ADD-ON: Approval of Amendment to Management Agreement
with The Young Men's Christian Association of South Florida, Inc. (YMCA) to remove the Key
Largo Community Park -Skate and Bike Park facility from contractual scope of management,
supervision, operation and direction services
ITEM BACKGROUND
: The BOCC approved use of freestyle bikes in the newly renamed Skate
and Bike Park facilities in the Key Largo Community Park (Key Largo Park) and the Big Pine Key
Community Park. F.S. 316.0085 provides the County with statutory immunity from personal injury
and property damage claims when it designates public property (such as the Skate and Bike Parks)
and allows the public to use that property for skateboarding, inline skating, paintball, freestyle,
mountain, or off-road bicycling. The current Management Agreement with the YMCA requires the
YMCA to manage, supervise, operate and direct the Key Largo Park - Skate and Bike Park facility.
The statute states that a non-governmental entity facility operator or owner, such as YMCA here, is
not granted statutory immunity. YMCA also cannot obtain the necessary insurance for these duties
related to the Skate and Bike Park facility operations. The YMCA Management Agreement needs to
be amended to relieve the YMCA of its obligations and responsibilities for the Skate and Bike Park
facility. The Amendment to the Management Agreement executed by YMCA and approved for legal
sufficiency is attached.
PREVIOUS RELEVANT BOCC ACTION
: On 2/16/00, the BOCC entered into a Management
Agreement with YMCA for management of the Key Largo Park. On 11/20/12, the BOCC entered
into a new Management Agreement with the YMCA for the management, supervision, operation and
direction of the Key Largo Park, including the Skate Park facility for a 5 year period. On 2/10/16,

Pine Key Park and to amend the current operator agreements with YMCA and Boys and Girls Club.
On 3/23/16, (1) the BOCC approved a Resolution establishing the Skate and Bike Parks, adopting
and ratifying revised rules for the Skate and Bike Parks to allow use of freestyle bikes, for posting of
rules, permissible activities, and assumption of risk warning at the designated areas; and (2) the
BOCC approved advertisement of a public hearing to consider the proposed amended ordinances.

On 4/20/16, the BOCC held a public hearing and adopted Ordinance to authorize freestyle bikes in
Skate and Bike Parks.
