A RESOLUTION OF THE MONROE COUNTY BOARD OF COUNTY
COMMISSIONERS APPROVING THE TOP 15 DEMONSTRATION
CANALS IN RANK ORDER BY TECHNOLOGY GROUP AND
APPROVING OTHER RECOMMENDATIONS CONTAINED HEREIN
AS RECOMMENDED BY THE FKNMS WATER QUALITY
PROTECTION PROGRAM CANAL RESTORATION ADVISORY
SUBCOMMITTEE.
WHEREAS, Monroe County, Florida, encompasses the uniquely beautiful natural
environment of the Florida Keys; and
WHEREAS, the Monroe County Board of Commissioners (BOCC) is dedicated to
preservation of the built and natural environment; and
WHEREAS, the purpose of the FKNMS WQPP Canal Restoration Advisory Subcommittee is to
advise on canal restoration technologies and policies needed to address water quality issues
in canals; and
WHEREAS, the Subcommittee has recommended criteria for selection of the demonstration
projects based on scientific criteria; and
WHEREAS, the Subcommittee has approved the top fifteen (15) canals categorized by
technology group and in rank order in each group; and
WHEREAS, approval is requested of the top fifteen (15) canals and to authorize negotiations
in rank order with the homeowners on the canals until the five (5) demonstration projects are
selected; and
WHEREAS, time is of the essence and therefore a ninety (90) day time limit is requested to
receive written agreement from the homeowners from the date of first written contact to
them, and to move to the homeowners of the next highest ranked canal in that category if
written agreement is not received within the ninety (90) day period; and
WHEREAS, the Subcommittee has recommended that multiple technologies be considered on
a canal to ensure complete restoration.
NOW, THEREFORE, BE IT RESOLVED BY THE MONROE COUNTY BOCC:
Section 1. The FKNMS WQPP Canal Restoration Advisory Subcommittee recommends that
the BOCC support the top fifteen (15) canals, a minimum of three (3) canals for each of the
five (5) technologies: canal backfilling, organic removal, pumping, weed gate installation and
culvert installation. One canal shall be selected for each technology. The top fifteen (15)
canals are included in Attachment A. Canal #266 will have both a weed barrier and organic

removal. Canal #290 will be a second canal for organic removal. Canal #277 Big Pine Tropical
Bay shall be added to the Culvert Installation Demonstration Canals; however, if #459 Geiger
Boca Chica Ocean Shores does not chose to participate, then only #277 will be used for the
culvert demonstration.

Section 2 . Approval is authorized to negotiate with the homeowners of the top ranked canal
in each group in rank order, for a period up to ninety (90) days, in order to obtain written
homeowner agreement. If written agreement is not received within the ninety (90) day time
period, staff is authorized to move to the next ranked canal and so forth until five (5)
demonstration projects are selected, one per category, and written agreement has been
received from the homeowners.
Section 3 . Approval is authorized to move to the next ranked canal under a category if a
canal has received a higher rating in another category and if recommended by the Canal
Restoration Advisory Subcommittee.
Section 4. Multiple restoration techniques shall be considered if recommended by the Canal
Restoration Advisory Subcommittee to ensure complete restoration. The estimated cost of
each technology for each canal shall be submitted to the BOCC for future approval before any
project proceeds further.
Section 5. This Resolution was passed by the Monroe County board of County Commission
at a meeting on the 16 day of October, 2013.
Section 6. EFFECTIVE DATE This Resolution shall become effective upon adoption.

a meeting of said Board held on the 16 day of October 2013.
