Ordinance 016-1998 BOCC ORDINANCE NO.016-1998 AN ORDINANCE BY THE MONROE COUNTY BOARD OF COMMISSIONERS RESCINDING ORDINANCE #007-1997 AND APPROVING THE REQUEST FILED BY JEAN LOPRESTI AND ANGELA REYNOLDS TO AMEND THE OFFICIAL LAND' USE DISTRICT (ZONING) MAP FROM SUBURBAN RESIDENTIAL (SR) TO IMPROVED SUBDIVISION (IS) FOR PROPERTY LOCATED AT MILE MARKER 99,5 AND FURTHER DESCRIBED AS BLOCK 5, LOTS 1 AND 2, BLOCK 14, LOTS 1 AND 2, KEY LARGO OCEAN SHORES ADDITION, SECTION 32, TOWNSHIP 61 SOUTH, RANGE 39 EAST, WITH REAL ESTATE IDENTIFICATION NUMBERS 00498820, 00498830, 00500670 and 00500680. THESE PROPERTIES LIE IN SECTION 32, TOWNSHIP 61 SOUTH, RANGE 39 EAST, WHEREAS, Section 9,5-511(c), Monroe Countv Code of Ordinances (MCC) , provides that the land development regulations (Chapter 9.5 of the MCC), including the land use district (zoning) maps may be amended or changed at any time; and WHEREAS, the Board of County. WHEREAS, the Monroe County Board of Commissioners, after due notice and public participation in the hearing process, has reviewed all of the above recommendations; and WHEREAS, the Monroe County Board of Commissioners adopts the following FINDINGS OF FACT: 1. According to Policy 101,4,2 of the 2010 Comprehensive Plan, the Residential Low future land use category (and therefore, the Suburban Residential zoning category) should be applied to properties with natural vegetation, within partially developed areas and other low density residential areas, 2. 1985, maps. The surrounding neighborhood and remaining portions of Key Largo Ocean Shores Addition contain medium- to high-density residential uses as well as commercial uses. 4, As' evidenced by recent aerials of the area, Key Largo Ocean Shores Addition is almost completely built out and is served by all public utilities. 5, Section 9,5-213, MCC, states that the purpose of the Improved Subdivision (IS) district is to accommodate residential development rights for properties within platted subdivisions, which are served by dedicated roads and water supplies. 6. Under the current development potential accessory uses. and proposed land use designations, is limited to a single-family home the and 7. No public facilities expansions are necessary to support the permitted uses in either category. WHEREAS, the Monroe County Board of Commissioners adopts the following CONCLUSIONS OF LAW: 1. The subj ect parcels do not meet the intent of the Suburban Residential zoning category; however, they do fulfill the purpose of the Improved Subdivision zoning district, especially as it relates. to the surrounding community character. (Findings of Fact 1-5) 2, Similar impacts on natural resources and public facilities are expected with the Improved Subdivision as with the Suburban Residential designation.
