PSC staff disallowed many ofKWRU’sexpenses, including some management fees, legal and accounting fees.The PSC voted to acceptthis recommendation at its meeting on 2/7/17. The final order should be issued by the end of February and, unless appealed, will become final 30 days after it is issued.The new rates will go into effect oncethe utility files a new tariff sheet with the PSC and sends out customer notices.While the average customer will see an increase in their monthly billand an increase in some miscellaneous charges, the resulting rates are still lower than most of the other wastewater utilities in the County, other than the City of Key West.The resulting rates are approximately $150 –325 per year less for the average residential customer compared to what KWRU had requested or what the PSC had ordered before the County filed its petition. While staff did not adoptthe County’s projections for growth on Stock Island,and thuswe believe that they have understatedfuturerevenues, the resulting final rates are only slightly higher than what the PSC had originally ordered for phase 1 rates. The rates will also go down by 5% in four years, when some utility expenses have been fully recovered. (IPERI] WO]Z*/%% z'%/+VMRHIV 2. TYQTIEWIQIRXPMXMKEXMSRz Two property owners in the Cudjoe Regional Wastewater System service area filed suit against the County and FKAAseeking a judicial declaration that they are not obligated under state law and county ordinance to connect to the CRWSunless the grinder pump is located in the right of way; the amended complaint also seeks a writ of mandamus to compel the county and the FKAAto provide a gravity hook up to the property owners.On 12/7/16,Circuit Judge Bonnie Helms dismissed Count I of the amended complaint with leave to refile a second amended complaintbefore recusing herself. On 2/3/17, Judge Koenig denied the property owners’motion for rehearing and imposed a deadline of 2/16/17 to file an amended pleading. 4EGOIX4K 3E +EPPISR&E]'SVTZ1SRVSI'SYRX]ERH7XEXISJ*PSVMHEzH 3..The developer/property owner filed a notice of appeal on 6/15/16. County and State filed notice of cross appeal on 6/20/16.This is the eighth (8th) time this case has been before the Third DCA.The Third DCAextended the deadline for Galleon Bay to submit its initial brief to 2/23/17 and stated that no further requests for extensions will be allowed. (SREPH(EZMW 'SPPMRW Z1SRVSI'SYRX] 7XEXISJ*PSVMHE 4.-The parties reached a tentative settlement agreement during a mediation conference held on 8/29/16.TheBoard ratified the settlementagreementat the 9/21/16 meeting. Under the agreement, the parties stipulated that the value of the Davis property was $175,000; the parties also stipulated that the County and State are permitted to appeal the underlying liability finding previously entered in favor of Mr. Davis. The settlement eliminates the need for a valuation trial that had been scheduled for 10/17/16 before Chief Judge Mark Jones.After the Court enters a final judgment, the County & State plan on appealing the underlying liability judgment to the Third District Court of Appeal. %MV&R& At the June 2016 meeting, the Board gave direction to work with the Tax Collector to seek full payment of tourist development taxes by AirBnB customers in a manner that does not conflict with or encourage violations of the County’s vacation rental ordinance. Included within that direction was to consult with outside counsel to gauge the interest of other counties to join us in a suit against AirBnB but also to negotiate with AirBnB to see if we can avoid litigation. Those efforts are ongoing. Of those 19 cases, 14were found in violation (including 10stipulated agreements), 2were continued, and 3 came into compliance prior to the hearing.The Special Magistrate imposed fines of$66,438.00.
