WHEREAS, there was an agreement entered into on April 18, 2012 between the parties, awarding $245,000 to the City of Key West for the Rest Beach Renourishment project; and WHEREAS, there was an amendment to agreement on April 17, 2013 to delete the portion of the project described as "repair and replacement of dune plantings, concrete walkway repair, beach walkovers and rope fencing at Rest Beach — by licensed contractor and increase the quantity of sand to be purchased and delivered for Rest Beach; and WHERAS, there was an amendment to agreement on August 21, 2013 to extend the agreement to September 30, 2014 due to delays in permitting by the Florida Department of Environmental Protection & the U.S. Army Corps of Engineers; and WHEREAS, due to further delays in the permitting process by the Florida Department of Environmental Protection & the U.S. Army Corps of Engineers it has become necessary to request and extension to September 30, 2015; and NOW, THEREFORE, in consideration of the mutual covenants contained herein the parties agree to the amended agreement as follows: 1. All references to termination date and submission of invoices shall be September 30, 2015. 2. The remaining provisions of the agreement dated April 18, 2012, amended April 17, 2013 and August 21, 2013 remain in full force and effect.
