APPLICATION DEADLINE
The application deadline for the Housing category will be published in the Florida Administrative
Weekly. Notices will also be mailed to each eligible community.
If hand delivered:
Applications must be received by the Department in Tallahassee by 5:00 p.m. on the deadline
date.
Applications must be delivered to the Division of Housing and Community Development, Room
310C, 2740 Centerview Drive, Tallahassee, Florida 32399 -2100.
If mailed:
Applications must be postmarked by the U.S. Postal Service by midnight on the deadline date.
The mailing address is: Department of Community Affairs, Division of Housing and Community
Development, 2740 Centerview Drive, Tallahassee, Florida 32399 -2100.
Applications which do not meet the established deadline will not be considered. No waivers will
be granted by the Department for applications that do not meet the established deadline.
Two copies of the complete application must be submitted, one with original signatures. In
addition, five copies of information to be sent through the Intergovernmental Coordination and Review
(IC &R) process must be submitted. The IC &R materials include Application Summary (CDBG -H -2),
Project Impact (CDBG -H -3), Scope of Work - Benefit form (CDBG -H -4), Scope of Work - Benefit
Summary form (CDBG -H -5), Historic Preservation Questionnaire (CDBG -H -6) and Maps required in
CDBG -H -8. Three additional copies of the IC &R materials must be submitted to the Regional
Planning Council serving the jurisdiction, prior to the application deadline date.
Complete all blanks. Any missing or incorrect information will negatively impact your score.
Also, the numerator and denominator, and the multiplier and the multiplicand of each calculation must
be displayed. All calculations are rounded to two decimal places.
The publication of this document was financed through the Florida Small Cities Community
Development Block Grant Program and was produced at an annual cost of $500 or $2.50 per copy to
inform the public of the program's requirements.

APPLICATION DEADLINE
The application deadline for the Neighborhood Revitalization category will be published in the
Florida Administrative Weekly. Notices will also be mailed to each eligible community.
If hand delivered:
Applications must be received by the Department in Tallahassee by 5:00 p.m. on the deadline
date.
Applications must be delivered to the Division of Housing and Community Development, Room
310C, 2740 Centerview Drive, Tallahassee, Florida 32399 -2100.
If mailed:
Applications must be postmarked by the U.S. Postal Service by midnight on the deadline date.

Applications which do not meet the established deadline will not be considered. No waivers will

The purpose of this rule chapter is to provide procedures for the Department's
implementation and administration of the Florida Small Cities Community Development Block
Grant Program Act, Sections 290.0401 -.049, Florida Statutes. This rule chapter provides the

9B- 43.002 The Florida Small Cities Community Development Block Grant Advisory
Council.
The Advisory Council shall review and make recommendations on program policies related
+� to program implementation, administration, and distribution of funds among program categories.

9B- 43.003 Definitions.
(1) "Administrative Closeout" means the written notification of a grantee by the
Department that all applicable administrative actions and all required work of the grant have
been completed with the exception of the final audit.

(2) "Administrative costs" means those costs outlined in Section 290.042, F.S. Specific costs
to be included as administrative costs include at a minimum:
(a) All personnel costs directly related to the CDBG program, including salaries and fringe
benefits. Such personnel costs shall include, but not be limited to:

1. Percentage of time charged to the grant by a city or county manager or clerk; "'
2. All community development directors, administrators, coordinators, specialists,
administrative or staff assistants, planners, and individuals performing similar functions; ..
3. All fiscal coordinators, specialists, bookkeepers, analysts, and individuals performing
similar functions;
4. All rehabilitation specialists, counselors, inspectors, specifications writers, and individuals
performing similar functions;
5. All relocation and acquisition specialists, counselors, and individuals performing similar
functions; and
6. All consultant management and administrative services, including all staff employed by
the consulting firm being charged to the grant.
(b) Other included administrative costs are:
1. All legal fees or costs, except title searches;
2. All audit, bookkeeping or financial management costs;
3. All staff training expenses;
4. All travel expenses for all staff;
5. All costs and charges for office space rent, utilities, telephone and other communication
charges, furniture, equipment, purchase or lease of computer hardware and software,
publications, advertising, printing or reproduction, postage, office supplies, subscriptions and
membership dues, the purchase or lease of any personal property; and ,.
6. All planning and urban design costs.
(c) Excluded from administrative costs are:
1. Architectural, engineering and associated resident inspection costs where State law or
OMB Circular A -102 requires sealed construction documents in order to obtain a building ..
permit;
2. Force account crews performing actual construction work;
3. Title searches, appraisals and costs of surveys.
(3) "Affordable rents" means the average monthly cost for rent and utility charges; or the
average monthly cost for all mortgage payments, real property taxes and utility charges; or 30
percent of the gross monthly income of all adult members of the individual's household,
including supplemental income from other public agencies, whichever is less; or the adjusted
gross income pursuant to 24 C.F.R. Section 215.1.
(4) "Annual payroll" means the projected aggregate of all wages and salaries calculated on ..
an annualized basis to be paid for the permanent jobs created or retained for an Economic
Development project. Fringe benefits, commissions, tips, and bonuses are not to be included.

'is (5) "Applicant manuals" means the Florida Small Cities Community Development Block
Grant program application manuals for the Housing, Neighborhood Revitalization, Economic
Development, and Commercial Revitalization categories which shall be published annually and
•• which shall contain application forms, instructions and administrative rules.
(6) "Architectural and engineering services" means the basic services required to be
NO performed by an architect or engineer licensed by the State of Florida. Specific cost may
include the following:
(a) Schematic design, including preliminary investigations, preparation of preliminary
"" drawings, preliminary itemized list of probable construction costs, and preliminary engineering
reports;
WO (b) Design development includes drawings and other documents to fix and describe the size _
and character of the entire construction project as to structural, mechanical, and electrical
systems, materials and other such elements as may be appropriate;
... (c) Construction documents include detailed drawings and specifications which set forth in
detail the requirements for construction of the project, bidding information and forms, and
forms of agreement between the owner and the contractor in accordance with the owner's
""' instructions;
(d) Bidding and negotiations for subcontracts include preparation of necessary documents,
obtaining bids and assisting in the award and preparation of contracts for construction;
(e) Construction administration shall include:
.. I. A general review of the work completed to ascertain that the construction conforms to
the design;

3. Coordination with other appropriate governmental agencies;

4. Review of the contractor's application for progress and final payments;
5. Preparation of necessary contract change- orders for approval on a timely basis;

6. A final review prior to the issuance of a statement of substantial completion of all
construction and submission of a written report;

7. A statement of final completion and a written acceptance of the facility; and
8. Provision of a set of reproducible as -built drawings, such drawings will be based on
construction records provided by the contractor during construction.
(7) "Blighted area" means an area as defined in Section 163.340, F.S.
(8) "CDBG" means the Florida Small Cities Community Development Block Grant Program.
,.. (9) "Community Redevelopment Agency" means a public instrumentality which is
established and controlled pursuant to Section 163.356 or 163.357, F.S.
(10) "Community Redevelopment Plan" means a community redevelopment plan developed

and adopted in accordance with Part III, Chapter 163, Florida Statutes. ..
(11) "Complementary activities" means eligible activities which are directly related to and
in support of the primary activity for which grant funds are being requested. The use of
CDBG funds for complementary activities shall not exceed 35 percent of total CDBG funds
requested.

(a) In the Housing category, complementary activities are limited to water and sewer
activities to provide service to units being rehabilitated. The per unit cost of providing service
shall not exceed $5,000.

(b) In the Neighborhood Revitalization category, complementary activities shall be limited
to rehabilitation of units to construct bathrooms where no bathrooms exist and which are to be
hooked up by the Neighborhood Revitalization project. .•
(12) "Created jobs" means permanent jobs which were not in existence in the State of
Florida prior to the provision of the CDBG assistance. In cases where an employer both creates .4
and eliminates jobs, "created jobs" means the difference between the new jobs created and the
old jobs eliminated. ,*
(13) "Department" or "Department of Community Affairs" means the Florida Department of
Community Affairs.
(14) "Direct beneficiaries" means low and moderate income persons who submit an r..
application or complete a personal record as a necessary part of receiving a benefit during the
contact term of the proposed CDBG project.
(15) "Downtown development authority" means a special district either dependent or
independent, as defined in Section 165.031 and 189.403(1), (2) & (3), F.S. whose primary
function is downtown development.

(16) "Downtown non - profit organization" means a not - for - profit corporation, pursuant to
Chapter 617, F.S., whose primary function is downtown development.
(17) "Eligible applicants" are counties and incorporated cities which qualify as eligible local
governments under Section 290.042,(5), F.S.
(18) "Eligible Units" in Housing are units in the project area which are substandard and are
owned or rented by persons of low and moderate income.
(19) "Enterprise Zone" means an area in the State as designated under Section 290.0065, �+
F.S.
(20) "Fundable range" shall be determined from the scores of the eligible applications,
ranked in descending order by the Department. Awards will be made based upon rank
following appeals, beginning with the highest scoring applicant and proceed in descending order
until all available funds in that category for that funding cycle are depleted. The score of the
last application funded shall establish the lowest score in the fundable range.
(21) "Household" means a family, individual or individuals residing in a dwelling unit.
(22) "HUD" means the U.S. Department of Housing and Urban Development.
(23) "Indirect beneficiaries" means low and moderate income persons residing in the service

area who receive benefits during the contract term from the proposed CDBG project without
submitting an application or completing a personal record.
.,, (24) "Jurisdiction" means the corporate limits of a local government or the area over which
it has zoning authority.
(25) "Leverage" or "match" means non -CDBG public and private funds that are necessary
and committed to the completion of an Economic Development project.
(26) "Local Comprehensive Plan" means the adopted growth management plan required
.. under the Local Government Comprehensive Planning and Land Development Regulation Act,
Section 163.3161, F.S., et seq.
in„ (27) "Low and moderate income families" means "lower income families" and "very low -
income families" as defined under the HUD Section 8 Assisted Housing Program. A lower
income family is a family whose annual income does not exceed 80 percent of the median
income for the area or does not exceed 80 percent of the median income for the State,
whichever is higher, as most recently determined by HUD. A very low- income family is a
family whose annual income does not exceed 50 percent of the median income for the area or
does not exceed 50 percent of the median income for the State, whichever is higher, as most
r recently determined by HUD.
(28) "Low and moderate income persons" means members of families or unrelated
r individuals whose incomes are within the income limits of "lower income families" and "very
low- income families" and means persons of low income and persons of moderate income.
(29) "Main Street Program participants" means cities which have been selected for
participation in the Florida Main Street program by the Secretary of State and are currently
under contract for participation in the Main Street Program as of the application date.
(30) "Necessary or appropriate" means the criteria established by HUD pursuant to 24
C.F.R. Section 570.203(b) used to assess an Economic Development project. The criteria shall
include at a minimum, but not be limited to:
(a) A financing gap between the private funds available and the funds needed to complete
the project; or
•• (b) A rate of return which makes the project more feasible for the investor than other
investments; or
„W (c) The assurance that without CDBG assistance the project would not be located in the
jurisdiction.
(31) "Net jobs" means the total permanent number of jobs created by an intrastate
relocation of an employer minus the number of jobs lost in the Florida jurisdiction from which
the employer's move originated.
(32) "Open Contract" for the purposes of Section 9B- 43.004 means any grant which has not
been administratively closed out.
(33) "Participating party" means a business which will create or retain permanent jobs for
the proposed Economic Development project.
(34) "Permanent job" means a full -time job or a full -time equivalent job as set forth in the

application which is necessary to the overall goals and objectives of a business and which has no
known end.
(35) "Principals" means the owners of more than 20 percent of the business, the officers,
and the directors of a participating party in the proposed Economic Development project.
(36) "Private funds" means any funds other than those provided by a public body, an 1
organization owned by a public body, directly from the State or federal treasury, or generated
from bonds issued by a public body for a public purpose.
(37) "Program income" shall be defined in accordance with 24 C.F.R. Section 570.500.
(38) "Project area" means the sites within a local jurisdiction in which all activities are to
be performed for a Community Development Block Grant project in the Housing category.
(39) "Public notice" shall be defined as an advertisement in a local newspaper of general
circulation published at least 5 and no more than 20 calendar days prior to any public hearings
required herein or by Chapter 290, F.S. The day of publication shall not be counted in
calculating the number of days of notice, but the day of the hearing shall be counted in
calculating such time period.
(40) "Retained jobs" means the total number of permanent jobs which, without CDBG
assistance, would be abolished by layoffs, plant closing, or other severe economic or natural
conditions.
(41) "Service area" means the total geographic area to be directly or indirectly served by a
Community Development Block Grant project, where at least 51 percent of the residents are low
and moderate income persons.
(42) "Slum area" means an area as defined in Section 163.340, F.S.
(43) "Survey" means the term and information contained in the HUD Circular Letter 88 -61
entitled "Survey Methodology to Determine Low/ and Moderate Income Status of Community
Development Block Grant Service Areas ", which is hereby incorporated by reference.
(44) "Tangible assets" means assets which would be reflected in a company's balance sheet
as either fixed assets or inventory valued at 5500 or more, if the proposed Economic
Development project were implemented.
(45) "Unit" in Neighborhood Revitalization means the quantity or number of appropriate
measurable units which exist or which are to be addressed by each activity in the service area. ..

9B- 43.004 Eligible Applicants.
(1) Individual Applicants. An eligible applicant may submit an individual application to
undertake eligible activities within its jurisdiction.
(a) An eligible applicant's activities may extend beyond its jurisdiction, provided the areas
outside its jurisdiction are eligible.
(b) If an eligible applicant proposes a Housing activity outside its jurisdiction, it shall

document in the application that the activity relates to other community development activities
being proposed, and that the beneficiaries of each activity are low and moderate income
persons. All beneficiaries shall reside within the jurisdiction of the local government submitting
the individual application.
(c) If an eligible applicant proposes a Neighborhood Revitalization activity outside its
jurisdiction or the service area, it shall document in the application that the activity relates to

other community development activities being proposed within the service area and that the
only beneficiaries of each activity are residents of the service area. All service area residents
shall reside within the jurisdiction of the local government submitting the individual
application.
(d) In instances where an individual eligible applicant proposes activities outside its
MID jurisdiction, a written interlocal agreement shall be executed authorizing the applicant to
undertake the activity, giving the concurrence of the other Local government with the activity
and committing resources by one or both local governments to maintain the activity. Such an
interlocal agreement must be submitted with the application for funding.

(2) Joint Applicants. Eligible applicants may submit a joint application to address a
shared problem, the solution to which requires the common action of the joint applicants. One
OW local government shall be designated as the lead agency responsible for the administration of the
grant.
.r (a) Joint applicants shall execute a written interlocal agreement authorizing the applicants
to undertake the activity, giving the concurrence of both local governments with the activity
and committing resources by one or both local governments to maintain the activity. Such
applicants must submit an interlocal agreement with their application for funding.
(b) If a joint application proposes an activity outside its jurisdiction or service area, it shall
document in the application that the activity relates to other community development activities
being proposed within the service area and that the beneficiaries of each of the activities are
only the service area residents. All service area residents shall reside within the jurisdiction of
the local government submitting the joint application.
(3) The lead applicant submitting as part of a joint application under either the Housing or
Neighborhood Revitalization or Commercial Revitalization category cannot submit an individual
application under any of these three categories.
(4) The eligible applicant may submit an additional joint or individual application under
the Economic Development category.
(5) Local governments with an open Housing, Neighborhood Revitalization or Commercial
Revitalization Community Development Block Grant contract from any State fiscal year whose
activities are on schedule as set forth in subsection (8), in accordance with the expenditure rates
and accomplishments described in the contract, may apply for an Economic Development grant.
(6) Local governments with an open Economic Development Community Development
Block Grant contract from any State fiscal year whose activities are on schedule as set forth in
subsection (8), in accordance with the expenditure rates and accomplishments described in the
contract, may apply for a Housing or Neighborhood Revitalization and a Commercial
Revitalization Community Development Block Grant. Local governments with an open
Economic Development contract whose activities are on schedule in accordance with the
expenditure rates and accomplishments described in the contract may receive no more than one
additional Economic Development grant in each State fiscal year.

(7) Local governments with an open Housing, Neighborhood Revitalization or Commercial
Revitalization Community Development Block Grant contract from any State fiscal year shall
not be eligible to apply for another Housing, Neighborhood Revitalization or Commercial
Revitalization grant until administrative closeout of their existing contract(s). The
Neighborhood Revitalization Emergency Assistance Set -aside shall be exempt from this
requirement.
(8) Contract performance shall be determined to be on schedule when the scheduled
expenditure, accomplishment and beneficiary data contained in the work plan have been met or
surpassed for all activities, as evidenced by the recipient's quarterly status report for the
calendar quarter ending just prior to the application deadline. The quarterly status report shall
be compared to the work plan contained in the CDBG contract, as of the last date of the
calendar quarter ending just prior to the application date. If the quarterly report, due in the
Department 20 days after the end of the quarter, is not received by the application deadline
date, the Department shall evaluate the recipient's past performance using the most current '
quarterly report on file, comparing it to the work plan contained in the CDBG contract as of
the last date of the most recent calendar quarter ending just prior to the application date. The
quarterly status report may be subject to verification by Department staff during the site visit.
If the Department determines as a result of the site visit that the quarterly status report is
inaccurate and the performance is not in accordance with the expenditure rates and
accomplishments described in the contract, then the applicant shall be deemed ineligible in
accordance with Section 290.046(2)(c), F.S. 14
(9) For any grant which has not expired or has not been terminated by June 30, 1990,
the Department shall notify the local government within 45 days of receipt of a closeout
package from the local government as to whether it is administratively closed out for the
purpose of eligibility. Notification shall be effective upon mailing by certified first class mail.
For any grant which has expired or been terminated by June 30, 1990, the local government
shall be eligible to apply for a Housing, Neighborhood Revitalization or Commercial
Revitalization grant, but the release of funds under any authorized contract shall not be ..
permitted until administrative closeout of the prior grant is completed.

9B- 43.005 Application Criteria.
(1) During each State fiscal year, eligible applicants may submit applications in the
following categories:
(a) Either Housing or Neighborhood Revitalization;
(b) Commercial Revitalization; and

(c) Economic Development.
(2) An applicant may not receive more than one grant in any State fiscal year from any of v*
the following categories: Housing, Neighborhood Revitalization or Commercial Revitalization.
(3) Economic Development applicants may apply up to three times in any one annual

funding cycle; however, only one Economic Development grant per annual funding cycle may
be awarded to a local government, in accordance with Section 290.046, F.S. Up to one -third of
the annual Economic Development category allocation may be awarded in any one phase to

.. applicants, plus any funds not awarded in previous phases or deobligated from previous
Economic Development grants, in accordance with the Final Statement of Goals and Objectives
submitted by the Department to the U.S. Department of Housing and Urban Development, as
.. amended.
(4) Neighborhood Revitalization Emergency Assistance Set - aside. Applications will be
accepted from eligible applicants under the Neighborhood Revitalization category for the
Emergency Assistance Set -aside in accordance with the following criteria:
(a) The maximum funds available under this set -aside shall be 10 percent of the funds
10, allocated to the Neighborhood Revitalization category or $650,000, whichever is less, and shall
be available through the third quarter of the State fiscal year.
.. (b) Applications will only be accepted from eligible applicants which have been declared
by executive order of the Governor to be in a state of emergency as provided under Section
252.36, F.S.
+x" (c) The applicant shall submit notification of intent to submit an application within 30
days of such declaration, and a completed application must be received by the Department
within 90 days of such declaration. Applicants, due to subsequent executive orders resulting
from the same emergency event, shall have up to 30 days from the date of issuance of
subsequent executive order for notification of intent to submit an application and shall submit
an application within 90 days from the initial executive order for the emergency event.
"" (d) The purpose of funds received under this category shall be to meet serious, urgent
community needs which pose an immediate and direct threat to the health, safety and welfare
of eligible residents of low and moderate income and which are eligible activities.

(e) Applicants under this category shall demonstrate that no other federal, State or local
disaster funds to address the emergency are available to the eligible applicant.
(f) All other provisions of this chapter shall apply to the Neighborhood Revitalization
Emergency Assistance Set -aside unless otherwise stated.
(5) Grant Size for All Program Categories. Grant ceilings establish limits on the amount of
funds that may be requested in a single grant application based on the most recently available
U.S. Census of Population data. In the case of county applicants the population shall include
only the unincorporated areas of the county. Joint applicants shall base their grant ceiling on
the population of the lead agency.
(a) Local governments shall comply with the population sizes and grant ceilings listed

9B- 43.006 Application Procedures for All Categories.
(1) Application Forms. Application forms are found in the applicant manuals which are
hereby incorporated into this rule by reference and which are available from the Department of
Community Affairs; Division of Housing and Community Development; 2740 Centerview Drive;
Tallahassee, Florida 32399 -2100:
(a) Form CDBG -H, Housing Application Manual;
(b) Form CDBG -N, Neighborhood Revitalization Application Manual;
(c) Form CDBG -C, Commercial Revitalization Application Manual; and _
(d) Form CDBG -E, Economic Development Application Manual.
(2) Rejection Criteria. All applications shall meet the following minimum requirements as +�
outlined in Section 290.0475, F.S. to qualify for scoring and shall be rejected if they fail to
satisfy these requirements:
(a) Submission of Applications. The Department shall establish a deadline for submission
of applications. This submission deadline date shall be announced by publication in the Florida
Administrative Weekly at least 30 days in advance of the deadline date. Applications shall be
sent by U.S. Mail or hand delivered. If hand delivered, applications shall be received by the "`
Department in Tallahassee by 5:00 p.m. on the deadline date; if mailed, applications shall be
postmarked by the U.S. Postal Service by midnight of the deadline date. Applications which do
not meet the established deadline shall not be considered. No waivers will be granted by the
Department for applications that do not meet the established deadline.
(b) Achievement of National Objectives. An applicant shall demonstrate that each of the
activities proposed in its application meets at least one of the following three national objectives
and that at least 60 percent of the funds requested shall benefit low and moderate income
persons:
1. Activities shall be considered to benefit low and moderate income persons, when at least
51 percent of those who benefit are low and moderate income persons; or
2. Aid in the prevention or elimination of slums or blight; or
3. Meet urgent community development needs where there is a serious and immediate
threat to the health and welfare of the community, which are of recent origin or recently
became urgent and where other financial resources are not available.
(c) Activity Eligibility. Proposed activities shall be eligible in accordance with Title I of
the Housing and Community Development Act of 1974, as amended, (42 USC Sections 5301-
5320), 24 C.F.R. Part 570, the State Operating Instructions published by HUD, and this rule. In
addition, all activities funded under a Community Development Block Grant must be in
conformance with the adopted local comprehensive plan. If any activity is determined not to be
eligible for funding pursuant to 24 C.F.R. Part 570, at any time prior to the effective date of a
grant, the Department shall reduce the amount of the grant award by the amount requested for
the activity deemed ineligible and any complementary activities associated with the activities ..
deemed ineligible.

•. (d) Misrepresentation. The eligibility and scoring of the application is subject to the truth
and accuracy of all information, representations, and materials submitted or provided by the
applicant in the application, in any subsequent submission or in any response to fulfill the
application requirements. The lack of accuracy thereof or any material changes shall cause the
application to be rejected for eligibility or scoring.
(e) Administrative Closeout. Applicants must have satisfied the eligibility criteria set forth
in Rule 9B- 43.004(9), Florida Administrative Code.
(f) Citizen Participation. The applicant shall demonstrate that the citizen participation
.. requirements prescribed in sections 104(a)(1) and (2) and 106(d)(5)(C) of Title I of the Housing
Community Development Act of 1984 have been satisfied.
(3) Completeness Review Period. All applications in all categories which satisfy the
requirements of Rule 9B- 43.006(2) and are in the fundable range shall be reviewed for
completeness.
.. (a) Additional Completeness Review Items for Neighborhood Revitalization Applications
Only. During the completeness review period, the Department shall review applications that
propose land assembly or site preparation for new housing construction for low and moderate
.,. income persons to determine whether documentation of firm commitments for construction from
the developer or documentation of ownership or an option on the land to control the sale to or
use by low and moderate income persons is provided in the application. Documentation that the
proposed site is properly zoned shall also be submitted.
(b) Additional Completeness Review Items for Economic Development Applications Only.
During the completeness review period, the Department shall also review Economic
+� Development applications to determine that sufficient information is provided in the application
to document that projects are necessary or appropriate and eligible.
(c) The Department shall notify the applicant in writing of any material requested as
provided in 9B- 43.006(3), (a) and (b).
(d) Applicants shall have seven working days from the date that the Department's
notification is received to have the requested material received by the Department as described
below.
.. (e) If the requested material is not received by five p.m. on the seventh working day, in
the Office of the Director of the Division of Housing and Community Development, or if at the
end of the completeness period, material is found to be incomplete or not in compliance, the

following points shall be deducted from the applicant's total score:
1. The Certification by Clerk - 50 points;
2. The Statement of Assurances - 50 points;
3. Maps - 25 points;
4. Documentation of private commitments, business plan, financial and profit and loss
statements, if applicable - 50 points.

(4) Administrative Costs.

(a) Percentage Limitations. Applicants under the Housing category shall utilize no more
than 15 percent of the total grant request for administrative cost. Applicants under the
Economic Development, Neighborhood Revitalization and Commercial Revitalization categories
shall utilize no more than eight percent of the total grant request for administrative costs.
(b) If administrative cost percentages set forth in Section 290.047, F.S. are exceeded, the
application shall be .scored. If the application scores in the fundable range, the dollars for MID
administrative costs shall be reduced prior to the offering of a grant award in order to bring the
percentages into compliance based on the total dollars requested. If the percentages cannot be
reduced without substantially affecting the structure of the project, beneficiaries or the ..
applicant's ability to carry out the project or if the applicant declines to reduce the percentages,
the Department shall not make a grant award offer.
(5) Architectural and Engineering Costs. The maximum percentage of awarded block grant
funds that may be spent on architectural and engineering costs by an eligible local government
shall not exceed the U. S. Farmers Home Administration schedule as applied to projects in
Florida on the date of the application. —r
(6) Economic Development Applications. If an eligible application is not funded during
Phase I or later phases because of insufficient funds and the applicant desires its application to �.
be considered for funding in the next funding phase, or if the applicant desires to withdraw its
application and resubmit it for consideration in the next funding phase, the applicant shall
notify the Department in writing prior to the submission deadline of the next funding phase.
(7) Past Performance for All Categories.
(a) Audit Findings. If an applicant has not submitted an audit report in accordance with
OMB Circular A -128 or has not taken action to resolve an audit finding within the prescribed
time frame or by the application date, whichever is later, a 15 -point score reduction will be
assessed for each outstanding finding or for failure to submit the required audit reports.
(b) Monitoring Findings. If an applicant has not taken action to resolve any monitoring
findings within the prescribed time frame or by the application deadline date, whichever is
later; has not submitted a monitoring report response from current or previous CDBG- funded
programs; has an unresolved monitoring finding at closeout; or has failed to meet the contracted
for number of jobs in the most recently closed out Economic Development grant, a 15 -point
score reduction will be assessed for each unresolved monitoring finding.
(c) Closeouts. A 15 -point score reduction will be assessed if the required closeout package
has not been received by the Department within 45 days of the expiration date of the contract,
as it may have been amended, or the application date, whichever is later.
(d) Schedule of Accomplishments. The applicant's quarterly status reports are due in the
Department 20 days after the end of the quarter. The most recent grant award under contract
between the Department and the applicant shall be used to evaluate past performance. A 15-
point score reduction will be assessed for each quarterly report not received by the Department
within 20 days after the end of the quarter. ..
(8) Site Visits. At a minimum, site visits shall be conducted by the Department prior to
issuance of a preliminary scoring list for those applicants in the fundable range.
(a) The Department shall notify the local elected official in writing of the date and
approximate time the site visit will take place.

(b) The Department shall examine all documents that have been certified to in the
application by the Town, City or County Clerk.
(c) The Department staff shall determine the validity and accuracy of all information,
representations, and materials submitted or provided by the applicant in the application,
including:
I. Evidence which documents all claims and representations made in the application.
,,. 2. Any documentation to determine the reasonableness of cost in a funding request
pursuant 24 C.F.R. Part 85.
(d) The Department shall request in writing any documentation found to be unavailable or
... inadequate. Applicants shall have seven working days from the date that the request is received
to provide the requested information to the Department.
- (e) If the Department has not received the requested material by 5:00 p.m. on the seventh
working day, the applicant's score and funding request shall be revised accordingly.
(9) Conformance with Local Comprehensive Plan.
(a) If the local government has adopted a local comprehensive plan pursuant to Chapter
163, Florida Statutes, the application shall include a certification that the proposed activities are
in conformance with the applicable elements of the local comprehensive plan.
(b) If the Department determines that an application is not in conformance with the
local comprehensive plan, the application shall be rejected.

9B- 43.007 Scoring System.
(1) The maximum score possible in each program category is 1,000 points. These points
shall be divided among three program factors as specified below. Further point breakdowns for
program impact are found in the rule section pertaining to individual program categories:

(2) Applications which score within the fundable range following appeals shall be awarded
funds for activities which are eligible and meet all other requirements contained herein.
,., (3) Ties. In the event that two or more applications receive an equal final score, the
application addressing the highest State priority goal shall receive first consideration. If a tie
still exists, then the application receiving the highest impact score calculated out 15 decimals,
shall receive first consideration. If a tie still exists, then the applicant with the highest
community -wide needs score shall receive first consideration.

9B- 43.008 Communitv -wide Needs for Housing and Neighborhood Revitalization.
(1) General. Applicants shall not submit data for calculating the community-wide needs
score. The most recent and uniformly available federal and State data for all jurisdictions
eligible to apply shall be collected and analyzed by the Department. Current U.S. Census data
shall be used unless otherwise noted. Data shall be further defined as:
(a) For city applicants, the data relevant for the entire incorporated area, except for
unemployment data which shall be county -wide; ..
(b) For county applicants, the data relevant for only the unincorporated areas within the
county shall be used, except for unemployment data which shall be county -wide;
(c) For joint applicants, data shall be calculated for each jurisdiction as described in
Section 9B- 43.008(3) and the total scores shall be averaged;
(d) For cities incorporated since 1979, enumeration district data for the area that was
incorporated shall be used where available, otherwise a proportion of the county's census data
shall be used to calculate the community -wide needs score. ..
(2) Factors. Seven factors shall be used to determine the community -wide needs score with
the following maximum points available for each:
(a) Number of persons below poverty - 55 points
(b) Percent of persons below poverty - 55 points
(c) Number of year -round housing units with 1.01 or more persons per room - 20 points;
(d) Percent of year -round housing units with 1.01 or more persons per room - 20 points;
(e) Number of year -round housing units with no or 1/2 bath - 30 points;
(f) Percent of year -round housing units with no or 1/2 bath - 30 points; and
(g) Unadjusted unemployment rate average over the past three Federal Fiscal Years; based
on Florida Department of Labor and Employment Security data - 40 points.
(3) Method of Calculation. All eligible Local governments shall be compared on the factors
identified in Section 9B- 43.008(2). Eligible local governments shall be compared on each factor
with all other applicants in their population group as designated in Section 9B- 43.005(2)(a).
Calculating each applicant's score shall include the following steps:
(a) The highest statistic in each population group for each factor identified in Section 9B-
43.008(2) shall be the basis for relative comparison of all other eligible local governments in the

wide needs score adjusted to reflect the funding impact pursuant to Section 290.046(3)(b), F.S.
•• Each local government which previously received any Community Development Block Grant
funds shall have its community -wide needs score reduced by 3 points for every $100,000, or
fraction thereof, of funding disbursed by the Department. This calculation shall be based on all
funds disbursed through the Florida Small Cities Community Development Block Grant program
as of the opening date of the application cycle. The adjusted community -wide needs score
cannot be less than zero.

9B- 43.009 Program Requirements for Housing.
(1) Eligible Housing Activities. The primary objectives of the Housing category are to
improve housing conditions or expand housing opportunities primarily for low and moderate
+ income persons. Activities that could achieve these objectives include, but are not limited to:
(a) The rehabilitation of houses or publicly owned or acquired properties;
(b) Demolition of dilapidated housing and relocation of residents;
(c) Weatherization and energy - efficiency improvements;
(d) Code enforcement;
(e) Installation of wells or septic tanks where water or sewer service is unavailable.
(2) Measurement of Program Impact. The following point breakdown shall be used in
+op measuring program impact for the Housing category. Specific formulas used to calculate points
are found in Form CDBG -H.

(3) Housing Goals. Goals under the CDBG Housing category seek a solution to
substandard housing conditions in targeted low and moderate income housing areas. The
•• primary housing goal is to provide a long -term solution by upgrading housing stock to a
condition that shall last for at least 15 years. A secondary goal is to provide a short -term
solution by upgrading the units to a liveable condition which makes the units safe, decent and
sanitary. Goal point values for specific activities are found in Form CDBG -H.
(4) Housing Survey. A survey of 100% of the proposed housing units to be addressed in
the Housing (CDBG -H -8) application must be conducted during the preparation of an

(a) The survey will verify the need for the proposed activities and certify the number of
projected low and moderate income households, the number of projected very low income
households and the total number of beneficiaries.
(b) The survey will also certify the number of households receiving direct benefit, establish
a structural condition review for the purpose of determining appropriate activities to be ..
completed by the project and measure health and safety indicators.
(c) The survey process shall use the survey instrument provided in the application (CDBG-
H-9) �+
and shall be conducted as defined in 9B- 43.003(43).
(d) Where there is evidence that the survey results substantially overstate the proportion of
persons with very low, low and moderate income, the Department may require the applicant to
- provide supporting evidence which substantiates the survey data. If the survey results are found
to be inaccurate, then the application shall be rejected pursuant to 9B- 43.006(2)(d).
(5) Benefit. Benefit can accrue to both direct and indirect beneficiaries. Activities
involving rehabilitation or acquisition of property to provide housing shall be considered to
directly benefit low and moderate income persons only to the extent that such housing shall, �•
upon completion, be occupied by low and moderate income persons, and for rental units the
units must be occupied by low and moderate income persons at affordable rents.
(6) On an average, at Least one household shall benefit for each $25,000 of CDBG funds
requested or a 25 -point score reduction shall be assessed.

9B- 43.010 Program Requirements for Neighborhood Revitalization.
(1) Eligible Activities. The primary objective of the Neighborhood Revitalization category
is to conserve and revitalize declining low and moderate income service area neighborhoods by
addressing the major problems contributing to such decline. Activities that could achieve this
objective include, but are not limited to:
(a) Improvements to deteriorating infrastructure;
(b) Provision of basic services such as water and sewer facilities where the applicant can
demonstrate sufficient plant capacity and operation to serve such facilities;
(c) The rehabilitation of neighborhood facilities that provide community services for
service area residents;
(d) The construction of facilities for the elderly and the handicapped;
(e) Land assembly or site preparation for new housing construction; or ..►
(f) Provision of roads and drainage facilities.
(2) Measurement of Program Impact. The following point breakdown shall be used in ..
measuring program impact for the Neighborhood Revitalization category. Specific formulas
used to calculate points are found in Form CDBG -N.

(3) Neighborhood Revitalization Category Goals. Goal point values for specific activities

OR (a) Goal 1: To assist local governments with appropriate solutions to serious water and
sewer deficiencies which are detrimental to the public health and safety in areas of
concentrations of low and moderate income persons.
(b) Goal 2: To assist local governments with appropriate solutions to other serious
deficiencies in public facilities which are detrimental to the public health and safety in areas of
concentrations of low and moderate income persons.
(c) Goal 3: To assist local governments with appropriate solutions to deficiencies in public
facilities in areas of concentrations of low and moderate income persons.
(d) Goal 4: To assist local governments with appropriate solutions to deficiencies in land
assembly or site preparation for new housing construction in areas of concentrations of low and
.. moderate income persons.
(e) Goal 5: To assist local governments in providing the elderly and the handicapped with
facilities to meet their special needs and to provide access to all public facilities by the
handicapped.
(f) Goal 6: To assist local governments in providing social service facilities and
.• recreational facilities to persons of low and moderate income.
(4) Service Area Requirements.
(a) An activity conducted in a service area will be considered to benefit low and moderate
income persons when at least 51 percent of the residents of that area are low and moderate
income persons. Such a service area must be the entire area to benefit either directly or
indirectly from the activity.
(b) A survey of 100% of households that are proposed as direct beneficiaries must be
conducted. The survey of the indirect beneficiaries must correspond to the sampling
requirements established in Table B of HUD Circular Letter 88 -61. The survey of indirect and
direct beneficiaries must be conducted during the preparation of an application.

9B- 43.011 Community -wide Needs for Economic Development and Commercial
Revitalization.
(1) General. Applicants need not submit applicable data for calculating the community -
wide needs score. The most recent and uniformly available federal and State data for all
jurisdictions eligible to apply shall be collected and analyzed by the Department. Current U.S.
Census data shall be used unless otherwise noted. Applicable data shall be defined as:
(a) For city applicants, the data relevant for the entire incorporated area, shall be used
except for unemployment data which shall be county -wide; mor
(b) For county applicants, the data relevant for only the unincorporated areas within the
county shall be used, except for unemployment data which shall be county -wide;
(c) For joint applicants, data shall be calculated for each eligible applicant as described in
Section 9B- 43.011(3) and the total scores shall be averaged;
(d) For cities incorporated since 1979, enumeration district data for the area that was
incorporated shall be used where available, otherwise a proportion of the county's census data
shall be used to calculate the community -wide needs score. ...
(2) Factors. Seven factors shall be used to determine the community -wide needs score with
the following maximum points available for each:
(a) Number of persons below poverty - 65 points;
(b) Percent of persons below poverty - 65 points; =l"
(c Number of year -round housing units with 1.01 or more persons per room - 5 points;
(d) Percent of year -round housing units with 1.01 or more persons per room - 5 points;
(e) Number of year -round housing units with no or 1/2 bath - 5 points;
(f) Percent of year -round housing units with no or 1/2 bath - 5 points; and
(g) Unadjusted unemployment rate average over the past three Federal Fiscal Years; based �►
on Florida Department of Labor and Employment Security data - 100 points;
(3) Method of Calculation. All eligible local governments shall be compared on the factors
identified in Section 9B- 43.011(2). Eligible applicants shall be compared on each factor with all
other eligible local governments in their population group as designated in Section 9B-
43.005(5)(a). Calculating each applicant's score shall include the following steps:

(1) Eligible Activities.

(c) Purchase of capitalized machinery and equipment with a useful life of at least 5 years;
(d) Energy conservation improvements designed to encourage the efficient use of energy
resources;
(e) Public, commercial or industrial real property improvements, including railroad spurs or
similar extensions, tied to a specific project; and
(f) Activities to remove barriers which restrict access for the elderly or handicapped to
publicly owned and privately owned buildings, facilities, and improvements.

(2) Ineligible Activities.
(a) Funds shall not be used for working capital, inventory or supplies.

(b) Direct assistance to private business shall not be in the form of a grant.
(c) Funds cannot be used to purchase assets from a business if any principal of the
participating party owns an interest of 20% or more in that business. w
(d) Funds cannot be used to build or develop infrastructure beyond that which is required
as a prerequisite for the job creation by the participating party.
(e) Funds cannot be used to fund activities determined not to be necessary or appropriate
as defined herein.

(3) Eligibility Requirements.
(a) Determining Eligibility for Assistance to Private - for - Profit Organizations. All
Economic Development applications submitted to the Department shall be screened to determine
if the direct assistance to private, for - profit entities is necessary or appropriate to carry out the
Economic Development project. A financial analysis of the project shall be conducted to ..
determine that the minimum amount of assistance is being requested, that the terms and interest
rates are appropriate given the business' debt service capacity, and that the business has the
ability to meet the proposed debt service, given historical financial statements, data and
reasonable projections of revenues and operating expenses, if applicable.
1. Applications which do not contain justification of the necessity or appropriateness of the
assistance being requested shall be ineligible in accordance with federal law and federal ..
guidelines and shall be ineligible for scoring as provided in Section 290.0475, F.S.
2. If, based on the financial analysis of the project, the funds requested exceeds the funds IOW
necessary, the grant request shall be reduced.
(b) Determining Eligibility for Infrastructure Projects. Determination of eligibility for
infrastructure projects shall be based on the type of activities proposed and documentation that r'
benefit to low and moderate income persons shall occur. Applications shall also document that
the business proposing to create jobs is financially viable based on accepted industry standards.
Specific items needed for this determination are found in Form CDBG -E.
(c) Job Commitment. Applicants shall document that the participating party has the
capacity to meet its commitment to provide or retain the jobs specified in the application.
Applications which do not contain evidence of the capacity to provide jobs shall be assessed a
150 -point reduction of their program impact score.
(d) Job Creation or Retention. At a minimum, one permanent job shall be created or •+
retained for every $12,000 of CDBG funds requested. Applications which do not meet the cost -
per -job requirements shall be assessed a 150 -point reduction of their program impact score.
(e) Leveraging of CDBG Dollars. The ratio of the total dollar amount of all private funds
to CDBG funds proposed to be used shall be at least 1:1. Once the 1:1 ratio is met, other non -
CDBG public funds directly linked to the proposed project may be included as part of the
leveraging ratio for scoring purposes. Applicants shall include documentation that all funds
used to meet the leverage requirement are cash, loan, or grant. Previously expended funds or
previously purchased assets shall not be counted as part of the leveraging ratio. Leveraged
funds cannot be used to purchase assets from a business if any principals of the participating —
party owns an interest of 20% or more in that business. Applications which do not meet the 1:1
private leveraging ratio shall be assessed a 150 -point reduction of their program impact score.

(f) Compliance with National Objectives.
1. In determining whether an activity will actually benefit low and moderate income
• persons, the net effect of the completed activity shall be considered. The criteria set forth
below shall be used to determine whether a CDBG funded activity meets the national objective
of an activity benefiting low and moderate income persons.
2. Determination of Benefit of Completed Project.
a. New jobs. The determination of actual benefit to low and moderate income persons
shall be made based on the number and percent of persons who, at the time they were hired,
were low and moderate income persons as defined herein. Should the number of such persons
actually hired be less than specified in the application, then the recipient must document that
�• first priority was given to low and moderate income persons for the required number of jobs.
b. Retained jobs. The determination of actual benefit to low and moderate income
persons shall be made based on the number of low and moderate income persons employed in
the jobs proposed to be retained by the project, plus the number of low and moderate income
persons hired into retained jobs previously held, within the past 2- years, by persons not of low
and moderate income. The calculation of jobs shall be determined as of the date the application
" is submitted. Should the number of such persons actually retained or hired be less than
specified in the application, then the recipient must document that first priority was actually
given to low and moderate income persons for the required number of jobs.

3. Determination of Availability of Jobs to Low and Moderate Income Persons. To
determine that the created or retained jobs have been made available to low and moderate
income persons at least three of the following criteria shall exist:
a. Jobs whose required skills, education and experience would not exclude low and
moderate income persons;

b. The training opportunities to make such jobs available to low and moderate income
persons who would not otherwise qualify;
c. The advertising and recruiting efforts directed toward low and moderate income
persons; and
.. d. The accessibility of the jobs to areas where concentrations of low and moderate income
persons reside.
IMP (4) Information or documentation in applications submitted under the Economic
Development category shall be verified by on -site visits when funds are available or by
consulting pertinent and authoritative published materials such as those available from the U.S.
Census Bureau, U.S. Department of Commerce, Florida Department of Commerce, Florida
Department of Revenue, Florida Department of Community Affairs, Florida Department of
Labor and Employment Security, Florida Chamber of Commerce or Robert Morris Associates.
(5) Program Impact Criteria for the Economic Development Category.
(a) Applications submitted under this category shall be designed to promote the provision
•� of long -term jobs with growth potential, principally for low and moderate income persons; the
investment of private capital; the development of local economic enterprises; and the expansion
of local tax bases.

9B- 43.013 Program Requirements for Commercial Revitalization.
(1) Eligible activities. All activities must be in accordance with an adopted community
redevelopment plan as defined herein and must be shown by diagram and in narrative terms as ••
required in Section 163.362, F.S. All activities must be geographically and physically located
within the boundaries of the community redevelopment area and be contiguous to or located on
property which is utilized for a non - residential use as of the application deadline date.
(a) To acquire substandard or blighted areas or portions thereof, including lands, structures
or improvements when acquisition is necessary or incidental to the proper clearance,
development, or redevelopment of such community redevelopment area;
(b) To clear any such areas by demolition or removal of existing buildings, structures,
streets, utilities, or other improvements and to install, construct or reconstruct streets, utilities,
parks, playgrounds, public spaces, public parking facilities, sidewalks, bus stop shelters,
lighting, benches or other similar furniture, trash receptacles, shelters, pedestrian and vehicular
overpasses and underpasses and any other necessary public improvements essential to the
preparation of sites for use in accordance with a community redevelopment plan. Installation of
sewer and water utilities must demonstrate that sufficient plant capacity presently exists to serve
such water and sewer facilities;
(c) To sell, lease, or otherwise make available land in such areas for residential,
recreational, commercial, or other use, including parking or other facilities functionally related
or subordinate to such use, or for public use or to retain such land for public use, in accordance
with a community redevelopment plan;
(d) To dispose of all real and personal property or any interest in such property, or assets,
cash or other funds held or used in connection with residential, recreational, commercial or
other use, including parking or other facilities functionally related or subordinate to such use,
or any public use specified in a community redevelopment plan or project, except that such
disposition shall be at its fair market value;
(e) To carry out plans for a program of voluntary or compulsory repair and rehabilitation
of building facades or other exterior improvements affecting exterior appearance and the

correction of code violations in conformance with the community redevelopment plan. At least
one building shall be rehabilitated for every $10,000 of CDBG funds requested for this activity;
and
(f) Funds requested and approved for Commercial Revitalization activities shall not be used
as grants or loans for working capital, inventory or supplies, or for interior repairs and
NIB renovations, except for repairs necessary to correct code violations.
(2) Program Requirements. Applicants shall include a description of the role of CDBG
financing in the solution of the problem. If the project. involves assistance to private entities,
the applicant shall identify the private entities in the application and document that the amount
and terms of the assistance are the minimum amounts necessary to carry out the project.
r (3) Service Area Requirements
(a) An activity conducted in a service area will be considered to benefit low and moderate
income persons when the benefits are available to all residents in a particular area where at least

51 percent of the residents of that area are low and moderate income persons. Such a service
area must be the entire area served by the activity, and must encompass the entire geographic
area contained in one or more census tracts, enumeration districts or block groups of the most
""' recently available decennial census information.
(b) In determining whether there is a sufficiently large percentage of low and moderate
OD income persons residing in the area to be served by an activity in order to qualify under this
Section, the most recently available decennial census information shall be used to the fullest
extent feasible, together with the Section 8 income limits that would have applied at the time
the income information was collected by the Bureau of Census, unless the applicant chooses to
sit use a surveyed area as provided in paragraph 3.
(c) In those instances where the census data does not reflect current relative income levels
MD in a service area, census boundaries do not coincide sufficiently with the service area of an
activity, and the population of the service area exceeds 2,500 the applicant may establish a
service area whose boundaries are not Less than a one -half mile radius and not greater than a
one mile radius, with its center point at the central point of the activities to be funded. Those
applicants whose service area population is less than 2,500, shall define their service area
boundaries to be coterminous with the established city limits at the time of the application
deadline date. To determine the percentage of low and moderate income residents of the area,
applicants must conduct a current survey of the residents of the area to determine the
percentage of such persons who are low and moderate income. Where there is substantial
evidence that the survey results substantially overstate the proportion of persons that are low
•. and moderate income, the Department may require the applicant to rebut such evidence and
provide satisfactory proof of the accuracy of such survey. Such surveys shall be conducted as
defined herein.
(4) Program Impact Criteria for the Commercial Revitalization Category.
(a) Applications submitted under this category shall be designed to conserve and revitalize
commercial areas that serve or employ principally low and moderate income persons and that
are showing signs of decline, through a concentrated approach to addressing the problems which
contribute to the decline.
(b) Program Impact criteria for Commercial Revitalization shall be based on the following
factors with the assigned number of points:

located in areas of concentrations of LMI persons.
(b) Goal 2: To assist local governments in providing assistance to private- for - profit
businesses to improve building facades and code violations.
(c) Goal 3: To assist local governments in improving other public facilities in the
commercial area.

' 9B- 43.014 Grant Administration for All Cateeories.
(1) Procurement Procedures. Grant funds may be used to procure commodities and
services only in accordance with written procurement procedures adopted by the recipient and
certified by the chief executive officer of the recipient as meeting or exceeding the minimum
standards set forth in this subsection.
(a) Such procedures shall:
1. Apply to all procurements of commodities or services in connection with Community
Development Block Grants;
2. Comply with applicable provisions of all State and federal laws and regulations
governing the Florida Small Cities Community Development Block Grant program;
3. Provide a dollar amount not greater than $600 above which all procurements shall be
evidenced by a written agreement embodying all provisions and conditions of the procurement;
4. Provide a dollar amount not greater than $2,000 above which all procurement
agreements shall be entered only after competition. Procurements for amounts greater than the
threshold provided in this paragraph but not greater than the threshold provided in paragraph 5
may be entered after informal competition based on offers or price quotations from three
sources;
5. Provide a dollar amount not greater than $3,000 above which all procurement
agreements shall be entered only after an invitation to bid or request for proposals, as defined
in s. 287.012, F.S., has been published and notice of the solicitation has been given to potential
bidders or offerors. Sealed bidding shall be used unless the recipient's chief executive officer
or chief purchasing officer certifies in writing that sealed bidding is not practicable or

r advantageous, in which case the procurement shall be based on sealed proposals;
6. Provide that, except as otherwise provided by law, procurement awards shall be made
only on the basis of requirements and evaluation factors that are directly related to the price or
quality of the commodities or services or to the ability of the prospective supplier or contractor
to perform under the agreement. In evaluating the ability of a prospective contractor to
,. perform, the recipient shall at a minimum consider the prospective contractor's record of past
performance under CDBG grants;
7. Include procedures for publishing invitations to- bid and requests for proposals and for
giving notice of both formal and informal solicitations of bids and offers; and
8. Include procedures for documenting every required step or activity in the procurement
process for each procurement.
(b) A recipient's procurement procedures may provide exceptions from the requirement of
Igo competition for commodities and services available only from a single source and for
procurements from another unit of government.
(c) In procuring services for grant administration, recipients shall evaluate any economies
of scale or other means of securing efficiency that may be available as a result of the type,
number and geographic distribution of grants to be administered by the recipient or by a
prospective grant administrator.
(d) An eligible local government shall not contract with the same individual or business
entity for more than one of the services listed in s. 290.047(5), F.S., unless, for each such
service, it can demonstrate that such individual or entity is the sole source for the service or is
the responsive proposer whose proposal has been determined in writing, as a result of a
competitive process in accordance with the local government's procurement procedures, to be
the most advantageous to the local government.
(e) The provisions of this subsection shall not be construed to conflict with or supersede
the requirements of s. 287.055, F.S., or any other applicable State or federal law.
(2) Contract. Upon award of funds by the Department, a written contract shall be
executed by the local government and returned to the Department within 30 days after receipt
of the contract by the local government which specifies the terms and conditions of the award.
The term of the original contract shall not exceed 24 months. The following shall become a
part of the contract:
(a) The approved application with its statement of assurances and clerk's certification;
(b) The approved activity budget, work plan, which establishes the goals and
accomplishments and beneficiaries; and
(c) Any applicable evidentiary materials;
(d) Any special conditions as determined by the Department.
(3) Fulfillment of Special Conditions. Applicants who are awarded funding under this part
-• shall have 90 days, unless otherwise amended utilizing the amendment procedure described in
Section 9B- 43.014(6), to provide the Department with legally binding commitments and all other
necessary evidentiary materials to be specified in the contract. No project funds shall be
released to the recipient until the required evidentiary materials are received and approved by

the Department. The Department shall terminate its obligation to fund the recipient if the

recipient is unable to comply with the evidentiary materials submission requirements.
(4) Method of Fund Distribution.
(a) No payment from the Department shall be for an amount less than $5,000, unless it is a
recipient's last draw.
(b) Recipients may maintain cash -on -hand in amounts of $5,000 or less for more than five
days to meet daily cash needs.
(c) All requests for advance payments shall be for immediate disbursement needs. The
timing and amount of cash advances shall be as close as feasible to the actual disbursement by
the recipient not to exceed five working days.
(5) Escrow Accounts. Recipients may draw down CDBG funds and deposit them into an
escrow account for property rehabilitation in order to encourage the participation of small and
minority -owned contracting firms. Escrow accounts may be established when direct grants or
loans are made to owners of private property for the purpose of property rehabilitation.
(6) Program Amendments and Budget Revisions.
(a) The recipient may propose an amendment to its contract by submitting a request for
program amendment to the Department on forms provided by the Department.
(b) Any proposed amendment which would change or alter by more than 10% of the
original contracted amount for the amount of funds budgeted for an activity, the number of
beneficiaries or the amount of accomplishments included in its Award Agreement, shall require
prior written Department approval. Also, any proposed amendment modifying the time -frame
of the contract shall require prior written Department approval.
(c) Any proposed amendment which would change or alter by 10% or less the original
contracted amount for the amount of funds budgeted for an activity, the number of
beneficiaries or the amount of accomplishments included in its Award Agreement shall be
submitted in writing to the Department on forms provided by the Department.
(d) Except as provided in paragraph (e), all amendments requiring prior written
Department approval shall be reviewed by the citizen advisory task force required in Section
290.046(6), F.S.; shall involve at least one public hearing to consider comments and views
expressed by citizens on the proposed amendment prior to submitting the amendment to the
Department for approval; and shall have the approval of the local governing body. �►
(e) All requests for contract amendments requiring prior written approval under (b) above
by the Department shall include the following written documentation as criteria to be
considered. Amendments which are only to extend the termination date of the contract or
extend the time for submission of evidentiary materials to satisfy any contract conditions do not
require that a public hearing be held or reviewed by a citizen advisory task force:
1. A request for amendment shall outline all changes in budgetary amounts, beneficiaries,
or scope of accomplishments;
2. Detailed narrative description of the proposed changes and their effect upon the
approved project, demonstrating that the change in scope of work is economically feasible
relative to the number of beneficiaries and the funds expended;

3. Revised work plan for each activity affected by the amendment;
rr 4. Revised budget summary showing the current approved budget and the revised budget
for each activity;
5. If any change in location, legible map which indicates
the proposed changes;
6. Copy of the public notice, which shall evidence compliance with 9B- 43.003(39);

7. Copy of the minutes of the meeting of the citizens advisory task force at which the
proposed amendment was reviewed; and
8. Signature of approval by the chief elected official or resolution from the local
governing body authorizing the proposed amendment.
(f) Any proposed amendments that shall reduce the scope of work or intended beneficiaries
by 20 percent or more from the original contract shall not be approved by the Department
unless the recipient can demonstrate to the satisfaction of the Department that the need for the
proposed reduction occurred due to circumstances beyond the control of the recipient. The
reduction shall be measured based on a weighted average of the line items proposed for
reduction. Local governments which cannot meet the program objectives without such an
amendment, shall have the contract terminated for cause. All other amendments shall be
reviewed as specified in (e) above.
(g) Recipients shall be limited to four amendments, that the recipient initiates, over the

term of the grant award agreement.
(h) All amendments requesting an extension of the termination date of the contract shall be
r received by the Department at least 45 days prior to termination date.
(7) Grant Closeout.
(a) The Department shall advise the recipient to initiate closeout when the Department
determines, in consultation with the recipient, that there are no impediments to closeout, the
recipient does not have any outstanding monitoring findings, and the recipient has performed all
"' elements of its scope of work.
(b) Upon completion of the activities contained in the recipient's CDBG contract, including
any amendments, the recipient shall submit to the Department a closeout package which gives
the final statement of costs, certifies that the project is completed and reports demographics of
the program's beneficiaries. The closeout package shall also contain a map which shall
geographically depict the activities completed during the term of the CDBG grant.
(8) Performance.
(a) Reporting. At a minimum, the recipient shall provide the Department with quarterly
status reports and with a final closeout package.
.w I. Quarterly reports are due within 20 days of the conclusion of each calendar quarter
until submission of the final closeout package. Failure to have accurate and complete reports
received by the Department on the due date shall result in suspension of funding pending
receipt of such delinquent report or reports.

2. A closeout package is due within 45 days after expiration of the grant award agreement
or within 45 days after completion of all activities, whichever comes first. Failure to have the

closeout package received by the Department on the due date shall result in a score reduction as
provided in Section 9B- 43.006(7)(c) and may affect eligibility as provided in Section 9B-
43.004(9).
3. Recipients shall also submit such reports as may be necessary, pursuant to 24 C.F.R.
570.905, "Reports to be Submitted by the Recipient "; 570.906(b), "Performance Report," and
other applicable laws governing the CDBG program as outlined in the contract assurances or as M.
may be further required by the Department to document program compliance.
(b) Monitoring by the Recipient. Recipients shall constantly monitor their own
performance under grant- supported activities to ensure that time schedules are met, projected
milestones are accomplished within specified time periods, and other performance goals are
achieved. Such review shall be made for each program, function, or activity as set forth in the
grant application and award agreement. ..•
(c) Monitoring by the Department. The Department shall review each recipient's
performance periodically to determine whether the recipient has substantially completed its
program as described in the approved application and the grant award agreement in accordance
and compliance with the requirements of Sections 290.041 -049, F.S., this rule, and other
applicable State and federal laws and regulations.
1. The Department shall review each recipient's performance in accordance with
applicable portions of 24 C.F.R. 570.901, "Review for Compliance with Primary Objectives."
2. Department review of the recipient's performance shall include site visits as frequently
as necessary to evaluate program accomplishments and management.
3. Recipients shall be required to supply data and make available records as are necessary
to complete an accurate evaluation of contracted activities.
(d) Remedies. When the Department determines on the basis of a review of the recipient's "'
performance, that the terms of the grant award contract are not being met, the Department
shall:
1. Initiate actions as prescribed in 24 C.F.R. 570.910(b), "Corrective and Remedial
Actions" and 570.911, "Reduction, Withdrawal, or adjustment of Grant or other appropriate
action."
2. If at anytime after the effective date of a grant award agreement, the Department
determines that an activity to be funded is not eligible pursuant to 24 C.F.R. Part 570, the
Department may unilaterally modify the contract to delete the ineligible activity and deobligate
any unencumbered funds.
(9) Displacement and Relocation.
(a) Recipients are required to develop a written plan for assisting persons who may be
displaced as a result of activities assisted with CDBG funds and to set forth actions that the
recipient shall take to mitigate any adverse effects resulting from CDBG funded activities that
may cause such displacement. This plan shall be in accordance with applicable federal
regulations which may be promulgated from time to time.

(b) If the CDBG funded activity involves the acquisition of real property by the local
government, which causes displacement of persons, the federal "Uniform Relocation Assistance
and Real Property Acquisition Policies Act of 1970," as amended, shall apply. For activities
.• resulting in displacement of persons that do not involve the acquisition of real property, and
thus not subject to the "Uniform Act," the local government shall be required to develop a local
written policy setting forth the assistance it elects to provide for such persons.
(c) The recipient shall make its displacement and relocation policy available to the public.
