AN ORDINANCE PROVIDING FOR DEFINITIONS; PROHIBITING THE DISCHARGE
OF SEWAGE FROM VESSELS INTO THE WATERS OF THE FLORIDA KEYS, WITHIN
ZONES SPECIFIED IN THIS ORDINANCE TO INCLUDE COW KEY CHANNEL, BOCA
CHICA CHANNEL, NEWFOUND HARBOR/PINE CHANNEL, BAHIA HONDA
CHANNEL, BOOT KEY HARBOR; BONEFISH BAY, COCOPLUM BAY, LONG KEY
BIGHT, LITTLE BASIN AREA, WINDLEY HARBOR ANCHORAGE, COWPENS
ANCHORAGE, COMMUNITY HARBOR, ROCK HARBOR, SUNSET
COVE/BUTTONWOOD SOUND, TARPON BASIN, BLACKWATER SOUND, LAKE
SURPRISE, AND PUMPKIN KEY ANCHORAGE; PROVIDING THAT THE OWNERS OR

WHEREAS, the tropical waters surrounding the Florida Keys contain an
ecologically diverse tropical marine ecosystem, including the only coral reef system in
the continental United States;
WHEREAS, these waters are of such great interest and beauty, and hold such
concern for protection, that the State of Florida has designated them as Outstanding
Florida Waters and Congress has designated them as a part of the Florida Keys
National Marine Sanctuary; and
WHEREAS, these low nutrient (oligotrophic) waters are highly susceptible to
damage from chronic sources of pollution; and
WHEREAS, many nearshore water areas tend to accumulate pollutants, such as
wastewater nutrients, more readily than other areas because they are in protected wind
shelters or are semi-enclosed, or enclosed waterbodies and therefore do not exchange
rapidly with adjacent open water areas; and
WHEREAS, in particular, areas depicted on the map attached as Exhibit A,
including Cow Key Channel, Boca Chica Channel, Newfound Harbor/Pine Channel,
Bahia Honda Channel, Boot Key Harbor; Bonefish Bay, Cocoplum Bay, Long Key
Bight, Little Basin Area, Windley Harbor Anchorage Harbor, Cowpens Anchorage,
Community Harbor, Rock Harbor, Sunset Cove/Barnes Sound, Tarpon Basin,
Commissioner Nora Williams
Blackwater Sound, Lake Surprise, and Pumpkin Key Anchorage have restricted water
exchange; and
WHEREAS, these same areas, especially during the winter months, have a large
number of vessels, some engaged in navigation, but with a large majority of vessels in
permanent residence; and
WHEREAS, many of those vessels discharge sewage directly into these areas
with consequent pollution injuries to the adjacent marine ecosystem; and
WHEREAS, the situation just described requires greater environmental
protection, vis a vis vessel sewage discharges, than that afforded by the applicable
Federal standards found in the 33 USCA 1322; and
WHEREAS, to protect the tropical marine ecosystem and coral reefs adjacent to
these areas serves to protect not only a vital economic resource of Monroe County,
Florida, but an ecosystem that is the common heritage of all citizens of the United
States; and
WHEREAS, such protection sufficiently justifies a prohibition on all vessel
sewage discharges within the areas depicted in Exhibits A through 0; and
WHEREAS, pump-out facilities or pump-out vessel services are or will be
available in the areas depicted in Exhibits A through 0,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA;
Section1. Definitions.
a.) No Discharge Zone means any of those areas located in the waters of the
State of Florida depicted in detail on the maps attached as Exhibits A through 0 of this
Ordinance.
b.) Discharge includes, but is not limited to, any spilling, leaking,
pumping, pouring, emitting, emptying or dumping.
c.) Sewage means human body wastes and wastes from toilets and
other receptacles, including approved Marine Sanitation Devises (MSD) intended to
receive or retain body wastes, whether treated or raw.

d.) Vessel is synonymous with boat as referenced in s.1(b) Art. VI I, of
the State Constitution and includes every description of watercraft, barge, houseboat
and air boat, other than a seaplane on the water, used or capable of being used as a
means some transport or water.
e.) Person means an individual, partnership, firm, corporation,
association, or other entity, but does not include an individual on board a public vessel
or the owner of a public vessel.
f.) Public vessel means a vessel owned or a bareboat chartered and
operated by the United States, the State of Florida, Monroe County, or by a foreign
nation, except when such vessel is in commerce.
g.) Owner means the individual, other than an individual aboard a
public vessel, in actual physical control of a vessel.
h.) Owner means a person, other than a leinholder, having the
property in or title to a vessel. The term includes a person entitled to use or possession
of a vessel subject to an interest in another person, reserved or created by an
agreement and securing payment of performance of an obligation, but the term
excludes a lessee under a lease not intended as security.
i.) Marine sanitation device includes any equipment installed on board
a vessel which is designated to receive, retain treat discharge sewage and any process
to treat such sewage.
j.) Pump-out station means a facility that pumps or receives human
body wastes and other effluent out of marine sanitation devise installed on board
vessels.
k.) Mobile pump-out vessel means any vessel capable of pumping out
and receiving human body wastes and other effluent contained in marine sanitation
devises installed aboard other vessels.
Section 2. Prohibition of sewage discharge from vessels in the No Discharge
Zones. The owner or operator of a vessel shall not suffer, permit, cause or allow, the
discharge of sewage from that vessel into the waters of the No Discharge Zones
depicted in Exhibits A through O.

Section 3. Pump-out requirements for certain vessel. The owner or operator
of a vessel that is on the waters located within any No Discharge Zone for a period of
greater than seventy-two (72) consecutive hours shall cause the vessel's marine
sanitation device tank to be pumped out at one of the pump-out stations described on
Exhibit P and, if the owner or operator of such vessel causes it to remain in one of the
No Discharge Zones in excess of seventy-two (72) consecutive hours, then the owner
or operator shall cause the vessel's marine sanitation device tank to be pumped-out at
one of the pump-out stations described in Exhibit P on an as needed basis but no less
frequently than one time every two weeks (Sunday through Saturday). If a vessel is not
equipped with a marine sanitation device capable of retaining sewage for pump-out,
and the vessel remains in one of the No Discharge Zones depicted in Exhibits A
through 0 for twenty-four (24) consecutive hours, then the owner or operator shall:
a.) Cause the vessel to be attached via quick disconnect plumbing to shoreside
sewage disposal; or
b.) Berth the vessel, when not in use in navigation, at a marina that has toilet
and bathing facilities available.
Section 4. Force and Effect
a.) This Ordinance becomes effective in a No Discharge Zone identified on maps
in Exhibits A through 0, when a land based pump-out station, as identified in
Exhibit P, becomes available within two miles by boat of the Zone's closest
approach to the individual No Discharge Zone; or when
b.) a mobile pump-out vessel begins providing at least weekly service within the
area of the No Discharge Zone.
Section 5. Additional No Discharge Zones Proposed
a.) At any regularly scheduled meeting of the Board of County Commissioners
and after duly and legally noticed public hearings, additional No Discharge Zones
may be added by amendment to this Ordinance. Appropriate maps shall be
added to the list of exhibits, which accompany the ordinance at the time of
amendment along with updates of the available pump-out facilities.

Section 6. Penalties and enforcement.
a.) A violation of this Ordinance is a noncriminal infraction under
Section 327.73 (1), F.S. Each violation is a separate offense. The owner and
operator of any vessel are jointly and severally liable for the civil penalty imposed
pursuant to this section.
• b.) Any person cited for a violation of this Ordinance is deemed
charged with a noncriminal infraction, must be cited for such an infraction, and
must be cited to appear before the county court. Citations may be issued
pursuant to Sec. 372.74, Fla. Stat. (uniform boating citations) by any law
enforcement agency authorized to issue such citations. The civil penalty for
such infraction is $50.00, except as otherwise provided in this section.
c.) Any person cited for an infraction under this section may:
1. Post a bond, which must be equal in amount to the
applicable penalty; or
2. Sign and accept a citation indicating a promise to
appear. The officer may indicate on the citation time and location of the
scheduled hearing and must indicate the applicable civil penalty.
d.) Any person who willfully refuses to post a bond or accept and sign a
summons is guilty of a misdemeanor of the second degree.
e.) Any person charged with a noncriminal infraction under this section may:
1. Pay the civil penalty, either by mail or in person with
10 days of the date of receiving the citation, or
2. If he has posted bond, forfeit bond by not appearing
at the designated time and location.
If the person cited follows either of the above procedures, he is deemed to have
admitted the infraction and to have waived his right to a hearing on the issue of

commission of the infraction. Such admission may not be used as evidence in any of
the proceedings.
f.) Any person electing to appear before the county court, or who is required to
appear, is deemed to have waived the limitations on the civil penalty specified in
subsection (a). the county court, after a hearing, must make a determination as
to whether an infraction has been committed. If the commission of an infraction
is proved, the county court may impose a civil penalty not to exceed $500.
g.) At a hearing under this chapter the commission of a charged infraction must
be proved beyond a reasonable doubt.
h.) If a person is found by the county court to have committed an infraction, he
may appeal that finding to the circuit court.
Section 7. Severability.
If any section, subsection, sentence, clause or provision of this Ordinance is held
invalid, the remainder of this Ordinance shall not be affected by such invalidity.
Section 8. Repeal of inconsistent ordinance clauses.
All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby
repealed to the extent of said conflict.
Section 9. Inclusion in the Monroe County Code.
The provisions of this Ordinance shall be included and incorporated in the Code
of Ordinances of the County of Monroe, Florida, as an addition to amendment thereto,
and shall be appropriately renumbered to conform to the uniform numbering system of
the Code.
Section 10. Effective date
This Ordinance shall be filed with the Office of the Secretary of State of the State
of Florida, but will not take effect until approved by the State of Florida and the U.S.
Environmental Protection Agency.
