BETWEEN MONROE COUNTY AND BENDER & ASSOCIATES ARCHITECTS, P.A.
FOR EAST MARTELLO SANCHEZ GALLERY ADA RAMP INSTALLIATION
KEY WEST, FLORIDA
In accordance with the Consultant Agreement for Professional Architectural and Engineering
Services, made and entered into on the 21" day of January, 2015, and as amended on the 18 day
of January, 2017, between MONROE COUNTY, hereinafter referred to as the "County," and
BENDER & ASSOCIATES ARCHITECTS, P.A., hereinafter referred to as "Consultant,"
where professional services are allowed if construction costs do not exceed Two Million and
00 /100 ($2,000,000.00) Dollars, or for study activity if the fee for professional services for each
individual study under the contract does not exceed Two Hundred Thousand and 00 /100
($200,000.00) Dollars, (hereinafter referred to as the "Agreement ").
All terms and conditions of the referenced Agreement apply to this Task Order, unless this Task
Order amends, adds, or modifies a provision or an Article of the Agreement of which will be
specifically referenced in this Task Order and the amendment, addition, or modification shall be
precisely described. These additions apply only to the project referenced in this Task Order.
This Task Order is effective on the _? of jnorc,� 2017.
WHEREAS, on October 17 2012, the BOCC approved a Contract with Consultant for the East
Martello Tower ADA Upgrades in the amount of Fifteen Thousand and 00 /100 ($15,000.00)
Dollars in accordance with the annual Contract for Professional Services dated January 20, 2010,
as renewed on November 20, 2013, and terminating on January 19, 2015; and
WHEREAS, grant funding for the ADA Upgrades during the county -wide ADA Compliance
projects ran out before the East Martello project could begin; and
WHEREAS, the Tourist Development Council (TDC) awarded the County funding for the East
Martello ADA Upgrades in fiscal year 2016; and
WHEREAS, during construction it was determined that access to the Sanchez Gallery at East
Martello needed ADA access by constructing an ADA ramp; and
NOW THEREFORE, in consideration of the mutual promises contained herein, the County and
Consultant agree to this Task Order based on their current annual Professional Architectural and
Engineering Services Agreement dated January 21, 2015, and as amended on January 18, 2017,
for Professional Services associated with the Sanchez Gallery Ramp as follows:
1. In accordance with Article II SCOPE OF BASIC SERVICES of the Professional
Architectural and Engineering Services Agreement, the Consultant will perform services
as described below:
a. Consultant shall conduct an on -site evaluation of existing conditions, develop
details for discussion, conduct a meeting with the County and Key West Art and
Historical Society staff and provide a draft and final report. This evaluation will
be referred to as the Consultant's "assessment findings" and will be utilized to
determine the scope of the construction bid.
b. Consultant shall utilize the scope of work required in the assessment findings as
the basis of design and then detail these areas on the construction documents. The
Consultant shall prepare drawings and specifications that comply with the
Secretary of the Interior's Standards and coordinate with and obtain approvals
from the County, State Division of Historical Resources, and the Key West
Historic Architectural Review Commission (HARC).
c. Consultant shall provide construction bidding services to include evaluating
qualifications' submittals, listing contractors meeting the requirements, evaluating
all bids, and making a recommendation for award. Consultant shall attend the
pre -bid conference(s) and respond to bidder questions by addenda.
d. Consultant shall provide construction administration services including:
conducting, at a minimum four (8) on -site progress meetings to confirm
compliance with the contract documents, filing field reports, approving
contractor's submittals, answering contractor's questions, reviewing and
recommending approval of contractor invoices, and final punch list /acceptance.
2. In accordance with Article VII paragraph 7.1.1, the County shall pay the Consultant a
lump sum fee of Five Thousand Three Hundred and 00 /100 ($5,300.00) Dollars paid on
percent complete basis for the following phases:
a. Assessment & Design — consisting of a final assessment report— $1,500.00 upon
document review and approval by the Director of Project Management.
b. Construction Documents — consisting of drawings and specifications setting forth
in detail the requirement for the construction of the project — $2,500.00 upon
document review and approval by the Director of Project Management.
c. Construction Administration - $1,300.00 upon final acceptance.
All other Terms and Conditions of the Task Order shall remain in accordance with the
Agreement dated January 21, 2015, and as amended on January 18, 2017.
