Resolution 028-1997 RESOLUTION NO. 028 County Attorney -1997 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS DIRECTING ENFORCEMENT OF OSTDS INSPECTION ORDINANCE WHEREAS, Section 4C of Ordinance No. 03-1997 (the "OSTDS Ordinance") provides for certain penalties and authorizes enforcement procedures to assure enforcement of the provisions of the OSTDS Ordinance; and WHEREAS, Section 4C-1 of the OSTDS Ordinance authorizes, but does not require, enforcement proceedings under Chapter 162, Florida Statutes and Chapter 6.3, Monroe County Code; and WHEREAS, the Monroe County Code Enforcement Department lacks sufficient resources to undertake enforcement of the OSTDS Ordinance, and will not have such resources in the foreseeable future; and WHEREAS, Section 4C-2 of the OSTDS Ordinance provides an enforcement mechanism for correction of sanitary nuisances, without placing responsibility for such enforcement on Code Enforcement staff; now, therefore BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA that Enforcement of the OSTDS Ordinance shall be directed first via the procedure established under Section 4C-2 of the OSTDS Ordinance where applicable, and the Monroe County Code Enforcement Department shall not be required to undertake any enforcement proceedings pursuant to Section 4C-1 of the OSTDS Ordinance. ~~ .. \d-_ 2: '.
