Resolution 023-1997 RESOLUTION NO. 023 -1997 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, RENOUNCING AND DISCLAIMING ANY RIGHT OF THE COUNTY AND THE PUBLIC IN AND TO A PORTION OF EVERGREEN TERRACE, KEY HAVEN, KEY WEST, FLORIDA WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to renounce and disclaim any right of the County and the public in and to the hereinafter described streets, alley- ways, roads or highways, and WHEREAS, due notice has been published and a public hearing has been held in accordance with Chapter 336, Florida Statutes, and WHEREAS, at said public hearing the Board considered the argument of all parties present wishing to speak on the matter, and all premises considered concerning the renouncing and disclaiming of any right of the County and the public in and to the hereiriQfter des~ed 1freets, .. -..J r- ailey-ways, roads or highways as delineated on the hereinafter described ma~gr~lat. ~d ~ WHEREAS, the Board has determined that vacation of the said road is:..'~rthe ginerar.:public N '::;:. welfare, and conforms to the requirement of Florida Statutes Sec. 336.09 gr9 Sec. 5@6.1 O,~;. now, therefore, ~ c: ..... ...-...... BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COU~Y, Flt5RIDA. . ~ that the Board hereby renounces and disclaims any right of the County and the public in and to the following described streets, alley-ways, roads or highways as delineated on the hereinafter described map or plat. to-wit: Parcel No. 10 A parcel of land on Key Haven, said parcel being a part of Evergreen Terrace as said terrace is delineated on the plat of KEY HAVEN - 10TH ADDITION said plat being recorded in PB 5 at Page 114 of the Public Records of Monroe County, Florida; and the said parcel being described as follows: COMMENCE at the intersection of the SE'ly right-of-way-Iine (ROWl) of Evergreen Avenue with the Centerline of Evergreen Terrace and run thence S49015'00" E and along said Centerline for a distance of 100 feet; thence S40045'00"W for a distance of 25.00 feet to the POINT OF BEGINNING of the parcel of land being described herein; thence continue S40045'00"W for a distance of 20.83 feet to the beginning of a curve, said curve being concave to the East and having a radius of 50.00 feet; thence Northerly and along said curve for an arc distance of 31.78 feet to a point that bears N49015'OO"W from the Point of Beginning; thence S49015'OO"E for a distance of 23.30 feet back to the POINT OF BEGINNING, containing 295 square feet. more or less. Parcel No. 11 A parcel of land on Key Haven, said parcel being a part of Evergreen Terrace as said terrace is delineated on the plat of KEY HAVEN - 10TH ADDITION said plat being recorded in Plat Book 5 at Page 114 of the Public Records of Monroe County, Florida; and the said parcel being described as follows: COMMENCE at the intersection of the SE'ly right-of-way-line (ROWl) of Evergreen Avenue with the Centerline of Evergreen Terrace and run thence S49015'OO"E and along said Centerline for a distance of 100 feet to the POINT OF BEGINNING of the parcel of land being described herein; thence continue S49015'OO"E for a distance of 70.00 feet to the beginning of a curve, said . curve being concave to the North and having a radius of 50.00 feet; thence Westerly and along said curve for an arc distance of 99.12 feet to a point that bears S40045'OO''W from the Point of Beginning; thence N40045'OO''E for a distance of 45.83 feet back to the POINT OF BEGINNING, containing 2936 square feet, more or less. Parcel No. 13 A parcel of land on Key Haven, said parcel being a part of Evergreen Terrace as said terrace is delineated on the plat of KEY HAVEN - 10TH ADDITION said plat being recorded in PB 5 at Page 114 of the Public Records of Monroe County, Florida; and the said parcel being described as follows: COMMENCE at the intersection of the SE'ly right-of-way-Iine (ROWL) of Evergreen Avenue with the Centerline of Evergreen Terrace and run thence S49015'OO"E and along said Centerline for a distance of 100 feet; thence N40045'00''E for a distance of 25.00 feet; thence N49015'OO"W for a distance of 20.00 feet to the POINT OF BEGINNING of the parcel of land being described herein; thence N40045'OO''E for a distance of 5.00 feet to the beginning of a curve, said curve being concave to the South and having a radius of 50.00 feet; thence Westerly and along said curve for an arc distance of 6.04 feet to a point that bears N49015'00"W from the Point of Beginning; thence S49015'OO"E for a distance of 3.30 feet back to the POINT OF BEGINNING, containing 9 square feet, more or less.
