ITEM BACKGROUND: David Manz was appointed to the HSAB January 21, 2015. He has been a resident of Marathon, and a Florida Bar certified attorney since 1988. His new two -year term will extend to January 2019. PREVIOUS RELEVANT BOCC ACTION: The BOCC approved the creation of the HSAB by Resolution No. 077 -1991, amended by Reso. No. 056 -1992 and No. 093A -2002. The advisory board reviews the funding applications and makes recommendations for the annual non -profit human services organization grant funding allocations, which are approved by the BOCC during the budget process. David received his Bachelor's of Science degree from Auburn University in 1981 and his Juris Doctor degree from Cumberland School of Law in 1984. David has been a member of The Alabama Bar since 1984 and a member of The Florida Bar since 1988. David has lived in Monroe County since 1988. David currently resides in Marathon with his wife and three children. In addition to The Florida Bar and The Alabama Bar, David is also a member of the U.S. District, the 11th Circuit Court of Appeals, and the U.S. Supreme Court. WHEREAS, on March 13, 1991, the Board of County Commissioners did pass Resolution Number 077 -1991, creating the Human Services Advisory Board; and WHEREAS, on January 8, 1992, the Monroe County Board of Commissioners did pass Resolution Number 056 -1992, amending Resolution Number 077 -1991; and, WHEREAS, the Board of County Commissioners has often observed that those County residents who are willing to serve on advisory boards are often active as volunteers or paid employees or contractors of entities involved in the field for which the advisory board was established; and, WHEREAS, it is desired to enable volunteers with appropriate expertise and experience to serve on advisory boards and yet prohibit only those conflicts of interest which are prohibited by state statute; and, WHEREAS, Resolution Number 077 -1991, as previously amended, is more restrictive than the state statute; now therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that Section V of Resolution Number 077 -1991 is hereby deleted, and that the Human Services Advisory Board members shall comply with the Florida statutes regarding ethics of county officers and employees. Resolution No. 77 -1991, Section III is hereby amended to read as follows: r (a) The Board shall consist of five members, each of whom shall be appointed by each individual County Commissioner and limited to a term of two years or the termination of the respective appointing Commissioner's term, whichever shall first occur; provided, however, that each Board member shall serve on the Board until the appointment of a successor. (b) Any member of the Human Services Advisory Board who absents himself from any three (3) consecutive regular meetings of said Board, unless excused from such attend- ance by consent of the Board, expressed by action of record in its official minutes, or who is absent from a total of four (4) regular meetings of said Board in any fiscal year wihtout having been excused from such attendance by consent of the Board expressed by action of record in its offiical minutes, shall thereby automatically forfeit his position and office as a member of the Human Services Advisory Board; and the name of such person shall be automatically removed from the membership of said Board immediately after the adjournment of any such third consecutive meeting or any such fourth meeting in any fiscal year, as the case may be, at which such member has not appeared. The Board shall thereupon promptly notify the member so removed and the Board of County Commissioners for Monroe County. The appointing Commissioner or remaining Board members, depending on the method by which the member so removed had been appointed to the Board, shall thereupon appoint a new member to serve the remainder of the unexpired term of the member so removed. Section 2. Section XI is hereby added to Resolution No. 77 -1991, and shall read as follows: Members of the Advisory Board shall be compensated for those travel expenses necessarily incurred in the performance of their official duties. Section 3. Section IV of Resolution No. 077 -1991 is hereby deleted. Section 4. This resolution amendment shall become effective immediately upon its adoption. WHEREAS, there is a need for the Board of County Commissioners to purchase services from Community based agencies that impact on the health, safety and welfare of the Citizens of Monroe County, and WHEREAS, there is a need for a board of citizens that will review requests for financial contributions from human service (non - profit) agencies, and WHEREAS, the purpose of this board is to evaluate County needs and agency performances using established guidelines so as to determine where the community will derive the greatest benefit from the tax dollars expended, and WHEREAS, the Board of County Commissioners has approved the assignment of responsibility for the administration of funding for the agencies receiving County support to the Director of Management Services through the Office of Management and Budget, NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, AS FOLLOWS: SECTION I. There is hereby created and established the Human Services Advisory Board, which shall be appointed by the County Commission and shall have staff support designated by the Director of Social Services. SECTION II. The Advisory Board may obtain information and counsel from the Clerk of Courts, the Division of Management Services, and the Department of Social Services. SECTION III. The board shall consist of 7 members, who shall serve terms of 3 years each, provided, however, of those members initially appointed to the board, 3 shall serve until January 1993, 2 shall serve until January 1994, and 2 shall serve until January 1995. SECTION IV._ Membership of the committee shall include one representative appointed by each of the five County Commissioners and the two persons subsequently elected by the committee at large. SECTION V. No appointee shall be employed by, serving on the board of, or be directly or indirectly associated with any agency that is an applicant for or in receipt of funds from the County. SECTION VI. The board shall establish eligibility guidelines and application procedures which shall become effective upon approval by the County Commission. The board shall (1) carefully evaluate the County's human services needs, (2) recommend the most cost effective way of obtaining needed services, (3) develop measures of the services provided, and (4) determine which of those services are appropriate for public funding. SECTION VII. The board shall hold an organizational meeting annually to elect a chairman, vice chairman and secretary. Officers may serve no more than three consecutive years in such office. SECTION VIII. The board shall meet at the call of the chairman or the Director of Social Services acting as designated staff representative for the Board of County Commissioners. All meeting shall be conducted in accordance with the requirements of the Sunshine Law of the State of Florida and all records shall be maintained in accordance with the public records laws of the State of Florida. The board shall abide by the rules and procedures of the Monroe County Board of County Commissioners. SECTION IX. The Monroe County Department of Social Services shall provide staff assistance to the Board including the preparation of all agendas and meeting notices, taking of all minutes and scheduling appropriate meeting places. SECTION X. This Resolution shall become effective immediately upon its adoption.
