Ordinance 013-1998 BOCC ORDINANCE NO. 013-1998 AN ORDINANCE BY THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS RESCINDING ORDINANCE #026-1997 AND ADOPTING AN AMENDMENT TO THE OFFICIAL LAND USE (ZONING) MAP REQUESTED BY GEORGE AND GAY NETH FOR A CHANGE FROM IMPROVED SUBDIVISION (IS) TO SUBURBAN COMMERCIAL (SC) FOR PROPERTY LOCATED AT 6350 OVERSEAS HIGHWAY AND DESCRIBED AS LOTS 1 AND 2, BLOCK 2 OF CASA BLANCA SUBDIVISION, SECTION 11, TOWNSHIP 66 SOUTH, RANGE 32 EAST, TALLAHASSEE MERIDIAN, VACA KEY, MONROE COUNTY, FLORIDA, MILE MARKER 50.4. THE REAL ESTATE NUMBER IS 336380. WHEREAS, Section 9.5-511(c), Monroe Count v Code of Ordinances (Code), provides that the land development regulations (Chapter 9.5 of the Code), including the land use district (zoning) map, may be amended or changed at any time; and WHEREAS, the Monroe County Board of County Commissioners, adopted the land use district (zoning) map on February 28, 1986, and designated the above-described property as Improved Subdivision (IS); and WHEREAS, the Monroe County Board of Commissioners, during a regular meeting held on June 18, 1997, adopted Ordinance #026-1997 approving a map amendment filed by George and Gay Neth to change the land use district (zoning) designation from Improved Subdivision (IS) to Suburban Commercial (SC) for the above-described property; and WHEREAS, it has been determined that Ordinance #026-1997 is not in compliance with Florida Statutes because it was adopted before the necessary Future Land Use Map amendment was adopted; and WHEREAS, the Monroe County Board of County Commissioners, during a regular meeting held on April 8, 1998, reviewed and considered a map amendment filed by George and Gay Neth to change the land use district (zoning) designation from Improved Subdivision (IS) to Suburban Commercial (SC) for the above-described property; and NETH.23/TXTAMAP/#M96116 WHEREAS, the Planning and Environmental Resources Departments have reviewed the proposed land use distri~ (zoning) map amendment and recommend approval; and ~ j;: :c ='" (:) ('") ~ ~ ;:::; WHEREAS, during the amendment process, the ~ltl>m~t Review Committee, after due notice and public par~tl\9n ~n the hearing process, has reviewed the proposed land~~ d~t~t (zoning) map amendment and recommends approval; and ~~f2 :'b -=b :"'7 :--t:::r:: ~ .::tJ ~l;~Pl . 1'1'j'<::) <:::) rnitials4-- Page 1 of 4 WHEREAS, during the amendment process, the Monroe County Planning Commission, sitting as the local planning agency, after due notice and public participation in the hearing process, has reviewed the proposed land use district (zoning) map change and the recommendations of the Planning and Environmental Resources Departments and the Development Review Committee and recommends approval; and WHEREAS, the Monroe County Board of County Commissioners, after due notice and public participation in the hearing process, has reviewed all of the above recommendations; and WHEREAS, the Monroe County Board of County Commissioners hereby makes the following FINDINGS OF FACT: 1. The subject property's IS zoning was the result of a mapping error made during the 1986 comprehensive planning process. 2. The subject property's IS zoning is not consistent or compatible with the Mixed Use/Commercial (MC) future land use designation according to Policy 104.4.22. 3. Sec. 9.5-143, MCC (Monroe County Code), and Objective 101.8 prohibit the expansion of nonconforming uses. The subject property is a nonconforming use under the IS designation. 4. The requested SC zoning is associated with the MC future land use category according to Policy 101.4.22, and is intended to provide for commercial areas which serve the immediate planning area (Sec. 9.5-206, MCC). 5. A site visit and research confirmed that property contains 15,897 square feet and 2,913 of floor area in the form of a restaurant, storage. the subject square feet office and 6. The surrounding community is mixed in character, containing residential and commercial uses. Herbie's restaurant has been in existence since 1972, according to the application. 7. Sec. 9.5-511, MCC, and Objective 101.4 require the County to protect community character. 8. Goal 102 calls for growth to be directed away from environmentally sensitive areas, Objective 101.1 requires adequate public facilities concurrently with development impacts, and Objective 101.5 calls for the County to encourage redevelopment and infill. 9. The SC zoning designation will produce no impacts on natural resources, will not exceed available public facilities capacity and will positively affect redevelopment and infill. WHEREAS, the Board of County Commissioners hereby adopts the following CONCLUSIONS OF LAW: NETH.23/TXTAMAP/#M96116 Page 2 of 4 Ini t ial s 9'J! 1. The rationale for the proposed land use (zoning) map change is to correct a mapping error and to bring the land use (zoning) map into consistency with the Future Land Use Map. (Findings 1-2) 2. The requested SC zoning is consistent and compatible with the Future Land Use Map of the Year 2010 Comprehensive Plan. (Finding 3-5) 3. The proposed land use (zoning) map amendment will not negatively impact community character and is therefore consistent with Objective 101.4 and Sec. 9.5-511, MCC. (Findings 5-7) 4. The proposed SC designation is consistent with Goal 102, Objective 101.5 and Objective 101.11 because the land is already disturbed, is served by sufficient public facilities, and improves redevelopment and infill potential. (Findings 8-9) THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT: Section 1. This Board specifically adopts the findings of fact and conclusions of law stated above; and therefore Section 2. designated map, which exhibit 1.
