AGENDA ITEM WORDING:
Discussion and direction regarding the Big Pine Road Prison
property where two buildings on adjacent County property appear to be encroaching on the prison
property.
ITEM BACKGROUND:
On behalf of the State of Florida Bureau of Public Land Administration,
Department of Environmental Protection-Division of State Lands (DEP), Jay Sircy, recently
contacted the County Attorney regarding s desire to clear a title issue of encroachment
over state owned property known as the Big Pine Road Prison . The County owned
parcel that is adjacent to the Road Prison and contains the tion and Social Services
Building . In addition, there are two (2) single family residences located
on the Fire Station property which encroach over and upon the Road Prison property, according to
the attached survey.
The Trustees of the Internal Improvement Fund of the State of Florida
owner of record of the Big Pine Road Prison, (RE number 00111650.000000). The property is
currently leased to the State of Florida Department of Transportation, Lease Agreement Number
3367, with no expiration date, a copy of which is attached.
The County is the owner of record of the Fire Station property, (RE number 00111460.000000).
A portion of the Fire Station property is currently leased to the Florida Department of Agriculture
, which has a termination date of February 23, 2022. A copy of the
lease is attached. The two (2) single family residences, located on the Monroe County, Fire Station
property, are encroaching on the State of Florida, Road Prison property and are currently occupied
by employees of DOA Division of Forestry.
Mr. Sircy indicated that the State is open to options for clearing this title issue of encroachment. He
suggested the following options:
1.Monroe County purchase of the encroachment area.
2.A land swap of portions of both parcels of land between TIIF and Monroe County.

3.A land swap of the encroachment area and other Monroe County lands.
close the Prison, acquisition of that parcel by the County
would also resolve the encroachment issue. Direction is needed as to what position the County
Commission wants to take regarding resolving the encroachment between these two properties and
how the issue should be resolved.

STAFF RECOMMENDATION:
Direct the County staff to hold off on resolving encroachment
until determining if State finalizes its decision to keep prison operating.
