12 OF COUNTY COMMISSIONERS APPROVING A
13 SPECIAL PERMIT ALLOWING A TEMPORARY
14 CONSTRUCTION STAGING AREA AND A
15 TEMPORARY SETBACK VARIANCE FOR A CANAL
16 RESTORATION/WATER QUALITY IMPROVEMENT
17 PROJECT AT PROPERTY DESCRIBED AS A TRACT OF

24 WHEREAS, an application was filed for a special permit allowing a temporary
25 construction staging area at a property on Avenue I, Big Pine Key, approximate mile marker 31
26 (Florida Bay side of the Overseas Highway); and
27
28 WHEREAS, the property is described as a tract of land in a part of Block 51, Sand's
29 Subdivision (Plat Book 1, Page 65), having real estate (RE) Number: 00110940.000000; and
30
31 WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to
32 grant the special permit allowing a temporary construction staging area and temporary setback
33 variance of 25' from the required 25' front yard setback along the Avenue I right -of -way and 10'
34 from the required 10' side yard setback along the eastern property line; and
35
36 WHEREAS, the temporary construction staging area would facilitate a canal
37 restoration/water quality improvement project being carried out by Monroe County; and
38
39 WHEREAS, due notice has been carried out and a public hearing was held in accordance
40 with Monroe County Section 6 -3; and
41
42 WHEREAS, at said public hearing, the Board considered the argument of all parties
43 present wishing to speak on the matter; and

WHEREAS, the Board makes the following Findings of Fact and Conclusions of Law:

1. The temporary construction staging area is not inconsistent with any of the criterion
provided in Monroe County Code §6 -3;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the preceding Findings of
Fact and Conclusions of Law support its decision to approve the request for a special permit,
subject to the following conditions:
1. The temporary construction staging area shall only be used in association with the canal
restoration project for Canal #290 on Big Pine Key.
2. The expected commencement date of the temporary construction staging area is July 1,
2015. The termination date of the temporary construction staging area shall be no later
than June 30, 2016.
3. Upon termination of the temporary construction staging area, the property shall be
restored to its prior condition.
AND ADOPTED BY THE BOARD OF COUNTY COMMISSIONERS of Monroe
County, Florida, at a regular meeting held on the 10 of June, 2015.
