Dear Mike:
The following is a synopsis of the activity of zoning
prosecutions for the month of October 1979:
CASES CLOSED IN OCTOBER
State vs. Iry Friedman: defendant pled guilty to
failure to post a building permit and agreed to obtain
an after the fact permit according to the specifications
of the Zoning Department.
State vs. Hamilton: defendant pled guilty to unlawful
land clearance without a permit, paid a fine in the amount
of $100.00 plus costs.
State vs. James R. Green: defendant pled guilty to
unlawful land clearing without a permit, paid a fine in
the amount of $50.00 plus costs.
CASES OPENED IN OCTOBER
State vs. Thaler: Unlawful fill without permit.
State vs. Carter: Unlawful fill without permit.
State vs. Gray: Unlawful fill without permit.
State vs. Banks: Unlawful fill without permit.
State vs. Albury: Unlawful fill without permit.
MISCELLANOUS TRAVEL, MEETINGS, AND HEARINGS
Marathon, Wednesday, October 10, 1979, negotiated
plea hearing on State vs. Schmit and State vs. Green.
Thursday, October 11, 1979, two hour meeting with
Chuck Schnepel, U.S.C.O.E., Present was John Carbon
representing Monroe County. Mutual concerns and overlap-
ping areas of prosecution were discussed and it was agreed
that a joint effort would be made in providing information
regarding violations of overlapping regulations and laws.
October 16, 1979, one hour conference with Sally Link
of Building and Zoning regarding numerous complaints from
White Marlin Beach regarding storage of fish traps on vacant
land. It was agreed that at the conclusion of lobster sea-
son that prosecutions would be instituted on vacant land
where traps are stored.
October 22, 1979, Court appearance regarding State vs.
Friedman in Plantation Key.
Thursday, October 25, 1979, Conference with Sally
Link, Building & Zoning Department regarding complaints
on land owner who had partially constructed fence and
abandoned same. Letter was sent demanding removal or
completion within 30 days otherwise prosecution would be
instituted.
Monday, October 29, 1979, Court appearance, Plantation
Key, RE: State vs. Hamilton.
Tuesday, October 30, 1979, Court appearance, Planta-
tion Key, RE: State vs. Carter, State vs. Thaler, State vs.
Albury, State vs. Banks.
COMPLAINTS RECEIVED FOR OCTOBER
Ocean Farming Systems made a complaint regarding the
use of dynamite on an adjacent vacility. Art Stevenson and
the State Fire Marshall are currently investigating this
problem. I will advise.
