RESOLUTION NO,342 -2015
A RESOLUTION OF THE MONROE COUNTY BOARD OF
COUNTY COMMISSIONERS RENOUNCING AND
DISCLAIMING ANY RIGHT OF THE COUNTY AND PUBLIC
IN AND TO THAT PORTION OF THE RIGHT OF WAY OF
2ND STREET, ADJACENT TO LOT 16, BLOCK 30 AND LOT 9,
BLOCK•29 BOTH OF SAND'S SUBDIVISION, BIG.PINE KEY
AS SHOWN AS RECORDED IN PLAT BOOK 1, PAGE 65 OF
THE PUBLIC RECORDS OF MONROE COUNTY,FLORIDA.
WHEREAS, an application was filed by.Bomar C. and Diane L Kelley to abandon-a
portion of 2nd Street on Big Pine Key that is located between Lot 16, Block 30 And Lot 9, Block
29 Both Of Sand's Subdivision Big Pine Key As Shown As Recorded In Plat Book 1, Page 65
Of The Public Records Of Monroe County, Florida; and
WHEREAS,the Board of County Commissioners of Monroe County, Florida, desires to
renounce and disclaim any right of the County and the public in and to the hereinafter right of
way;and .
WHEREAS, due' notice has been published and a public hearing has been held in
accordance with Chapter 336, Florida Statutes;and
WHEREAS, at said public hearing,the Board considered the argument of all parties .
present wishing to speak on the matter, and considered the renouncing and disclaiming of any,
right of the County and the public in and to the hereinafter described right of way as delineated
on the hereafter described map or plan; and
WHEREAS,the Board makes the following Findings of Fact and Conclusions of Law:
1. For purposes of Monroe County Code Section 19-1(a) (1) (2) (3) the right of
way does not terminate at or provide access to "open water" or preclude a way
for the public access to water.
2. By approving this resolution, Monroe County agrees to the abandonment as an
affected property owner under Monroe County Section 19-1(b).

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, that it hereby renounces and
disclaim any right of the County and public in and to the following described streets, alley-ways,
roads, or highways as delineated on the hereinafter described map or plat, to-wit:
"A Part Of 2nd Street Of"Sands Subdivision", adjacent to Lot 16, Block 30 and Lot 9,
Block 29 both of"Sands Subdivision" according to the Plat thereof as recorded in Plat Book 1,
Page 65 of the Public Records of Monroe County, Florida, and being more particularly
described by metes and bounds as follows:
commencing at the Northeast corner of Lot 9, Block 29 of said "Sands Subdivision", said
point also being the Point Of Beginning of the part of 2ND Street hereinafter described; thence
bear S 89°52'00"E a distance of 50.00 feet to the Northwest corner of Lot 16, Block 30 of said
"Sands Subdivision"; thence bear South 100.00 feet to the Southwest corner of said Lot 16,
Block 30; thence bear N89°52'00"W a distance of 50.00 feet to the Southeast corner of said Lot
9, Block 29; thence bear North 100.00 feet to the Northeast corner of said Lot 9, Block 29 and
the Point Of Beginning. Containing 5,000 square feet, more or less."
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida,
at a regular meeting of the Board held on the 21st day of October, 2015. 3 o ��
