Resolution 150-2012 • 00 r— . p.; 0-1 t..-:1VIONROE COUNTY BOARD OF COUNTY COMMISSIONERS '` • RESOLUTION NO. 150 -2012 L. A RESOLUTION BY THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS, ADOPTING THE 2012 EVALUATION AND APPRAISAL REPORT FOR THE MONROE COUNTY YEAR 2010 COMPREHENSIVE PLAN; STATING THE INTENT OF THE COMMISSION TO AMEND THE COMPREHENSIVE PLAN BASED UPON RECOMMENDATIONS CONTAINED IN THE EVALUATION AND APPRAISAL REPORT. WHEREAS, the Monroe County Board of County Commissioners adopted the Monroe County Comprehsive Plan on April 15, 1993; as amended pursuant to DCA Rule 9J-14.022, Florida Administrative Code on January 4, 1996, and adopted by Florida Administrative Code Rule 28-20.100 Part I, January 2, 1996 and Part II, July 14, 1997; and WHEREAS, the Florida Legislature intends that local planning be a continuous process, and the Florida Statutes encourage local governments to comprehensively evaluate and, as necessary, update comprehensive plans to reflect changes in local conditions; and WHEREAS, the Monroe County Board of County Commissioners adopted an Evaluation and Appraisal Report (EAR), pursuant to Section 163.3191, Florida Statutes, for the Monroe County 2010 Comprehsive Plan on August 18, 2004 and adopted Comprehensive Plan amendments in accordance with the 2004 EAR; and WHEREAS, in 2011, the requirements for the EAR were significantly amended pursuant to. House Bill 7207, as reflected in Section 163.3191, Florida Statutes, and the State Land Planning Agency revised the Monroe County EAR deadline to May 1, 2014; and WHEREAS, amended Section 163.3191(1), Florida Statutes directs local governments to. evaluate its comprehensive plan at least once every seven years to determine if plan amendments are necessary to reflect changes in state requirements since the last update of the comprehensive plan; and • WHEREAS, the EAR is a periodic evaluation of how successful a local government has been in addressing major issues as part of its Comprehensive Plan. Based on this evaluation, the EAR suggests how the Comprehensive Plan should be revised to reflect changes in State requirements in Chapter 163, F.S. and better address the County's objectives, changing conditions and trends; and P. lof 3 • WHEREAS, the Monroe County Planning Commission, acting as the designated Local Planning Agency, has reviewed the EAR, held advertised special public meetings on November 2, 2011 and February 6, 2012, provided for participation by the public in the process, and rendered its recommendations to the Board of County Commissioners; and; WHEREAS, the Board of County Commissioners has reviewed the EAR, held an advertised public meeting on November 16, 2011 and an advertised special public March 19, 2012, provided for comments and public participation in the process in accordance with the requirements of state law and the procedures adopted for public participation in the planning process; and WHEREAS, the Board of County Commissioners held a special public hearing on May 22, 2012 to consider the adoption of the EAR; WHEREAS, at the special public hearing the Board of County.Commissioners voted to add the following strategies to_the EAR: 1) Include implementation or, focus on the surface water management plan relative to canals and the water quality of the canals; 2) Add rainwater harvesting as a potable, water conservation item; 3) Add grey water/re-use as a conservation method into the potable water elements and to remove impediments to people being able to use grey water; 4) Add the evaluation and identification of sites for the installation of new mooring fields; 5) Revise the EAR because land acquisition policies are not adequate and the County will need to revise the policies to better address the future build-out or maximum number of housing units of the Florida Keys; 6) Add the need to develop alternate land use policies related to the possibility of a future build out of the Florida Keys; 7) Add the need to develop an estimate of • the long term maintenance costs for the acquired lands; 8) Investigate whether the one half cent sales tax used by the Land Authority for acquistion can be broadened in scope in the statue to include the ability to use those funds for long term land management; 9) Add the development of a proactive public education program that informs individuals considering moving to the Florida Keys about issues concerning habitat, conservation, evacuation issues, flood plain regulations; 10) Prioritize the completion of strategies, studies and master plans, based on the 20 year planning horizon of the new Comprehensive Plan that will result from the EAR; NOW THERFORE, BE. IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,FLORIDA: Section 1: The Board of County Commissioners does hereby adopt the 2012 Evauation and Appraisal Report for the Monroe County Comprehensive Plan with the additional strategies recommended at the special public meeting. Section 2. The Board of County Commissioners does hereby intend to amend the Monroe County Comprehensive Plan based upon recommendations contained in the 2012 Evaluation and Appraisal Report. Section 3. This Resolution shall be effective immediately upon its passage. . Section 4. All Resolutions and parts of Resolutions in conflict herewith are repealed.
