At the April 20, 2016 Board of County Commissioner's meeting the Board granted approval and
authorized execution of Items:
N2 Approval of Amendment No. 9 to the Contract for Engineering, Design and Permitting Services
of the Demonstration Projects, with AMEC Foster Wheeler Environment and Infrastructure, Inc. for an
internal reallocation of funds to fund the CEI services for the #277 Culvert and the #266 and #287 air
curtain installations, and minimal technical review for the air curtains O&M operations. The Contract
value remains unchanged.
N3 Authorization to enter into Amendment # 1 to the contract with Earth Tech Enterprises, Inc. for
installation of air curtains on Canals #266 and #287 on Big Pine Key to remove the list of subcontractors
from the contract. The contract value remains unchanged.

AMENDMENT NO.9
TO THE CONTRACT
FOR
ENGINEERING, DESIGN AND PERMITTING SERVICES
FOR THE
CANAL DEMONSTRATION PROJECTS
THIS AMENDMENT NO. 9, dated April 20, 2016, is entered into between the County and the
CONSULTANT, to the Contract For Engineering, Design And Permitting Services, dated the
21' day of May, 2014, as amended September 17, 2014 (Al), February 18, 2015 (A2), May 20,
2015 (A3), July 15, 2015 (A4), October 21, 2015 (A5), January 20, 2016 (A6) and March 23,
2016 (A7 and A8) by and between Monroe County Board of County Commissioners,
"COUNTY," and AMEC Foster Wheeler Environment & Infrastructure, Inc., "AMEC".
WITNESSETH:
WHEREAS, much engineering and administrative coordination work has been performed under
the Contract for design and construction oversight of the canal demonstrations projects; and
WHEREAS, the culvert installation project construction contractor Douglas N. Higgins, Inc. and
the air curtain installation projects construction contractor EarthTech Enterprises each has a 60
day construction schedule for which AMEC CEI services will be required; and
WHEREAS, the Operations and Maintenance period for the air curtains extends for a period of
two years, during which time AMEC will be needed to provide technical review of the activities
and reports only during the first six months of activities; and
WHEREAS, funds are required to fund the CEI onsite inspections by AMEC for the time needed
for these two projects; and
WHEREAS, funds are required to provide technical review of the operation and maintenance
performance of the Canal #266 and #287 air curtain projects during the first six months of
operation
NOW, THEREFORE, in consideration of mutual promises, covenants and contracts stated
herein, and for other good and valuable consideration, the sufficiency of which is hereby
acknowledged, COUNTY and AMEC agree as follows:
1. AMEC will provide the scope of services as specified in Exhibit "A-9" attached and made a
part of this AMENDMENT No. 9.
2. This AMENDMENT No. 9 provides a reallocation of previously funded tasks totaling Forty
Four Thousand Two Hundred Ninety Nine Dollars and Six Cents ($44,299.06). $16,431.75 of
existing funds from Canal #290 CEI Task 10 approved in Amendment #5, $21,723.31 of
existing funds from Canal #459 Task 1, and $6,144.00 of existing funds from Canal #459 Task 2
shall be reallocated to the tasks for the construction support services at Canal #277 culvert
installation project, Canal #266 and #287 air curtain installation projects, and technical review of

the air curtains operation for the first six months which is needed to ensure the system operates
per design and in an optimal manner. The overall CONTRACT value will remain unchanged
from the current Nine Hundred Sixty Two Thousand and Thirty Five Dollars and Forty Four
Cents ($962,035.44)
IN WITNESS WHEREOF, each party caused this AMENDMENT NO. 9 to be executed by its

AMEC FOSTER WHEELER'S SCOPE OF SERVICES
A. Construction Support Services And Engineering During Construction At Canal #277
Culvert Installation and Canal #266 and #287 Weed Barrier Installation and Review of
Operation and Maintenance Data for #266 and #287 Air Curtains
1. Scope of Work:
The AMEC Foster Wheeler's scope of work associated with the original contract for Engineering,
Design and Permitting Services for Canal Demonstration Projects dated May 21, 2014 included
work at Canal #277 Big Pine Key the Tropical Bay Subdivision Culvert Installation, Canal #266
Big Pine Key the Doctors Arm Subdivision Air Curtain Barrier, and Canal #287 Big Pine Key the
Atlantic Estates Subdivision Air Curtain related to Construction Support Services and Engineering
during Construction which was identified as Task 7 for each project. The scopes included daily site
inspections and construction administration for the projects. The culvert installation project
construction contractor Douglas N. Higgins, Inc. and the weed barrier installation projects
construction contractor Earth Tech Enterprises has proposed a 60 day construction schedule and
requested to extend the work week to include Saturdays. The original contract dated May 21, 2014
Task 7 for the Culvert Installation included 21 days for oversight and the Air Curtain Installation
projects included a total of 14 days for oversight.
Douglas N. Higgins has provided a schedule with a construction completion date to June 27, 2016.
Earth Tech Enterprises has provided a schedule with a construction completed date to July 17, 2016.
Additionally, the original scope of work for Canals #266 and #287 did not include any technical
review time of the air curtain operation for the first six months which is needed to ensure the system
operates per design and in an optimal manner. Additional funds are required to fund the additional
CEI onsite inspections by AMEC for the additional time needed by the contractor to complete the
projects and to review the operational data of the two air curtains. The specific scope includes:
a) Site Inspections: AMEC will oversight the concurrent projects Monday through Friday
during field construction activities through July 17, 2016 and prepare daily work reports
showing contractors activities, equipment, maintenance of traffic and environmental
compliance. AMEC will contact site superintendent via phone on Saturday's to determine a
status update.
b) Construction Administration - AMEC will provide consultation and advice to County
regarding the Contractor's performance of the Contract. AMEC will liaise with the County,
homeowners, and other stakeholders as necessary to administer the construction contract
through the estimated July 17, 2016 project completion date.
c) Review of Operation and Maintenance Data — AMEC will review the Contractors'
operational and maintenance data for the air curtains at Canals #266 and #287 for a six month
period after system startup. AMEC will provide recommendations to the Monroe County
and the Contractor as needed.
2. Deliverables:

Subcontract services will be invoiced at a cost multiplied by 1.15
