The proposed designations are based on changes made to the Tier Overlay District (Chapter 130-130 of the Monroe County Lanai Development Code) in accordance with the Final Order in DOAH Case No. 06-2449GM. ITEM BACKGROUND: Please see attached staff report. PREVIOUS RELEVANT BOCC ACTION: The Monroe County Board of County Commissioners (BOC7) adopted Ordinances Nos. 008- 00 , 00 - 006, 010- 00 � 011- 006, and 013-2006 (Tier Ordinances) which set forth criteria in the Lanai Development regulations implementing a "Tier System" and adopting Tier Overlay District Traps in order to protect the natural habitat and guide development toward less environmentally sensitive areas. Following the d Of two pnhlic hearings on May 4, 2011 the BOCC adopted Ordinances 005- 2011, 00 - 011, 007- 011 and 008- 011 amending the Tier Overlay District maps in accordance with the Final Order in DOAH Case No. 06-2449GM. There is a 21 day appeal period before the ordinances are considered fma1. III. ISSUES As shown in the summary tables, only� parcels � s are recommended to have their Fier designation changed. Planning and EnvironmenU Resources staff re rnxnendations differ from that of the TDRC for two (2) parcels. For parcels 001 7 1 0-000000 and 001 7440- 000000 located between Central Avenue and . umho Limbo Avenue in the Bay Maven subdivision in Ivey Largo, the TDRC recommended a Fier designation of Tier III -A (SPA) based on the habitat connectivity.
