OF MONROE COUNTY, FLORIDA AMENDING SECTION 2- 110(3)
TO INCREASE THE SUBSISTENCE (MEALS) ALLOWANCE RATES
FOR BREAKFAST TO $10.00, LUNCH TO $15.00 AND DINNER TO
$30.00; AMENDING SECTION 2- 111(a) TO ALLOW FOR THE
PURCHASE AND /OR REIMBURSEMENT OF A REFUNDABLE
AIRLINE TICKET, AUTHORIZING THE PURCHASE OF TRAVEL
INSURANCE, AND AUTHORIZING REIMBURSEMENT FOR THE
USE OF CHARTERED AIRLINE SERVICE UPON A
DETERMINATION BY THE COUNTY ADMINISTRATOR THAT
SUCH TRAVEL IS THE MOST COST EFFECTIVE METHOD OF
TRAVEL; AND CLARIFYING THE EXISTING LANGUAGE AND
REMOVING ANACHRONISTIC LANGUAGE; PROVIDING FOR
SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL
ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR
INCORPORATION INTO THE MONROE COUNTY CODE OF
ORDINANCES; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Monroe County Code Chapter 2, Article I11, Division 3. Travel, Per Diem,
Meals and Mileage Policy sets forth provisions governing travel reimbursement for public
officers, employees and authorized persons of Monroe County; and
WHEREAS, Section 112.061(14)(a)l., Florida Statutes, allows counties to establish
rates for per diem, subsistence (meals) and mileage allowances that exceed the rates set by
statute for state agencies by enactment of an ordinance or resolution by the governing body; and
WHEREAS, on March 18, 2015 the Board adopted Ordinance No. 009-2015 increasing
the subsistence (meal) allowance rates to: Breakfast $6.50, Lunch $13.50 and Dinner $27.00;
and
WHEREAS, the Board finds the actual cost for meals exceeds the County's current meal
reimbursement rates which do not adequately reimburse the travel for meal costs during County
related travel; and
WHEREAS, Section 2- 111(a) currently requires the County Administrator or his
designee to designate the most economical method of travel for each trip incurred for County -
related travel and does not specifically allow for the purchase or reimbursement of refundable
commercial airline tickets, purchase of or reimbursement for travel insurance, or purchase of
travel on or reimbursement for use of chartered aircraft; and
WHEREAS, due to the uncertain nature of advanced scheduling for out of town travel
for official meetings, coupled with unforgiving airline refund policies, County travelers have
experienced increased and unnecessary costs when unable to use previously purchased non-
refundable airline tickets due to last- minute schedule changes; and

WHEREAS, purchasing full fare tickets just prior to travel as an alternative to the risks
associated with advance purchase of less expensive non - refundable airline tickets also results in
unnecessary expense for the County; and
WHEREAS, due to the unique demographics of the Florida Keys and logistics of
Monroe County government, often a refundable airline ticket or a chartered flight is the more
economical air transportation especially when the Sheriff's King Air is unavailable for use; and
WHEREAS, the Board finds that it is in the taxpayers' best interests for the Board to
expressly authorize County travelers to purchase and be reimbursed for refundable airline tickets
for official travel; and
WHEREAS, the Board finds that it is in the taxpayers' best interests for the Board to
expressly authorize County travelers to purchase and be reimbursed for travel insurance for
official travel to help cover the costs due to last minute trip cancellations; and
WHEREAS, the Board finds that it is in the taxpayers' best interests for the Board to
expressly authorize County travelers to use and be reimbursed for use of chartered airline service
provided that the County Administrator makes a determination that such travel is the most cost
effective method of travel for that particular trip; and
WHEREAS, the Board desires to increase the County's reimbursement rates for
subsistence (meals) during official travel as well as to allow for the purchase of and /or
reimbursement for refundable airline tickets and travel insurance; and
WHEREAS, the Board desires to authorize the use and reimbursement for official travel
by chartered aircraft provided that the County Administrator has made a determination that such
travel is the most cost effective method of travel for that particular trip;
WHEREAS, the Board desires to update the language in Section 2 -111 by removing
some outdated language; now therefore,
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
SECTION 1. Sec. 2- 110(3) - Rates of per diem and subsistence allowance. shall be amended
to read as follows:
(3) All travelers shall be allowed the following amounts for subsistence while
on class C travel on official business as provided in section 2- 109(2):
a. Breakfast, $10.00;
b. Lunch, $15.00; and
c. Dinner, $30.00.
Note The remainder of Sec. 2 -110 remains unchanged.

SECTION 2 Sec. 2- 111(a). - Transportation. shall be amended to read as follows:
(a) All travel must be by a usually traveled route. In case a person travels by an indirect route
for his own convenience, any extra costs shall be borne by the traveler; and reimbursement for
expenses shall be based only on such charges as would have been incurred by a usually traveled
route. The county administrator or his designee shall designate the most economical method of
travel for each trip, keeping in mind the following conditions:
(1) The nature of the business;
(2) The most efficient and economical means of travel (considering time of the traveler,
impact on the productivity of the traveler, cost of transportation, and per diem or
subsistence required). When it is more efficient and economical to either the traveler or
the County, scheduled service offered by any airline may be used when the cost is within
an approved threshold determined by the County Administrator or his designee;
(3) The number of persons making the trip and the amount of equipment or material to
be transported;
(4) When justifiable circumstances exist, a traveler is authorized to purchase and the
Clerk is authorized to reimburse that traveler for the purchase of a refundable airline
ticket and /or travel insurance that authorizes reimbursement for cancelled or delayed
travel; and
(5) Upon a determination by the County Administrator that use of an air charter service
is the most cost effective method of travel for the County for a particular trip, travelers
are authorized to charter an airline service and the Clerk is authorized to reimburse the
traveler(s) responsible for paying the charter company. The charter company may also be
paid as a vendor.
Note: The remainder of Sec. 2 -111 remains unchanged.
SECTION 3: SEVERABILITY. If any portion of this ordinance is for any reason held
invalid or declared to be unconstitutional, inoperative or void, such holding shall not affect the
remaining portions of this ordinance. If this ordinance or any provision thereof shall be held to
be inapplicable to any person, property or circumstances, such holding shall not affect its
applicability to any other person, property or circumstances.
SECTION 4: CONFLICT WITH OTHER ORDINANCES. All ordinances or parts of
ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict.
SECTION 5: INCLUSION IN CODE OF ORDINANCES. The provisions of this ordinance
shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida,
as an addition or amendment thereto, and shall be appropriately renumbered to conform to the
uniform numbering system of the Code.

SECTION 6: TRANSMITTAL AND EFFECTIVE DATE. This Ordinance shall be filed
with the Department of State and shaii be effcctive as provided in section 125.66(2)(b), Florida
Statutes.
