ITEM BACKGROUND: The applicant has requested a special permit to utilize the subject property
for a temporary construction staging area. The staging area would facilitate a canal restoration/water
quality improvement project being carried out by Monroe County. In addition, the applicant is
requesting a temporary setback variance to allow placement of staging equipment in the sideyard
setback of the parcel. In addition, the applicant is requesting a variance from the front yard setback to
allow the placement of dewatering equipment on the property line at the edge of the right of way of
Avenue 1. The property owner for the adjacent parcel (#001 10940.000000) is seeking approval for a
similar request under a separate application.
If approved, the expected commencement date of the staging area is July 31, 2015 and the approval
shall expire one year from the date of commencement on July 31, 2016.
Note: The BOCC is considering an amendment to Section 6-3 of the Monroe County Code of
Ordinances to allow temporary construction staging to occur temporarily within the setbacks to
alleviate increased public expenses and avoid threats to public health and safety, provided the adjacent
property owners submit letters of no objections to the temporary variance. The applicant has submitted
letters of no objection from the adjacent property owners.
PREVIOUS RELEVANT BOCC ACTION:
At the December 10, 2014 meeting, the BOCC approved an ordinance establishing §6-3 of the Monroe
County Code, which provides the approval process for temporary construction staging areas with a
special permit granted by the BOCC. (Ordinance 0 18-2014)
At the April 15, 2015 meeting the BOCC approved the advertisement of a Public Hearing for 3:01 pm
(approximate) on May 20, 2015 at the Murray Nelson Government Center in Key Largo.

WHEREAS, an application was filed for a special permit allowing a temporary
construction staging area at a property on Avenue I, Big Pine Key, approximate mile marker 31
(Florida Bay side of the Overseas Highway); and
WHEREAS, the property is described as a tract of land in a part of Block 51, Sand's
Subdivision (Plat Book 1, Page 65), having real estate (RE) Number: 00110960.000000; and
WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to
grant the special permit allowing a temporary construction staging area and temporary setback
variance of 25' from the required 25' front yard setback along the Avenue I right-of-way and 10'
from the required 10' side yard setback along the western property line; and
WHEREAS, the temporary construction staging area would facilitate a canal
restoration/water quality improvement project being carried out by Monroe County; and
WHEREAS, due notice has been carried out and a public hearing has been held in
accordance with Monroe County Section 6-3; and
WHEREAS, at said public hearing, the Board considered the argument of all parties
present wishing to speak on the matter; and

WHEREAS, the Board makes the following Findings of Fact and Conclusions of Law:
1. The temporary construction staging area is not inconsistent with any of the criterion
provided in Monroe County Code §6-3;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the preceding Findings of
Fact and Conclusions of Law support its decision to approve the request for a special permit,
subject to the following conditions:
1. The temporary construction staging area shall only be used in association with the canal
restoration project for Canal #290 on Big Pine Key.
2. The expected commencement date of the temporary construction staging area is June 1,
2015. The termination date of the temporary construction staging area shall be no later
than June 1, 2016.
3. Upon termination of the temporary construction staging area, the property shall be
restored to its prior condition.

III REVIEW OF APPLICATION:
The requested temporary staging is to provide a suitable location for a pipeline to run to and
from the canal (#290) and to allow the placement of water separation equipment required to
extract and dewater the organic material to meet return water turbidity thresholds.
The BOCC has the authority to approve temporary construction staging areas in accordance
with MCC §6-3. A special permit may be granted by resolution by the BOCC to allow a
property to be used as a construction staging area for an off -site project. The BOCC shall
hold a public hearing on the request for a temporary construction staging area and shall issue
a resolution granting, granting with conditions or denying the request. The resolution shall
take effect on the date of enactment by the BOCC.
Applicability. A temporary construction staging area for an off -site project is a permitted
activity in any land use (zoning) district, provided it is approved by a special permit and
meets the criteria set forth in MCC §6-3. This special permit shall approve the temporary
construction staging area location and use and shall not override or substitute for any other
provision of the Florida Building Code and Monroe County Code that require an additional
type of building permit, certification or approval.
Criteria. Approval of such a special permit shall be granted only if the following criteria are
met:
(1) The temporary construction staging area shall serve a project being carried out in the
vicinity of the construction staging area: In compliance.
The proposed staging area is adjacent to Canal #290 which is one of the approved canal
restoration demonstration projects.
(2) The temporary construction staging area shall serve a project being carried out by a
governmental agency: In compliance.

The canal restoration project is being carried out by Monroe County, Florida.
(3) The temporary construction staging area shall be not be located in a tier I designated area:
In compliance.
The proposed staging area would be located on a property that is in a tier III designated
area.
(4) The property subject to the request shall be posted and surrounding property owners
within 300 feet shall be notified in writing at least 15 days prior to the BOCC public
hearing, with the notice located so it shall be easily visible from all public streets and
public ways abutting the property: Compliance to be determined prior to public hearing.
Planning & Environmental Resources Department staff shall carry out the notification as
required.
(5) Prior to establishment of the temporary construction staging area, a special building
permit approving any associated temporary structure shall be issued in accordance with
MCC §6-112: Compliance to be determined.
A permit pursuant to MCC §6-112 will be required for the storage container and
temporary fencing .
(6) No clearing or filling shall occur to accommodate the temporary construction staging
area: In compliance.
The proposed staging area would be located on a property that is predominately scarified.
No clearing or filling shall occur to accommodate the staging area.
(7) Other than fencing, no temporary structure associated with a temporary construction
staging area shall be located in any required setback unless the BOCC determines the
temporary construction staging may occur temporarily within the setbacks to alleviate
increased public expenses and avoid threats to public health and safety: In compliance
pending Temporary Setback Variance Approval.
The applicant is requesting a variance from the sideyard setback adjacent to Parcel
00110940-000000, which is also proposed as a staging area under a separate application.
The requested variance is to allow the placement of dewatering equipment on the
property line between the two parcels. In addition, the applicant is requesting a variance
from the front yard setback to allow the placement of dewatering equipment on the
property line at the edge of the right of way of Avenue I.
Note: The BOCC is considering an amendment to Section 6-3 of the Monroe County
Code of Ordinances to allow temporary setback variances on May 20, 2015. If the
BOCC approves the amendment to §6-3 and this request for Canal 290, the Resolution
for this request will be issued after the effective date of the Ordinance.

1 (8) The temporary construction staging area shall be compatible with existing uses on
2 surrounding properties, as determined by the BOCC. If necessary, prior to issuance of a
3 special permit allowing the temporary construction staging area, the board may attach
4 conditions to any special permit approval to a) avoid substantial harm to public health or
5 safety; b) avoid substantial harm to, or impairment of the normal use of, a public place;
6 and/or c) avoid substantial harm to the environment. Depending on the nature and
7 anticipated duration of the use, as a condition of approval to the special permit, the board
8 reserves the right to: a) Provide a deadline for termination of the construction staging
9 area; b) Limit the hours of operation; c) Limit the type of equipment and materials on the
10 site; d) Require fencing, landscaping and/or other screening to limit potential visual and
11 noise impacts of the use on adjacent property owners; and e) Require surface water
12 management improvements to the affected site: In compliance.

14 The BOCC reserves the right to attach such conditions to any special permit approval at
15 the May 20, 2015 public hearing.

17 (9) The property shall be restored to its prior condition: Compliance to be determined upon
18 termination of the staging area.

Description of Project: This project is part of the Water Quality Improvement Program being
funded by Monroe County for Canal Restoration Demonstrations. The purpose of the project is to
hydraulically vacuum dredge the accumulated weed rack along the bottom of the unnamed
manmade canal located between Avenues I and J in Big Pine Key, Florida to a maximum depth of -
8.9 feet Mean Low Water. Due to weed rack loading and lack of flushing, a layer of decomposing
weed rack (organic muck) has accumulated along the bottom of the canal which consumes oxygen
and prevents the inhabitance of fish or other marine organisms. The project entails hydraulically
removing the organic muck layer within the canals to the limestone bottom to promote a viable
benthic community. Six inches of sand will be placed on the limestone canal bottom after dredging
to assist in promoting seagrass growth.
Commencement and Termination Dates of Construction Staging Area: July 1, 2015 through
September 30, 2015
Hours of Operation: 8 AM — 6 PM Monday through Friday
Types of Equipment and Materials to be Stored in Staging Area:
1. Pipeline run to and from the canal and placement of water separation equipment required to
extract and dewater the organic material to meet return water NTU turbidity thresholds.
Equipment includes shaker/mix tank, clarifier, and belt presses.
2. Additionally, trucks and other equipment will need to enter the property to place and remove
the containers and the final dewatered dredge spoil material.
Setbacks and Request for Variances:
A 20 foot shoreline setback can be met on the eastern property boundary and a 20 foot setback can
be met along the canal as the property line extends to the middle of the canal.
A variance is being reguested alon the western grogeM boundaEY for a 0 foot setback to
accommodate all the a ui meat. The adjoining arcel on the western side Parcel
#00110940-000000 is also a part of the dewatering staldng area.
A variance is being requested along the front of the propedy for a 0 foot setback as the
dewatering a ui ment needs to extend into the Right -of -Way in order to fit all the required
equipment.
Proposed Fencing, Screening or Landscaping: A temporary construction fence consisting of 6
foot high chain link fence with canvas privacy screening will be placed on the property extending to
the front of the property staging area continuing west connecting with fence on Parcel ID
00110940-00000 property.

Any Proposed Surface Water Management Improvements: The Contractor will be required to
implement best management practices within the staging area to control all storm water runoff. The
Contractor will provide a final Erosion and Sediment Control plan based upon the Sediment and
Erosion Control Plan presented on the Design Drawings.
Current Vegetation: Parcel 00110960-000000, the Platek property, maintains no natural features.
The existing surface soil conditions are described as an "urban complex" consisting of fill material
covered with a small aggregate pea gravel. There are no plants located on the parcel.
