Kolhage, District 1 David Rice, District 4 Sylvia J. Murphy, District 5 County Commission Meeting August 17, 2016 Agenda Item Number: P.4 Agenda Item Summary # 1924 BULK ITEM: Yes DEPARTMENT: County Attorney's Office TIME APPROXIMATE: STAFF CONTACT: Bob Shillinger (305) 292-3470 None AGENDA ITEM WORDING: Approval of Resolution requesting the Supervisor of Elections to place referendum questions on the November 8, 2016 General Election Ballot in order to determine if the electors of Duck Key support 1) the creation of a Beautification and Improvement District that may replace the current Duck Key Security District and 2) removal of the current special assessment cap on vacant and improved lots. ITEM BACKGROUND: The Duck Key Security District (DKSD) was established in 1992 for security services only pursuant to F.S. 125.01(1)(q) and has operated as a municipal service benefit unit thereafter. That statute authorizes the County Commission to establish, subsequently merge or abolish those municipal service taxing or benefit units for any part of all of the unincorporated area of the county. The Duck Key District advisory board and some residents of Duck Key have indicated that they support expanding the services of the DKSD and support creating the Duck Key Beautification and Improvement District (DKBID) that may potentially replace and expand upon the current DKSD. The intent is to only impose one special assessment for all services, therefore a referendum question is sought to determine if the electors of Duck Key support this creation or expansion. Additionally, Ordinance 005-1992 established the DKSD and the initial special assessment of $200.00 per improved lot and $20.00 per unimproved lot. That ordinance provides that there "shall be no need for referenda in subsequent years unless an assessment increases more than ten percent (10%) over the previous year or increases to more than the sum of $300.00 per improved lot or more than the sum of $30 per unimproved lot in any given year." While the special assessment is expected to increase this year by 10% as allowed by ordinance, it had not been increased since 1992, and regardless of whether the DKSD is ultimately expanded, it is expected that the special assessment should be increased beyond the ten percent (10%) over the previous year and/or increased to more than the sum of $300.00 per improved lot or more than the sum of $30 per unimproved lot to fund security services. The DKSD has in recent years installed security cameras which have increased its budget and thus an increase is necessary to continue further security efforts. Additionally, due to inflation, $200 in 1992 is worth $343.04 in 2016, and $200 in 2016 has the same worth that $116.61 had in 1992. The Board has the authority to place non -binding questions on the ballot in order to determine whether the electors of the boundaries of the Duck Key Subdivision support a) creating a DKBID, and b) an increase in the special assessment and removal of the special assessment cap. A resolution directing the Supervisor of Elections to place these two non -binding questions on the ballot for the November 2016 general election is presented for approval by the BOCC. PREVIOUS RELEVANT BOCC ACTION: Ordinance 005-1992 enacted by BOCC February 6, 1992; Ordinance No. 012-1994 enacted by BOCC June 16, 1994; Ordinance 016-2014 enacted by the BOCC September 17, 2014; BOCC authorized the County Attorney to seek an Attorney General opinion regarding whether the statutory authority under F.S. 125.01(1)(q) allows for municipal service taxing or benefits units to be established for beautification, landscaping and canal maintenance and restoration March 1, 2016.
