ITEM BACKGROUND: On 12/14/16, the Board of Governors elected to retain the same officers for the coming year with Mayor George Neugent as Chairperson and Mayor Pro Tem David Rice as Vice Chairperson. The 12/14/16 election was not done by resolution which is required pursuant to Ordinance No. 045 -1988. Adoption of this resolution by the Board of Governor satisfies the requirements for the annual election of the Chairperson & Vice - Chairperson of the Board of Governors as set forth in Ordinance No. 045 -1988. WHEREAS, Section 1 of Ordinance No. 045 -1988 provides that the Chairperson of the Board of Governors of Fire and Ambulance District 1 shall be elected by the District Governing Board for a one year term which may be successive; and WHEREAS, it has become necessary for the members of the Board of Governors of Fire and Ambulance District 1 to elect a Chairperson and Vice - Chairperson; WHEREAS, on December 14, 2016, the Board of Governors elected Mayor George Neugent as Chairperson and Mayor Pro Tern David Rice as Vice - Chairperson; however, the election was not done by resolution of the Board of Governors of Fire And Ambulance District 1 as required pursuant to Ordinance No. 045 -1988; now therefore BE IT RESOLVED BY THE BOARD OF GOVERNORS OF FIRE AND AMBULANCE DISTRICT 1, MONROE COUNTY, FLORIDA: Section 1. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA; Section 1. Ordinance No. 031 -1988, Section 13(b), is hereby amended to read as follows: b) Upon the passage of such an ordinance by one of the cities the governing body of the District shall consist of three members of the board of county commissioners and two members of the governing body of the city; if both cities elect to become part of the district, the governing body of the district shall consist of the three members of the board of county commissioners and one member from each of the cities. In either case, the county and city(ies) shall designate their representatives on the district governing body by resolution. If none of the cities choose to be included within the district, the chairman of the board of county commissioners shall be chairman of the district governing body; if any of the cities choose to be included, the chairman shall be elected by the district governing body for a one year term which may be successive. Three members of the district governing body constitute a quorum. A quorum shall be necessary for the transaction of business. The chairman shall vote at all meetings of the district governing body. Section 2 If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of e this Ordinance shall not be affected by such invalidity. G.1.b Section 3. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. Section 4. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 5. This Ordinance shall be filed with the Office of the Secretary of State of the State of Florida, but, in addition to the acknowledgement of its receipt in the Office of the Secretary of State, the Ordinance shall not take effect until the 30th day of September, 1988.
