Board of County Commissioners ORDINANCE NO 045 -1999 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, PROVIDING FOR DEFINITIONS; PROVIDING FOR AN ADDITIONAL $25,000 HOMESTEAD EXEMPTION FROM TAXES LEVIED BY THE BOARD OF COUNTY COMMISSIONERS FOR PERSONS WHO HAVE LEGAL OR EQUITABLE TITLE TO REAL ESTATE THAT IS THEIR PERMANENT RESIDENCE, HAVE A HOUSEHOLD INCOME THAT DOES NOT EXCEED $20,000 (AS ADJUSTED FOR INFLATION) AND HAVE ATTAINED THE AGE OF 65; PROVIDING THAT TAXPAYERS CLAIMING THE EXEMPTION MUST FILE ANNUALLY WITH THE PROPERTY APPRAISER A SWORN STATEMENT OF HOUSEHOLD INCOME; DIRECTING THE CLERK TO DELIVER A COPY OF THIS ORDINANCE TO THE PROPERTY APPRAISER BEFORE DECEMBER 1, 1999; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE OF ORDINANCES; AND PROVIDING AN EFFECTIVE DATE LO o � 4.13 - 1=- BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MCiEIPT CEUNIT, rn -r C7' _-- N '1 1 FLORIDA: (=c-3• cp Section 1. Definitions. icr? -Tt.. s N n a) "Household" means a person or group of persons living togeth r irtra �m r group of rooms as a housing unit, but the term does not include persons boarding in or renting a portion of the dwelling. b) "Household income" means the adjusted gross income, as defined in s. 62 of the United States Internal Revenue Code, of all members of a household. Section 2. Grant of additional homestead exemption to certain persons 65 or older. a) The Monroe County Board of County Commissioners hereby grants an additional homestead exemption of$25,000 to any person who has the legal or equitable title to real estate and maintains thereon permanent residence as owner, who has attained the age of 65, and whose household income does not exceed $20,000, or the inflation adjusted amount provided for in Sec. 196.075(3), Florida Statutes. b) The exemption granted in subsection 2(a) of this Ordinance applies only to taxes levied by the Monroe County Board of County Commissioners. c) Any taxpayer`claiming the exemption granted in subsection 2(a) of this Ordinance must\\annually submit to the Property Appraiser, not later than March 1, a sworn statement of household income on a form prescribed by the Department of Revenue. Section 3. Delivery of this Ordinance to the Property Appraiser. The Clerk is directed to deliver a certified copy of this Ordinance to the Property Appraiser before December 1, 1999. Section 4. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 5. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict. Section 6. The provisions of this ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 7. This ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with said Office. Ordinance No. 044-1999 authorizing a lump sum years of service award to certain eligible volunteer firefighters whom each have provided at least ten (10) years of fire, rescue and emergency medical services to the residents and visitors of Monroe County and whom each have reached the age of sixty; providing for severability; providing for the repeal of all Ordinances inconsistent herewith; providing for incorporation into the Monroe County Code of Ordinance; and providing an effective date.
