A RESOLUTION BY THE MONROE COUNTY
BOARD OF COUNTY COMMISSIONERS
EXTENDING THE RESERVATION FOR FORTY -SIX
(46) AFFORDABLE HOUSING DWELLING UNIT
ALLOCATIONS FOR THE ISLANDER VILLAGE
PROJECT LOCATED ON FIFTH AVENUE,
MALONLEY SUBDIVISION, STOCK ISALND, REAL
ESTATE NUMBERS 00123700.000000 AND
00127400.00000.
WHEREAS, at its meeting of July 19 2006, the Board of County
Commissioners (BOCC) approved Resolution 273 -2006 reserving eighty -nine (89)
affordable housing allocations for the "Islander Village" project located on Fifth Avenue,
Maloney Subdivision, Stock Island, RE: #00123700.000000 and 00127400.00000; and
WHEREAS, at its meeting of May 16 2007, the Board of County
Commissioners (BOCC) approved Resolution 184 -2007 reserving eighty -nine (89)
affordable housing allocations for "Islander Village" project; and
WHEREAS, Islander Village entered into a 99 -year lease with Monroe County
on April 18, 2007 for property described as a parcel of land on Stock Island, being a part
of Block 59, Maloney Subdivision, as recorded in PB 1 -55, Real Estate Numbers
00554720.000000 and 00554720.000100 for the project; and
WHEREAS, Islander Village commenced development on the 89 employee
housing units; and
WHEREAS, Islander Village has received 43 certificates of occupancy out of 89
employee housing units; and
WHEREAS, 46 of the 89 building permits have expired and the applicant needs
the allocation awards reserved to continue the project; and
WHEREAS, the First Amendment to the Ground Lease was approved June 19,
2009; and
WHEREAS, the Second Amendment to the Ground Lease was approved October
21, 2009; and
WHEREAS, the Third Amendment to the Ground Lease was approved June 15,
2011; and
WHEREAS, the Fourth Amendment to the Ground Lease was approved October
17, 2012 which provides that he remaining certificates of occupancy will be obtained by
December 7, 2015; and
WHEREAS, the reservation of affordable housing allocations for the anticipated
project does not exempt the project from applicable requirements for the Monroe County
Land Development Regulations, Building Code and other regulatory requirements; and
WHEREAS, Islander Village shall obtain all required approvals from the Monroe
County Planning & Environmental Resources Department for the project; and
WHEREAS, 46 allocations are still required to complete the project;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA:
Section 1. Forty-six (46) affordable housing allocations are reserved for Islander
Village until December 7, 2015, pursuant to Monroe County Code Section 138 -
24(b)(4).
Section 2. This resolution is retroactive to May 16, 2008.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
Florida at a regular meeting held on the 16th day of January, 2013.
