At the August 21, 2013, Board of County Commissioner's meeting the Board granted approval
and authorized execution of Item B 1 First Amendment to Contract for Consulting Services to MBMM
Architecture Inc. for the Space Planning /Facilities Assessment Report, extending the completion date
and increasing the fee by $2,500.00. This project is funded by Ad Valorem.

CONSULTING SERVICES
BETWEEN OWNER AND CONSULTANT
FOR
THE DEVELOPMENT OF MONROE COUNTY SPACE
PLANNING/FACILITIES ASSESSMENT REPORT
THIS AMENDMENT made as of the 21 day of August 2013. FOR CONSULTING
SERVICES BETWEEN OWNER AND CONSULTANT (the "Agreement ") is made and
entered into by MONROE COUNTY, BOARD OF COUNTY COMMISSIONERS (the
"County "), a political subdivision of the State of Florida, whose address is 1100
Simonton Street, Key West, Florida 33040, its successors and assigns through the
Monroe County Board of County Commissioners ( "BOCC "), and MBI/K2M
ARCHITECTURE, INC. (the "Consultant "), whose address is 1001 Whitehead Street,
Key West, FL 33040 its successors and assigns.
WITNESSETH
WHEREAS, on the 12` day of December 2012, the County entered into an Agreement
for Consulting Services with the Consultant for The Development of the Space
Planning/Facilities Assessment Report for all Monroe County Facilities, Sites, Parks, and
Beaches. Services include determining the highest and best use of existing County
owned properties, cost savings to the County, and the benefits of increased convenience
of services to the customers of Monroe County; and
WHEREAS, Consultant's Basic Services to develop the Space Planning/Facilities
Assessment Report include one on one meetings with Director /Department heads of
County Services and Constitutional Services with established time limits approved by the
County, with a project completion date of August 16, 2013; and
WHEREAS, scheduled interviews with Director /Department heads, and Constitutional
Officers, exceeded time limits established and approved by the County, caused by events
not within the Consultants control, as described in paragraph 1. 1.6 of the Agreement; and
WHEREAS, a time extension beyond August 16, 2013 is required for the Consultant to
complete the final Assessment Report and to give a public presentation to the Board of
County Commissioners; and
WHEREAS, additional compensation is requested by the Consultant for the extension of
interviews and time limits; now therefore
IN CONSIDERATION of the mutual promises, covenants and agreements stated herein,
and for other good and valuable consideration, the sufficiency of which hereby
acknowledged, the County and Consultant agree:

The Completion Date of August 16, 2013, as indicated in paragraph 2.4 of the
Agreement dated December 12, 2012 shall be extended to September 6, 2013.
2. Pursuant to Paragraph 1.1.6, additional compensation of Two Thousand Five
Hundred Dollars and 00 /100, ($2,500.00) shall be added to Task 3 of the
Agreement for Data Analysis and the Final Report. This additional compensation
shall be provided to the Consultant as a result of the additional time required by
one on one meetings with director /department heads. Twenty percent, (20 %) of
the additional compensation, or Five Hundred Dollars and 00 /100, ($500.00) shall
be held until the final report is received and accepted by the County.
3. The remaining terms of the Agreement dated December 12, 2012 shall remain in
full force and effect.
IN WITNESS WHEREOF, the parties hereto have set their hands and Seals on
the day first written above. Execution by the Consultant must be by a person with
the authority to bind the entity. SIGNATURE OF THE PERSON EXECUTING
THTE DOCUMENT MUST BE WITNESSED.
