AN ORDINANCE AMENDING ORDINANCE NO 032-1998, SECTION 5(A), MONROE
COUNTY CODE, IN ORDER TO EXCLUDE THE PURCHASE OF INSURANCE POLICIES

5(C), MONROE COUNTY CODE, IN ORDER TO ELIMINATE THE REQUIREMENT THAT

AN EXISTING CONTRACT OF ANOTHER GOVERNMENT AGENCY DO NOT HAVE TO

THE PURCHASING DIRECTOR TO INQUIRE OF OTHER VENDORS TO DETERMINE IF A

THE TERMS OF A DECLARATION OF STATE OR LOCAL EMERGENCY; PROVIDING FOR
SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES INCONSISTENT
HEREWITH; PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE

Section 1. Section 5(a) of Ordinance no. 03-1998 i s hereby amended t~ ~:::o

(a) This Ordinance applies to all County contracts for services (excludi~ s 'icfIi ~
covered by the Consultants' Competitive Negotiation Act. Sec. 28Pb5, F.9:' C
utility/local telephone services. legal service, and insurance policiesl goods, and
public works, (excluding change orders authorized under a lawfully executed
County/contractor contract) that are, in accordance with generally accepted
accounting principles, expected to cost $25,000 or more. A contract may not be split
into multiple contracts for services, goods or public improvements for the purpose of
evading the requirements of this Ordinance.
Section 2.
Section 5(c) of Ordinance No, 032-1998 is hereby amended to read:
(c) When the goods or services sought are expected to cost $25.000 or more and
are available to the County through an existing contract between a vendor and the
State of Florida, the United States, or another Florida county, municipality or special
district. then compliance with the terms of this Ordinance is not required. However.
before any purchase is made through an existing contract, the Purchasing Director
must first contact other South Florida vendors in order to determine if the goods or
services sought are availGlble at a lower price than the price(s) of the existing
contract. If the goods or services are available from another vendor at a lower than
the price of the existing contract, then the contract for the goods or services must be
awarded to that vendor, The purchase of the goods or services sought may be
made through the existing contract if none of the other vendors contacted by the
Purchasing Director offered the goods or services at a price lower than the price of
the existing contract.
Section 3,
Section 11 of Ordinance No. 032-1998 is hereby amended to read:
Section 11. a) The Board of County Commissioners may dispense with the
bidding provisions of this ordinance and contract directly for services, goods or
public works in the case of an emergency. For the purposes of this ordinance, an
emergency means:
1. An immediate danger to the public health or safety; or
2. A danger of loss of public or private property that requires
immediate government action; or
3. An interruption in the delivery of an essential governmental
service; or
4. A substantial risk that a funding source of a contract will be
diminished or lost because the time required to competitively award bids
after the funds become available exceeds the time within which the funding
source must be spent.
b) The Mayor, or in his or her absence, the Mayor pro tem, may waive the
provisions of this ordinance in an emergency following a natural or man made
disaster. Such a waiver continues until the first meeting of the Board of County
Commissioners following the disaster. At that meeting the Board may elect to extend
the waiver if the emergency so requires.
c) Nothing in this ordinance may be construed to prohibit the Mayor, Mayor
pro tem or other County officer from directly contracting for goods and services on
behalf of the County during an emergency following a natural or man made

disaster when permitted by statute or the terms of a state or local emergency
declaration,
Section 4,
If any section, subsection, sentence, clause or provision of this ordinance is
held invalid, the remainder of this ordinance shall not be affected by such invalidity.
Section 5.
All ordinances or parts of ordinances in conflict with this ordinance are hereby
repealed to the extent of said conflict.
Section 6.
The provisions of this ordinance shall be included and incorporated in the
Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and
shall be appropriately renumbered to conform to the uniform numbering system of the Code.
Section 7.
This ordinance shall take effect immediately upon receipt of official notice
from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with
said Office.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida, at a
regular meeting of said Board held on the 12th day of May, 1999.

Enclosed please find a certified copy of Ordinance No. 019-1999 amending
Ordinance No. 032-1998, Section 5(A), Monroe County Code, in order to exclude the
purchase of insurance policies from the applicability of the Purchasing Ordinance;
amending Section 5(C), Monroe County Code, in order to eliminate the requirement that
goods or services with an expected value of $25,000+ available through an existing
contract of another government agency do not have to go out for bid to detennine if a
lower price is available but requiring the Purchasing Director to inquire of other
vendors to detennine if a price for the goods or services below that of the existing
contract is available; amending Ordinance No. 032-1998, Section 11, MCC, in order to
provide that the Mayor or Mayor Pro Tern may waive the requirements of the Monroe
County Competitive Bid Ordinance in an emergency following a natural or man made
disaster and clarifying that the Mayor, Mayor Pro Tern or other County officer may
contract for goods and services with a value of $25,000+ during an emergency following
a natural or man made disaster when pennitted by statute or the tenns of a Declaration
of State or Local Emergency; providing for severability; providing for repeal of all
ordinances inconsistent herewith; providing for incorporation in the Monroe County
Code; and providing an effective date.
