ITEM BACKGROUND: Ordinance No. 045 -1988 provides that the Board of Governors of Fire and Ambulance District 1 (BOG) shall consist of 3 members of the Board of County Commissioners and, if only one city participates, two members of the governing body of the one city (either Key Colony Beach or the City of Layton); or, if both cities participate, one member of the governing body from each city. The ordinance further requires that the designation of members to the BOG by the County and the participating city (cities) be done by resolution. The Board annually assigns Commissioners to serve on the various boards and committees throughout Monroe County which includes the assignment of three (3) County Commissioners to represent Monroe County on the BOG. The annual item for the assignment of commissioners to the various boards and committees, etc. was continued by the BOCC on 12/14/16 to the 1/18/17 BOCC meeting. This item is being placed on the agenda immediately following the item which will include the assignment of 3 commissioners to the BOG to ensure the 3 commissioners assigned under that item are named in this resolution. Adoption of this resolution by the Board satisfies the requirements for the designation of three County Commissioners to the BOG pursuant to Ordinance No. 045 -1988. In either case, the county and city(ies) shall designate their representatives on the district governing body by resolution. If none of the cities choose to be included within the district, the chairman of the board of county commissioners shall be chairman of the district governing body; if any of the cities choose to be included, the chairman shall be elected by the district governing body for a one year term which may be successive. Three members of the district governing body constitute a quorum. A quorum shall be necessary for the transaction of business. The chairman shall vote at all meetings of the district governing body. Section 2 If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. M.3.c Section 3. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. Section 4. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 5. This Ordinance shall be filed with the Office of the Secretary of State of the State of Florida, but, in addition to the acknowledgement of its receipt in the Office of the Secretary of State, the Ordinance shall not take effect until the 30th day of September, 1988.
