Cc: County Attorney Finance File ✓ 500 Whitehead Street Suite 101, PO Box 1980, Key West, FL 33040 Phone: 30S- 295 -3130 Fax. 305- 295 -3663 3117 Overseas Highway, Marathon, FL 33050 Phone: 305 - 289 -6027 Fax. 305- 289 -6025 88820 Overseas Highway, Plantation Key, FL 33070 Phone: 852 -7145 Fax. 305- 852 -7146 FIRST AMENDMENT TO CONTRACT FOR PROFESSIONAL SERVICES BETWEEN OWNER AND ARCHITECT/ENGINEER FOR PUBLIC WORKS OFFICES ON MAGNOLIA STREET THIS FIRST AMENDMENT (herein after "AMENDMENT" to CONTRACT BETWEEN OWNER AND ARCHITECT/ENGINEER ( "Contract" or "Agreement ") for the Public Works Offices on Magnolia Street, entered into between MONROE COUNTY "Owner" or "County ") and CURRIE SOWARDS AGUILA ARCHITECTS ( "Architect ") is made and entered into this 16 day of July 2014, in order to amend the Contract as follows: WITNESSETH WHEREAS, on the 20 day of January 2010, the parties entered into a Continuing Contract for projects in which the estimated construction costs of each individual project under the contract does not exceed Two Million Dollars ($2,000,000.00), or for study activity if the fee for professional services for each individual study under the contract does not exceed Two Hundred Thousand Dollars ($200,000.00); and WHEREAS, On the 20 day of November, 2013 the Continuing Contract for Professional Services was renewed for the first of two one year renewals effective January 20 , 2014 and terminating on January 19 , 2015; and WHEREAS, also on the 20 day of November 2013 the parties entered into a contract for Professional Services for the design through construction administration of the renovation of the Magnolia Street Recycling Center for the purposes of relocating the Upper Keys Public Works Division; and WHEREAS, it is customary that the Architect's fee for professional services be adjusted when the actual costs of construction are known; now therefore IN CONSIDERATION of the mutual promises, covenants and agreements stated herein, and for other good and valuable consideration, the sufficiency of which hereby acknowledged, the Owner and Architect agree: Paragraph 3 of the Contract for Professional Services for the Public Works Offices on Magnolia Street dated November 20 , 2013 shall be amended to add the following language: Architect's fee shall be adjusted by 8.63% of the actual construction costs when construction is complete. All other terms and conditions of the Continuing Contract dated January 20 2010, as renewed on November 20 2013, and the Contract for Professional Services for the Public Works Offices on Magnolia Street dated November 20 2013 remain in full force and effect.
