09/22/2014 Organizational Meeting MINUTES OF THE MONROE COUNTY VALUE ADJUSTMENT BOARD Organizational Meeting MarathonGovernment Center Monday,September 22, 2014 The 2014Organizational Meetingof the Monroe County ValueAdjustment Board convened at 10:00a.m., on the above date, at the Marathon Government Centerlocated at 2798 Overseas Highway, Marathon. Present at the meetingwereMayorGeorge Neugent;School Board Member John Dick; and BOCC Citizen Member John Repetto.BOCC Commissioner David Rice and School Board Member Nancy Mayhewwerenot present.Also present were Robert Tischenkel, Counsel to the Value Adjustment Board and Jennifer Sanchez, incoming VAB Counsel;Lindsey Ballard,Clerk to the ValueAdjustment Board;Scott Russell,Property Appraiser; and John Dent, Counsel to the Property Appraiser’s Office. Item ALindsey Ballard,Clerk introduced the 2014Value Adjustment Board members, as follows: MayorGeorge Neugent, (305) 292-4512; Commissioner David Rice, (305) 289-6000; School Board Member John Dick, (305) 289-1553; BOCC Citizen Member John Repetto, (305) 394-5948; and School Board Citizen Member Nancy Mayhew, (305) 292-1865. Ms. Ballardgave her contact information as: (305) 295-3130. Item BMotion was made by School Board Memeberand seconded by BOCC Citizen MemberJohn Repetto to appoint CommissionerNeugentas Chairmanand Commissioner Riceas Vice-Chairmanto the 2014Value Adjustment Board. Motion carried unanimously. Item CThe Clerk of the Board makes available to the Public, Special Magistrates and Board Member the following: 1.Rule Chapters 12D-9 and 12D-10, Florida Administrative Code, 2.Rules 12D-51.001, 51.00, 51.003, Florida Administrative Code and Florida Statute Chapters 192-195. 3.Florida’s Government in the Sunshine Laws, including information on where to obtain the current Government-in-the-sunshine manual. 4.Information regarding the Clerk’s website where Value Adjustment Board documents and information are available. Item DMotion was made by School Board Member Dick and seconded by BOCC Member Repetto to select Jennifer Sanchez, Esq. as the Value Adjustment Board Legal Counsel. A motion was made by School Board Member Dick and seconded by Commissioner Neugent to set the rate of pay for the Legal Counsel as $1,750.00 per month. 09/22/2014 Item E1Rinki Parwani was the only applicant qualified to hear issues regarding homestead/exemption, and the Board appointed Ms. Parwani. Item E2Motion was made by School Board Member Dickand seconded by BOCC Citizen Member Repetto to appoint Regina Corcoran, Patricia McGrath and Kevin Talbott to serve as Special Magistrates to hear issues regarding valuation of real property and commercial property. Item E3Regina Corcoran was the only applicant qualified to hear issues regarding tangible personal property, and the Board appointed Ms. Corcoran. Item FBob Tischenkel, Legal Counsel addressed the Board regarding the adoption of local rules of the Board: Item F1After discussion, a motion was made by School Board Member Dick and seconded by BOCC Citizen Member Repetto to deny telephonic hearings for the 2014-2015 VAB year. Motion passed unanimously. Item F2After discussion, a motion was made by School Board Member Dick and seconded by BOCC Citizen Member Repetto deny No de novo hearings or appeals at the Final Meetings of the Board. Motion passes unanimously. Item F3 After discussion, a motion was made by School Board Member Dick and seconded by BOCC Citizen Member Repetto to deny all petitions without further hearing where petitioner has not made partial payments ofproperty taxes by deadline pursuant to Fla. Statute section 194.014. Motion passed unanimously. Item GBob Tischenkel, Legal Counsel addressed the Board regarding Florida’s property tax system and tax payer rights and opportunities within the system. Item HLindsey Ballard, Deputy Clerk announced the tentative schedules for Hearings for the 2014 Tax Appeal year. Item IBob Tischenkel, Legal Counsel addressed the Board regarding the Pre- Hearing Checklist verification pursuant to Rule 12D.9-014. Item JMs. Ballardreported the number of petitions filed, as follows: 1) Exemption Petitions: 7filed; 2) Real Property Petitions: 187filed;Commercial Petitions: 134 filed; 3) Tangible Petitions: 19filed;4)Late FiledPetitions:15filed. Item KMotion was made by BOCC Citizen Memberand seconded by School Board Member Dickratifying the Value Adjustment Board Attorney’s determination of late-filed petitions to date for the current tax year, and re-authorization of Board Attorney’s review and determination of late-filed petitions on behalf of the Value Adjustment Board(Chapter 12D- 9.015(11)(b)). Motion passedunanimously. 09/22/2014 Item LMotion was made by BOCC Citizen Member Repettoand seconded by School Board Member Dick to appoint the Clerk, or herdesignee, to re-schedule hearings made fewer than 5 calendar days before the scheduled hearing for an emergency when good cause is shown (Chapter 12D-9.019.11(4b)). Motion passed unanimously. Item MMotion was made byBOCC Citizen Member Repettoand seconded by School Board Member Dick to adopt the following Resolution implementing the authorization provided for in Section 194.013, Florida Statutes, to require a filing fee for certain petitions filed with the Board. Motion carriedunanimously. RESOLUTION NO. 001-2014 Said Resolution is incorporated herein by reference. Item NMotion was made byBOCC Citizen Member Repettoand seconded by School Board Member John Dick to approve the Initial Certification of the Value Adjustment Board.Motion passedunanimously. Item OScott Russell, Property Appraiser addressed the Board. Item PMotion was made by BOCC Citizen Member Repetto and seconded by School Board Member Dick granting approval of the 2013 Final Meeting Minutes. There being no further business to come before the Board, the meeting was adjourned.
