Staff is now addressing the remaining permits property owners and have made progress in this effort. Starting with approximately 5,851 of these in March, there are currently 3,093 of these permits remaining. Further, there are 10,708 permits with no inspections and 5,031 with one passed inspection but no final inspections, which will still be processed using the Permit Investigation Process. PREVIOUS RELEVANT BOCC ACTION: March 23, 2016: BOCC discussed open permits and provided direction to staff, including but not limited to closing certain non-life safety permits and hiring additional staff to investigate 10,906 permits proactively to determine what to close, unless legal determines a method to close without an inspection by passage of an ordinance. July 20, 2016: BOCC passed and approved Ordinance 022-2016 which authorized the closing of approximately 21,100 building permits applied for prior to October 1, 1998. October 3, 2016 SUBJECT: PROGRESS REPORT ON OPEN BUILDING PERMIT PROJECT Honorable Mayor Carruthers and Commissioners, I am pleased to report on the progress staff has made on the open building permit project. As you recall we started working toward this important project late last year, at which time we had approximately 61,000 open permits. In January 2016 we transferred roughly 12,000 permits to Islamorada and Marathon and closed them in the county permitting system. An agenda item was brought to the BOCC in March requesting direction to staff regarding these open permits. Staff has been closing these permits based on your direction. In April a memo from the Building Official and Director of Planning and Environmental Resources to staff directed the administrative closure of approximately 4,700 non-life safety permits. In July the BOCC approved the closure of about 21,100 open building permits that were applied for prior to October 1998, based upon information from the County Attorney regarding Section 468.04 of the Florida Statutes and related case law. Staff was directed to investigate permits with at least one final inspection (any discipline) with the goal of closure. There were about 10,906 of these in March 2016, of which 5,015 were applied for prior to October 1998 and closed; and another 2,758 have subsequently been closed to date by staff that are processing these permits in order of difficulty, investigating and closing the easier permits first. Therefore staff has 3,093 of these permits remaining to investigate. A total of 10,708 open permits without any passed inspections (not including the 1,751 active permits) will require the Permit Investigation Process to move forward. Similarly there are 5,031 permits which have had at least one passed inspection but have not yet received any final inspections and will be required to proceed through the Permit Investigation Process. The attached table summarizes the decrease in open permits from 61,000 in late 2015 to 3,093 permits with final inspections that staff is actively addressing at no cost to customers; and 15,793 (minus the active permits therein) permits that will be required to proceed through the Permit Investigation Process.
