AN ORDINANCE BY THE MONROE COUNTY BOARD OF
COUNTY COMMISSIONERS ADOPTING A REMEDIAL
AMENDMENT TO POLICY 101.4.11 AND AN UPDATE OF THE
TECHNICAL DOCUMENT OF THE MONROE COUNTY YEAR 2010
COMPREHENSIVE PLAN. THIS REMEDIAL AMENDMHNT
DIRECTS THE COUNTY TO WORK WITH THE SCHOOL BOiRJj';

WHEREAS, the Board of County Commissioners, on April 15, 1993, adopted the
Monroe County Year 2010 Comprehensive Plan, which was subsequently enacted on January 4,
1996; and
WHEREAS, new state legislation (Section 163.3177, Florida Statutes) places additional
requirements on local governments relating to planning for educational facilities; and
WHEREAS, Monroe County Planning Department entered into a stipulated settlement
agreement with the Department of Community Affairs so that the County can meet the new
educational planning requirements of Section 163.3177; and
WHEREAS, the Board of County Commissioners approved this stipulated settlement
agreement between the County and the Department of Community Affairs at its July 8, 1988 meeting;
and
WHEREAS, the above referenced settlement agreement enables Monroe County to submit a
remedial comprehensive plan amendment that addresses the County's school siting requirements; and
WHEREAS, the Monroe County Planning Department gathered and analyzed the information
required by Section 163.3177 and prepared an amendment to Policy 101.4.11 which is outlined in the
proposed Comprehensive Plan Strategy for Siting Schools in Monroe County; and
WHEREAS, the Development Review Committee, Planning Commission and staff support
and recommend approval of the Monroe County Year 2010 Comprehensive Plan policy amendment
and technical document update as indicated in resolutions #D4-98 and #P62-98.

NOW THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA, THAT:
Section 1. Policy 101.4.11 of the Policy Document of the Monroe County Year 2010 Comprehensive
Plan is hereby amended to read as follows:
The principal purpose of the Educational land use category is to provide for
public educational facilities. The County shall coordinate with the School
Board to balance educational facility land requirements with other land use
objectives. Monroe County has a fragile environment, limited land and a
population that is dispersed along one main highway. In recognition of these
factors, the County shall encourage schools to accommodate building and
facility requirements on existing sites. When new school sites are required,
schools shall be encouraged to locate proximate to urban residential areas and
other public facilities [9J-5. 006(3) (c) 1 and 7].
Section 2. Monroe County does hereby fulfill its obligations under its stipulated settlement agreement
with the Department of Community Affairs by completing and submitting the proposed remedial
amendment and technical document update package to the Department of Community Affairs; and
Section 3. The Director of Planning is given authority to revise the Technical Document of the
Monroe County Year 2010 Comprehensive with the data and analysis from the school requirements
review process engaged in by Monroe County and the School Board; and
Section 4. The Director of Planning is given authority to prepare and submit the required transmittal
letter and supporting documents for the proposed amendment in accordance with the requirements of
Chapters 163 and 380, Florida Statutes; and
Section 5. If any section, subsection, sentence, clause or provision of this ordinance is held invalid,
the remainder of this ordinance shall not be affected by such invalidity.
Section 6. The Clerk of the Board is hereby directed to forward a certified copy of this ordinance to
the Director of Planning.

Dear Mrs. Cloud:
Enclosed please find a certified copy of Ordinance No. 030-
1998 adopting a remedial amendment to Policy 101.4.11 and an
update of the Technical Document of the Monroe County Year 2010 I
Comprehensive Plan. This remedial amendment directs the Count~
to work with the School Board to balance educational facili~ies'
land requirements with other land use objectives, encourages
existing schools to accommodate building and facility
requirements on their current sites and encourages new schools to
locate proximate to urban residential areas and other public
facilities.
This Ordinance was adopted by the Monroe County Board of
County Commissioners at a Regular Meeting in formal session on
