Section 9.5-490.2(e)(2), M.C.C., is hereby amended to read:;t> 0'\ 0 (2) Municipalities: Impact fees adopted by the county may be imposed by a participating municipality on new development within the municipality pursuant to an interlocal agreement with the county which provides that the municipality retains a portion of the impact fees collected and remits the remainder of the fees to the County. The fees retained by the municipality must be expended in a manner consistent with this Article X, Chap. 9.5, M.C.C. The interlocal agreement must provide that the municipality keep records of the impact fee expenditures according to generally accepted governmental accounting principles and to make those records available to an auditor employed by the County upon reasonable request. Section 2. Severability. If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 3. Repeal of inconsistent ordinance clauses All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. Section 4. Inclusion in the Monroe County Code The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition to amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 5. Effective date This Ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this Ordinance has been filed with that Office.
