A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA
CONVEYING A PORTION OF THE SOUTH ROOSEVELT
BOULEVARD RIGHT -OF -WAY TO THE STATE OF
FLORIDA DEPARTMENT OF TRANSPORTATION.
WHEREAS, Florida Statute 125.38 provides for the conveyance of county owned real
property to the State of Florida, or any department thereof, for public or community interest and
welfare, so long as the board of county commissioners is satisfied that the real property to be
conveyed is required for such use and is not needed for county purposes. The conveyance may
be for a nominal price regardless of the actual value of the property. In such a transfer no
advertisement is required; and
WHEREAS, the owner of record to a portion of South Roosevelt Boulevard right -of -way
lying in front of La Brisa Condominiums is uncertain and has previously been identified on the
La Brisa West Condominium Survey Sketch as a "County Park "; and
WHEREAS, the Florida Department of Transportation has provided Monroe County
Board of County Commissioners a Title Report prepared by Paramount Title Services, Inc., 7515
W. Oakland Park Boulevard, Suite 103, Fort Lauderdale, Florida 33319, identifying the owner of
record as La Brisa Association, Inc. a Florida not for profit corporation, a copy of which is
attached hereto and incorporated herein; and
WHEREAS, the Florida Department of Transportation has provided Monroe County
Board of County Commissioners with a current survey, sketch and legal description of the real
property at issue and identified the property as "Section 101" on the survey, a copy of which is
attached hereto and incorporated herein; and
WHEREAS, the Florida Department of Transportation is participating with the City of
Key West in order to complete the South Roosevelt Improvement Project, including plans to
upgrade the drainage system, repaving and restriping of the roadway, a new bike lane, three mid -
block pedestrian crossings and enhancement to the overall area; and
WHEREAS, the Florida Department of Transportation has presented to the Monroe
County Board of County Commissioners a quitclaim deed for Section 101 of the Right -of -Way
on South Roosevelt Boulevard and;
WHEREAS, due to the uncertainty of the ownership of the real property, Florida
Department of Transportation is applying to and requesting that the Monroe County Board of

County Commissioners convey its ownership, if any, by quitclaim deed, to the Florida Department
of Transportation of Section 101 of the Right -of -Way on South Roosevelt Boulevard, Key
West, Florida, for the nominal amount of One Dollar and No 100 ($1.00); now therefore

BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA:
Section 1. Monroe County shall convey its ownership, if any, of Section 101 of the
Right -of -Way on South Roosevelt Boulevard, Key West, Florida to the Florida
Department of Transportation.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
Florida at a regular meeting of said Board held on the 15 day of February, 2017.

THIS QUITCLAIM DEED, Made this day of , 20 —LY by MONROE COUNTY, a
political subdivision of the State of Florida, Grantor, to the STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATION, Grantee. Wherever used herein the terms "Grantor" and "Grantee" include all the parties to this
instrument and the heirs, legal representatives and assigns of individuals, and the successors, and assigns of organizations.
WITNESSETH: That the Grantor, for and inconsideration of the sum of $1.00 and other valuable considerations,
receipt and sufficiency being hereby acknowledged, does hereby remise, release and quitclaim unto the said Grantee
forever, all right, title, interest, claim and demand, which said Grantor has in and to the hereinafter described parcel of land,
together with all other right, title, interest, right of possession, claim and demand, if any, which the said Grantor has in and
to said parcel situated in the County of Monroe Florida, viz:

BEGINNING at the Southwest comer of said "Park "; Thence N34 °00' 45 "W along the existing easterly Right -of -Way line
of Bertha Street, for a distance of 51.72 feet to the point of intersection with the northerly line of said "Park ", also being the
southerly line of the Auditorium Tract, as shown on said plat of Map of Auditorium Tract; Thence N70'47'1 5"E along said
southerly line, for a distance of 540.07 feet to a point on the easterly line of said "Park "; Thence S33 0 56'44 "E along said
easterly line of said "Park ", for a distance of 51.70 feet to a point on the existing northerly Right -of -Way line of State Road
