Resolution 219-2014RESOLUTION 219- 2014 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA APPROVING AND AUTHORIZING THE MONROE COUNTY SOCIAL SERVICES DEPARTMENT TO IMPLEMENT THE SHIP LEGISLATIVE SPECIAL NEEDS SET ASIDES FOR FISCAL YEARS 2013 -2014 AND 2014 -2015; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, each local jurisdiction receiving SHIP funding must utilize a minimum of 20% of its allocation to serve "Persons with special needs" as defined in Section 420.0004 (13) F.S., "Persons with special needs" means an adult person requiring independent living services in order to maintain housing or develop independent living skills and who has a disabling condition; a young adult formerly in foster care who is eligible for services under s. 409.1451(5); a survivor of domestic violence as defined in s. 741.28, (" 'Domestic Violence' means any assault, aggravated assault, battery, aggravated battery, sexual assault, sexual battery, stalking, aggravated stalking, kidnapping, false imprisonment, or any criminal offense resulting in physical injury or death of one family or household member by another family or household member "); or a person receiving benefits under the Social Security Disability Insurance (SSDI) program or the Supplemental Security Income (SSI) program or from veterans' disability benefits',, and WHEREAS, the first priority of these Legislative special needs set aside funds must be to serve people with developmental disabilities as defined in Section 393.063(9) F.S., " 'Developmental disability' means a disorder or syndrome that is attributable to retardation, cerebral palsy, autism, spina bifida, or Prader- Willi syndrome; that manifests before the age of 18; and that constitutes a substantial handicap that can reasonably be expected to continue indefinitely "; and WHEREAS, the first priority for these Legislative special needs set aside funds must be to use them for persons with developmental disabilities, with an emphasis on home modifications, including technological enhancements and devices, which will allow homeowners to remain in their own homes and maintain homeownership; and WHEREAS, the total minimum funding available to serve persons with special needs for both fiscal years is $143,143.00; and WHEREAS, the Monroe County Social Services Department has an established client base of potential recipients; and WHEREAS, the Monroe County Social Services Department, cooperating with other not - for- profit providers, has a delivery system currently in place to identify and assist eligible applicants; and WHEREAS, the Monroe County Social Services Department is familiar and proficient in utilizing SHIP application forms and eligibility criteria based on their participation in the SHIP /WAP Leveraging Strategy; and WHEREAS, the Monroe County Social Services Department is best prepared to implement the SHIP Special Needs Set Aside; and Now Therefore, be it resolved by the Board of County Commissioners of Monroe County, Florida that the Monroe County Board of County Commissioners hereby approves and authorizes: 1. The Monroe County SHIP Program and the Monroe County Social Services Department to implement current and future Legislative Special Needs Set Asides. 2. The set asides will be limited to $35,000 per homeowner or $20,000.00 per resident of a group home and the funding will be a deferred payment loan at zero interest rate for 5 years and forgiven at maturity. 3. To offset administrative costs associated with the workload, the Monroe County Social Services Department shall be entitled to a 10% project delivery fee of the total amount of SHIP funds awarded to each applicant for the work required to implement the SHIP Special Needs Set Aside and to provide the necessary SHIP documents to the SHIP program. 4. The Monroe County SHIP Program will update the Monroe County SHIP Local Housing Assistance Plan to reflect these changes.
