutes because it was adopted before the necessary Future Land Use Map amendment was adopted; and WHEREAS, the Monroe County Board of County coinie:f3i_eI:'fit, during. a public hearing held on April 8, 1998, ~~~wejt ciiKi considered a map amendment filed by David Ethridge t~n::lI1p.n~ tfge land use district (zoning) designation from Maritim~?iIidtl'lifj:r~s (MI) to Urban Residential (UR) for the above-descrirg~;I?r~rg-; a~ 2. 0 ~ ~ ("') r- :&' :::0 .~:X: ", WHEREAS, the Planning and Environmenta:p!" ~e~u~s Departments have reviewed the proposed land use dist~c~ (~ntog) map amendment and recommend approval; and ~ WHEREAS, during the amendment process, the Development Review Committee, after due notice and public participation in the hearing process, has reviewed the proposed land use district (zoning) map amendment and recommends approval; and WHEREAS, during the amendment process, the Monroe County Planning Commission, sitting as the local planning agency, after due notice and public participation in the hearing process, has reviewed the proposed land use district (zoning) map change and the recommendations of the Planning and Environmental Resources Page 1 of 4 ETHRIDGE. 24/TXTAMAP/#M96111 Initials /Jh Departments and the Development Review Committee and recommends . approval; and WHEREAS, the Monroe County Board of County Commissioners, after due notice and public participation in the hearing process, has reviewed all of the above recommendations; and WHEREAS, the Monroe County Board of County Commissioners hereby makes the following FINDINGS OF FACT: 1. The Maritime Industries zoning category is not consistent with the Residential High future land use category pursuant to Policy 101.4.22. 2. The applicant has requested the Urban Residential (UR) zoning category, which is consistent with the Residential High future land use category pursuant to Policy 101.4.22. 3. Based on a site visit, staff determined the subject property lies in an area of existing mixed commercial retail, industrial, transient and permanent single- and multi-family development, and thus, within close proximity to a variety of employment opportunities. 4. A new issue is raised by Goal Comprehensive Plan which requires policies to promote adequate and current and future residents. 601 of the Year 2010 the County to adopt affordable housing for 5. Policy 101.4.4 regarding the Residential High (RH) future land use category states that this district shall provide for high density residential uses and should be located near employment centers. 6. Goal 212 requires the County to prioritize shoreline land uses to protect areas for water-dependent uses. 7. Additional detail shows that the mangrove fringe and shallow water associated with this property make it inappropriate for water access to Boot Key Harbor. 8. Cursory research by County staff on the County's vacant land supply revealed only a small percentage of vacant land in both the Industrial (I) and Residential High (RH) ca:tegories. 9. The Technical Documentof the Year 2010 Comprehensive Plan projects a need for additional Residential High (RH) land, but does not project a need for additional Industrial (I) land, and calls into question the development of existing vacant Industrial parcels. 10. Sec. 9. 5-511 of the Monroe County Code provides that no changes to the land use maps shall be made which result in adverse impacts on the community character of the area. (Findings 4,8-9) 3. The proposed map amendment is supported by additional detail related to Goal 212 since the subject property is not appropriate for water-dependent uses. (Findings 6-7) 4. The proposed change is consistent with Sec. 9.5-51I, MCC, and Objective 101.4 since they will protect community character by providing a transition between lower and higher intensity land uses. (Findings 3, 5, 10-11) 50 The proposed future land use map change is consistent with Policy 101.4.4 because the subject property is located near employment centers. (Findings 3, 5) 6.
