11 AN ORDINANCE BY THE MONROE COUNTY BOARD OF
12 COUNTY COMMISSIONERS AMENDING SECTION 2 -700, TO
13 EXPAND THE NUMBER OF MEMBERS APPOINTED BY THE
14 BOCC TO THE AFFORDABLE HOUSING ADVISORY
15 COMMITTEE; PROVIDING FOR SEVERABILITY; PROVIDING
16 FOR REPEAL OF ALL ORDINANCES INCONSISTENT
17 HEREWITH; PROVIDING FOR INCORPORATION INTO THE
18 MONROE COUNTY CODE OF ORDINANCES; AND PROVIDING
19 FOR AN EFFECTIVE DATE.

21 WHEREAS, Monroe County, as an Area of Critical State Concern, has adopted
22 Principles for Guiding Development which includes: Making available adequate affordable
23 housing for all sectors of the population of the Florida Keys. ; and
24
25 WHEREAS, Monroe County has high land values, limited land availability due to its
26 linear geography and environmental features, controlled growth (the Rate of Growth Ordinance)
27 and a tourism economy with a prevalence of lower paying service - sector employment; and
28
29 WHEREAS, the Board of County Commissioners reconvened the Monroe County
30 Affordable Housing Advisory Committee to assist with workforce housing issues facing the
31 County; and
32
33 WHEREAS, in August, 2014, the Board of County Commissioners approved an
34 agreement with the FCRC Consensus Center, FSU, for professional services on an Affordable
35 Workforce Housing Stakeholder Assessment, in order to assess the current affordable housing
36 situation in the County and propose a process for developing recommendations; and
37
38 WHEREAS, the April 2015 Workforce Housing Stakeholder Assessment Report,
39 prepared by the FCRC Consensus Center, includes a recommendation to review the current
40 Committee appointments to ensure that a balance of workforce housing stakeholder perspectives
41 are included in its membership and considering expanding membership to include representation
42 from of the municipalities in the County, the military, the School Board and perhaps other
43 organizations impacted by workforce housing policies and programs and with a stake in
44 contributing to solutions to improve the availability of workforce housing in the Florida Keys.

I NOW, THEREFORE, BE IT ORDAINED BY THE MONROE COUNTY BOARD OF
2 COUNTY COMMISSIONERS:

4 Section 1. Section 2 -700 of the Monroe County Code shall be established as follows (deletions
5 are str-ieken three and additions are underlined
6
7 Sec. 2 -700. - Establishment of affordable housing advisory committee.
8 (a) The affordable housing advisory committee shall be established and operational by June 30,
9 2008. It shall comply with all requirements in F.S. § 420.9076 (2007) or as subsequently
10 amended.
11 (b) The committee shall consist of 4414 members who shall be appointed by the BOCC by
12 resolution.
13 (c) The committee must include:
14 (1) One citizen who is actively engaged in the residential homebuilding industry in
15 connection with affordable housing.
16 (2) One citizen who is actively engaged in the banking or mortgage banking industry in
17 connection with affordable housing.
18 (3) One citizen who is a representative of those areas of labor actively engaged in home
19 building in connection with affordable housing.
20 (4) One citizen who is actively engaged as an advocate for low- income persons in
21 connection with affordable housing.
22 (5) One citizen who is actively engaged as a for -profit provider of affordable housing.
23 (6) One citizen who is actively engaged as a not - for -profit provider of affordable housing.
24 (7) One citizen who is actively engaged as a real estate professional in connection with
25 affordable housing.
26 (8) One citizen who actively serves on the local planning agency pursuant to F.S. §
27 163.3174.
28 (9) One citizen who resides within the jurisdiction of the local governing body making the
29 appointments.
30 (10) One citizen who represents employers within the jurisdiction.
31 (11) One citizen who represents essential services personnel, as defined in the local housing
32 assistance plan.
33 (12) One citizen who is recommended by the School Board and works for the School Board
34 (13) One citizen who is recommended by the lodging industry and is impacted by workforce
35 housing policies.
36 14 One citizen who has no financial interest in the development of affordable housing.
37 (d) All meetings of the advisory committee are public meetings, and all committee records are
38 public records.
39 (e) Staff, administrative, and facility support to the advisory committee shall be provided by the
40 BOCC. The advisory committee shall be cooperatively staffed by the local government
41 department or division having authority to administer local planning or housing programs to
42 ensure an integrated approach to the work of the advisory committee.

44 Section 2. Severability.

46 If any portion of this ordinance is for any reason held invalid or declared to be unconstitutional,
47 inoperative or void, such holding shall not affect the remaining portions of this ordinance. If this

ordinance or any provision thereof shall be held to be inapplicable to any person, property or
circumstances, such holding shall not affect its applicability to any other person, property or
circumstances.
Section 3. Conflicting Provisions.
All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the
extent of said conflict.
Section 4. Inclusion in the Code of Ordinances.
The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances
of the County of Monroe, Florida, as an addition to amendment thereto, and shall be
appropriately renumbered to conform to the uniform numbering system of the Code.
Section 5. Transmittal and Effective Date.
This Ordinance shall be filed with the Department of State and shall be effective as provided in
section 125.66(2)(b), Florida Statutes.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida
at a regular meeting held on the loth day of June , 2015.
