BUILDING PERMIT FEES FOR HABITAT FOR HUMANITY'tiF
THE UPPER KEYS FOR THE AFFORDABLE HOUSING
PROJECT AT 104 FIRST STREET ALSO KNOWN AS
MANDALAY, LEGALLY DESCRIBED'AS MANDALAY PB 1-,

WHEREAS, Habitat for Humanity of the Upper Keys (HHUK) is the lessee of property owned
by Monroe County at 104 First Street in Key Largo, (RE#00554720.000000 and
00554720.000100) , pursuant to an Occupancy Agreement and Ground Lease dated May 20,
2009, as amended by Amendment Number 1, and Amendment Number 2; and
WHEREAS,the purpose of the lease as amended is to construct seven affordable employee
housing units on the property, known as the Mandalay project;-and
WHEREAS, Monroe County Code Section 6-108(e) allows waivers from the building permit
fees for affordable housing as follows:
Waivers.Any entity may apply to the board of county commissioners for fee waivers from
the building permit and building permit application fees for construction or renovation of
affordable, low or very low income housing intended for occupancy for those households
with income up to 120 percent of the median annual adjusted gross income as defined
by Monroe County. Persons or entities which have a development order in effect as of
February 17, 2010 for affordable housing may apply for such fee waivers. Persons or
• entities building affordable housing which uses a higher percentage median income than
120 percent for qualification for occupancy may apply for a waiver from building permit
and permit application fees only if the specific project for development is being subsidized
with or is leveraging state or federal funding.All such waivers apply only to the individual
housing units being constructed. There are no other waivers of permit fees.
WHEREAS, HHUK will be constructing dwelling units for occupancy for households
with income up to 120 percent of the median annual adjusted gross income or lower and
has requested'a waiver of building permit fees;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA:
Pursuant to the Monroe County Code, building permit fees are waived for the-dwelling
• Units proposed to be built by HHUK at the Mandalay property as long as the units are for
occupancy of owners or tenants with income up to .120 percent of the median annual
adjusted gross income as defined by Monroe County.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, -
Florida at a regular meeting held on the 20th day of June, 2012.
