Should you have any questions, please do not hesitate to contact this office. cc: County Attorney Finance File 1 FREEMAN JUSTICE CENTER GROUND LEVEL LOBBY EXPANSION CONTRACT FOR PROFESSIONAL SERVICES BETWEEN OWNER AND ARCHITECT/ENGINEER THIS CONTRACT made as of the 16 day of May 2012. FOR PROFESSIONAL SERVICES BETWEEN OWNER AND ARCHITECT/ENGINEER (the "Contract" or "Agreement ") is made and entered into by MONROE COUNTY, BOARD OF COUNTY COMMISSIONERS ( "Owner" or "County "), a political subdivision of the State of Florida, whose address is 1100 Simonton Street, Key West, Florida 33040, its successors and assigns through the Monroe County Board of County Commissioners (`BOCC "), and CURRIE SOWARDS AGUILA ARCHITECTS, the ( "Architect "), whose address is 134 NE 1 St Avenue, Delray Beach, FL 33444, its successors and assigns. NOW, THEREFORE, in consideration of the mutual promises, covenants and agreements stated herein, and for other good and valuable consideration, the sufficiency of which hereby acknowledged, the Owner and architect agree: 1. This Contract is in accordance to the Continuing Contract as approved by the BOCC on January 20, 2010 where professional services are to be rendered for projects in which the estimated construction costs of each individual project under contract does not exceed Two Million Dollars ($2,000,000.00). All terms and conditions of the continuing contract approved by the BOCC shall apply to this contract. Modifications to the existing contract consist of the following: A. The Architect shall not disclose, publish, or authorize others to disclose or publish, design data, drawings, specifications, reports, or other information pertaining to the services performed by Architect or other information to which the Architect has had access during the Term of the Continuing Contract without the prior written approval of the County, during the term of the Continuing Contract and for a period of two years after the termination of the Continuing Contract. Nevertheless, the parties agree the Architect may use and publish the County's name and give a general description of the work provided by the Architect for the purpose of informing other clients and potential clients of the Architect's work experience and qualifications. B. Should the County receive a request for documents pursuant to Chapter 119, Florida Statutes, Architect shall cooperate with the County to facilitate the County's compliance with Chapter 119, Florida Statutes. Should the Architect assert any exemptions to the requirements of chapter 119 and related statutes, the burden of establishing such exemption, by way of injunctive or other relief as provided by law, shall be upon the Architect. Failure by the Architect to cooperate with the County in connection with a Public Records request shall be grounds for immediate unilateral cancellation of the Continuing Contract by the County. FREEMAN JUSTICE CENTER GROUND LEVEL LOBBY EXPANSION 2. PROJECT DESCRIPTION & SCOPE OF WORK The professional services required by this contract are to provide design through construction administration services associated with the expansion of the ground level main entrance lobby area of the Freeman Justice Center. The Lobby Expansion consists of expanding the current main entry lobby approximately 800 s.f. to encompass an adjacent area within the covered garage containing four parking spaces to be abandoned. Services include architectural, structural, electrical, and mechanical systems. Surface finishes, including floor, ceiling and walls are anticipated to match existing treatment where possible. Interior design services are not included in this proposal. Six (6) sets of signed and sealed drawings shall be provided as well as one CD. Architect will visit the site to obtain any available information affecting the proposed design and prepare a schematic design for the Client to review and approve. Once approved, the Architect and his consulting engineers will prepare bid and permit documents for use in obtaining a qualified general contractor to perform the necessary work. A pre -bid meeting attendance is included in the proposed fee. During construction, the Architect will respond to contractor questions, review submittals, and attend up to two on -site meetings to ascertain substantial and final completion of the work. Site visits shall be concurrent with the Drug Court Renovation Project as follows: • The initial kick -off meeting which will include the architect, structural engineer, and MEP engineer. • One site visit at the time of the pre -bid meeting with the architect and the MEP engineer. • Two site visits to include the architect and MEP engineer to establish substantial and final completion of the work. Any additional site visits required or requested will be provided at an additional cost. 3. PAYMENT Professional fees for the services described shall be a lump sum fee of Thirty Two Thousand Dollars and 00 /100 ($32,000.00) and shall be invoiced on a percentage of each phase of completion as follows: • Pre - Design Services $2,690.00 • Schematic Design $3,930.00 • Design Development $5,890.00 • Construction Documents $1 3,710.00 • Bid and Permitting $3,400.00 • Construction Administration $2,380.00 Total $32,000.00 FREEMAN JUSTICE CENTER GROUND LEVEL LOBBY EXPANSION 4. All other terms and conditions of this Contract shall comply with the Continuing Contract dated January 20, 2010, which shall be made a part of this contract as if written herein in its entirety. �?
