Approval of a resolution authorizing the Mayor to execute a quit
claim deed in favor of The State of Florida Department of Transportation for a portion of the South
Roosevelt Boulevard and Bertha Street right-of-way in order to complete the South Roosevelt
Improvement Project.
ITEM BACKGROUND:
The Florida Department of Transportation (FDOT) is participating with
the City of Key West in order to complete the South Roosevelt Improvement Project. Included in
this project are plans to upgrade the drainage system, repaving and restriping of the roadway, a new
bike lane, three mid-block pedestrian crossings and enhancement to the overall area.
Title to a portion of the South Roosevelt Boulevard right-of-way is uncertain. The uncertain portion
of the right-of-way lies in front of La Brisa Condominiums and has been identified as section 101 on
the FDOT Right of Way map and is also identified, on the La Brisa West Condominium Survey
Sketch as County The Florida Department of Transportation (FDOT) has requested that
the Monroe County BOCC deliver a quitclaim deed to the State of Florida Department of
Transportation for the purpose of clearing title to the portion of South Roosevelt Boulevard right-of-
way in front of La Brisa Condominiums. FDOT has provided a title opinion that states that the
property is owned by La Brisa Association, Inc., a Florida not for profit corporation; however,
because the pr FDOT has requested that Monroe County BOCC
transfer its ownership, if any, to FDOT.
