Should you have any questions, please feel free to contact our office. cc: County Attorney Finance File 500 Whitehead Street Suite 101, PO Box 1980, Key West FL 33040 Phone: 305-295-3130 Fax: 305-295-3663 3117 Overseas Highway, Marathon, FL 33050 Phone: 305-289-6027 Fax: 305-289-6025 88820 Overseas Highway, Plantation Key, FL 33070 Phone: 852-7145 Fax: 305-852-7146 SECOND AMENDMENT TO CONTRACT FOR PROFESSIONAL SERVICES BETWEEN OWNER AND ARCHITECT/ENGINEER FOR PUBLIC WORKS OFFICES ON MAGNOLIA STREET This Second Amendment to Contract for Professional Services dated November 20, 2013, between MONROE COUNTY ("Owner" or "County") and CURRIE SOWARDS AGUILA ARCHITECTS ("Architect") for the County Public Works Offices on Magnolia Street, is made and entered into this 21St day of September, 2016, in order to amend the Contract as follows: WITNESSETH WHEREAS, on January 20, 2010, the parties entered into a Contract for Professional Services on projects in which the estimated construction costs of each individual project under the contract does not exceed Two Million Dollars ($2,000,000.00), or for study activity if the fee for professional services for each individual study under the contract does not exceed Two Hundred Thousand Dollars ($200,000.00)("Continuing Contract"); and WHEREAS, on November 20, 2013, the Continuing Contract was renewed in a First Amendment effective January 20, 2014 and terminating on January 19, 2015; and WHEREAS, on November 20, 2013, the parties also entered into a Contract for Professional Services for design through construction administration of the renovation of the Magnolia Street Recycling Center for the purposes of relocating the Upper Keys Public Works Division ("Magnolia St. Project"); and WHEREAS, on December 10, 2014, the parties entered into a Second Amendment of the Continuing Contract for the purpose of completing active projects including the Magnolia St. Project; and WHEREAS, on July 16, 2014, a First Amendment to the Contract for Professional Services dated November 20, 2013, was entered into to adjust the Architect's fee to 8.63% of the actual construction costs when construction is complete in accordance with the State of Florida, Department of Management Services architectural and engineering fee guidelines; and WHEREAS, the Magnolia St. Project has been completed and the actual construction costs are known; now therefore IN CONSIDERATION of the mutual promises, covenants and agreements stated herein, and for other good and valuable consideration, the sufficiency of which hereby acknowledged, the Owner and Architect agree: 1.Owner and Architect agree that some added construction costs were incurred on the Magnolia St. Project due to errors and omissions from the Architect totaling $6,394.77, and this amount will be reduced from the total construction costs when adjusting the Architect's final fee. Owner and Architect further agree that the addition of an Information Technology (I.T.) closet was designed for the project at a later date and the professional services fee was paid to Architect. Per change order #12 the construction cost for the I.T. closet was $16,544.24 which will be excluded from the total construction cost when adjusting the Architect's final fee. 3. Owner and Architect agree to a negotiated final construction cost of $1,235,222.96 for the Magnolia St. Project. The total architectural fee for the project is $106,599.74 ($1,235,222.96 x 8.63%) of which Architect received $52,200.00 per the original Contract for Professional Services dated November 20, 2013. The balance owed to the Architect per this Second Amendment shall be $54,399.75. 4. All other terms and conditions of the Continuing Contract and as Amended, and the Contract for Professional Services for the Magnolia St. Project dated November 20, 2013, and as Amended, remain in full force and effect.
