Nelson Government & Cultural Center, Key Largo to consider a request filed by Keys Lake Villas, LLC for the abandonment of a platted, undeveloped right-of-way that is located in Section 1, Township 61 South, Range 39 East and Section 6, Township 61 South, Range 40 East, Key Largo, Monroe County, Florida according to P.F. Jenkins Model Land Company plat (PB1-68). ITEM BACKGROUND: The Keys Lake Villas site (RE No. 00083970.000000) was previously known as Lakeview Gardens. Prior to Lakeview Gardens, the site was known interchangeably as the Florida Keys RV Park and the Happy Vagabond, which was developed and utilized as a 126-unit RV park with 13 permanent residential units in the form of mobile homes. The petitioner has submitted a road abandonment petition in order to establish the property line that will insulate the 110-unit affordable housing project approved by Planning Commission Resolution No. P27- 08 from potential traffic and create a vegetative buffer as required by HUD. More specifically, the road abandonment petition is for a 30 foot wide, unnamed, unbuilt and not used, platted road with a length of 1,275.13 feet for a total of approximately 37,932 SF. Prior to the BOCC hearing this request, the BOCC was to consider a request to authorize the County Administrator or his designee to provide a letter of no objection, as an affected property owner of RE No. 00084140.000000, in order to have a complete road abandonment application. If the BOCC consents to this request, the road abandonment application would be complete. The County -owned property adjacent to the Key Lake Villas property is currently being leased by Humane Animal Care Coalition. If the road abandonment request is granted, the property owned by Monroe County would be increased in size and would gain 15 feet along the approximate 455-foot length of the eastern property boundary for a total of approximately 6,825 SF. The tenant has no objection to the abandonment. PREVIOUS RELEVANT BOCC ACTION: On March 19, 2008, the BOCC entered into a development agreement with Northstar Resort Enterprises Corp., requiring the applicant to construct 110 affordable housing units. More specifically, the road abandonment petition is for a 30 foot wide, unnamed, 35 unbuilt and not used, platted road with a length of 1,275.13 feet for a total of approximately 37,932 SF. 36 It should be noted that the northern portion of the platted, undeveloped right-of-way is only 15 feet wide 37 and runs south for 81.62 feet before the right-of-way widens to 30 feet. 38 39 Monroe County owns property (Re No. 00084140.000000) that is currently being leased by Humane 40 Animal Care Coalition and is located adjacent to the west of the Keys Lake Villas, LLC property. If the 41 road abandonment request is granted, the property owned by Monroe County would be increased in size 42 and would gain 15 feet along the approximate 455-foot length of the eastern property boundary for a 43 total of approximately 6,825 SF. The Engineering Department is currently pursuing the possibility of 44 obtaining a portion of surplus right-of-way along the front of US 1 from FDOT. The amount of surplus 45 right-of-way being requested by the County is 30 feet wide by 331 feet long. The County project would 46 not affect the requested abandonment area. 47 Keys Lake Villas, LLC Road Abandonment Petition Reviewed by Page 1 of 3 I This petition has been reviewed by County staff and written recommendations of no objection were 2 received from Monroe County Engineering Services, Fire Marshal, Code Compliance, and the Monroe 3 County Sheriff's Office. 4 5 At the time of this report, letters of no objection have been received from three of the four adjacent 6 property owners (Oscar Garcia, RE No. 00084180.000000; and Jose Grill Perez, RE No. 7 00084160.000000 and FKEC 00084150-000000). Monroe County is the third adjacent property owner 8 and has been requested to provide a letter of no objection. 9 10 Florida Keys Electric Cooperative Association, Inc., Florida Keys Aqueduct Authority, Monroe County 11 Sheriffs Office, Monroe County Fire Department, Monroe County Engineering and Comcast have 12 provided letters of no objection. 13 14 Monroe County Code Section 19-1 - Abandonment of rights -of -way states: 15 16 (a) No dedicated and accepted right-of-way in the county shall be abandoned where: 17 (1) the right-of-way terminates on a body of open water; or 18 • The platted, undeveloped right-of-way does not terminate on a body of 19 open water. 20 (2) the right-of-way provides access to the public to land on open water; or 21 • The platted, undeveloped right -of -right does not provide access to the 22 public to land on open water. 23 (3) the abandonment would preclude a way for the public to maintain access to the water. 24 • The abandonment would not preclude a way for the public to maintain 25 access to water. 26 27 (b) In all other cases of abandonment, no right-of-way shall be abandoned unless there is an 28 agreement to do so by all affected property owners. For purposes of this subsection, an 29 affected property owner is the owner of property which, if the right-of-way is abandoned, 30 will: 31 (1) Have access that is currently used by that property owner eliminated; 32 • The requested abandonment is for a platted, undeveloped right-of-way 33 that is not being used for access by the property owner. Aerial 34 photography shows the property has been accessed by two entrances off 35 US 1 since at least 1977. 36 (2) Have the only platted access eliminated; 37 • As noted above, the property has been accessed by two entrances to US 38 1 since at least 1977. 39 (4) Have the paved area adjacent to that property increased for turn -around purposes; or 40 • There are no paved areas adjacent to the adjoin properties and there 41 are no proposed plans for a turn -around. 42 (4) Be increased in size. 43 • There would be no increase in size. 44 45 (c) A road may be abandoned only at the terminal portion of the road and in its full width unless 46 the abandonment will comply with the County Code requirements for road, turn -around, and 47 fire -rescue access and one of the following circumstances exists: 48 (1) An adjacent lot owner has on the platted right of way or within a setback a substantial 49 structure which predates the Special Session Law 59-1578 pertaining to maps, plats Keys Lake Villas, LLC Road Abandonment Petition Reviewed by Page 2 of 3 I or metal fences, sheds or tiki huts or other items not listed which are accessory 2 structures. 3 • There are no substantial structures within the right-of-way area or the 4 side yard setback. However, it has been noted by the Engineering 5 Department that the adjacent County -owned property has space issues 6 and that there may be storage trailers encroaching on the platted, 7 undeveloped right-of-way being requested for abandonment. 8 9 (2) The abandonment is requested by a County department or governmental agency for a 10 public purpose. 11 • The abandonment request is not by a County department or 12 governmental agency, although HUD requested Keys Lake Villas 13 petition for the abandonment in order to create a vegetative buffer 14 along the property line. 15 16 (d) The board of county commissioners considers these a restriction on the rights of individuals 17 who desire to abandon properties in accordance with F.S. § 336.09. 18 • The petitioner meets the criteria above; therefore, there are no 19 restrictions on the rights of Keys Lake Villas, LLC 20 21 The requested abandonment of a platted, undeveloped right-of-way in Section 1, Township 61 South, 22 Range 39 East and Section 6, Township 61 South, Range 40 East, Key Largo, Monroe County, Florida, 23 according to P.F. The legal description describes the 30 foot wide right of way around the centerline; however, the northernmost portion of the corridor proposed for abandonment is only 15 feet wide so I question whether the legal description is entirely accurate. Monroe County is named as one of the affected parties since the Upper Keys Animal Shelter property abuts the right of way proposed for abandonment. I am not sure who is authorized to write a letter of no objection on behalf of the County as an affected property owner but from an Engineering perspective there are no issues other than the legal description. I spoke with Jerry Barnett, Director of Project Management who has been working on a project at the Upper Keys Animal Shelter property; he informed me that there are some space issues there (lack of parking) and that trailers at the site may be encroaching on the right of way for which abandonment is sought. Due to these issues, should the BOCC approve the abandonment petition, Engineering/Project Management recommends that the County retain the 15 ft. wide portion adjacent to the Animal Shelter property that would revert to the County.
