At the July 17, 2013, Board of County Commissioner's meeting, the Board granted approval and authorized execution of the Item K1 Second Amendment to the Memorandum of Understanding dated April 18, 2012, regarding FY 2010 Urban Area Security Initiative ("UASI") funds, to grant the Monroe County Sheriff's Office an additional $394,000.00 and also to reinstate and extend the MOU to June 30, 2013. The Additional UASI Grant amount of $394,000.00 will be used to purchase law enforcement equipment, as well as other equipment approved by the granting agency. WITNESSETH WHEREAS, on January 4, 2012 the COUNTY entered into an agreement with the City of Miami, by which the City of Miami sub -granted the sum of three hundred thirteen thousand four hundred forty dollars and ninety-nine cents ($313,440.99), of which one hundred fifty-six thousand seven hundred twenty dollar and 49 cents ($156,720.49) was to be given to Monroe County Sheriff's Office for the purchase of equipment approved by the granting agency as well as other items, with the balance to be used by the COUNTY for similar items; and WHEREAS, on April 18, 2012 the COUNTY entered into a MOU in order to grant use of $156,720.49 from FY 2010 UASI funds to the SHERIFF pursuant to the terms of the agreement between the County and the City of Miami; and WHEREAS, on February 20, 2013, the BOCC approved the First Amendment to the MOU, in order to grant the Monroe County Sheriffs Office the right to use the balance of funds in the grant, an additional one hundred fifty-six thousand seven hundred twenty dollar and fifty cents ($156,720.50) in order to purchase emergency management radio equipment, as well as other equipment approved by the granting agency; and WHEREAS, the COUNTY and the SHERIFF were recently notified by the City of Miami that an additional Three hundred ninety-four thousand dollars ($394,000.00) in 2010 UASI grant funding was made available for disbursement to the COUNTY, and the COUNTY wishes to disburse the additional funds to the SHERIFF and the SHERIFF wishes to accept the grant award, and will use the funding to purchase law enforcement equipment. NOW THEREFORE, in consideration of the mutual understandings and agreements set forth herein, the COUNTY and the SHERIFF agree as follows: 1. TERM — The original term of this Agreement was from October 1, 2010, through April 30, 2013. The MOU is reinstated and the term of the MOU extended to June 30, 2013, the date of the signature by the parties notwithstanding, unless earlier terminated as provided herein. All purchases under the MOU must be completed by the SHERIFF and requests for reimbursement submitted by the SHERIFF to the COUNTY by that date. 2. Paragraph 4 of the MOU is amended to read as follows: 4. FUNDS - The total project budget to be expended by the SHERIFF in performance of the services set forth in this agreement shall be the total sum of $707,440.99. The total sum represents federal grant support in the amount of $707,440.99 and matching funds in the amount of $0.00. All funds shall be expended in accordance with the grant agreement. All other terms and conditions of the MOU between the parties dated April 18, 2012 as amended on February 20, 2013 remain in full force and effect.
