The applicant is Monroe County. The subject right -of -way is unimproved and is adjacent to the County Magnolia Street Public Works Facility and the abandonment is requested in order to utilize the land area for the Public Works Facility. The other adjacent property owner is Board of Trustees of the Internal Improvement Trust Fund. The Florida Department of Environmental Protection, Bureau of Public Land Administration issued a letter dated June 20, 2016, stating there is no objection to the proposed abandonment. The portion of right -of -way is contiguous the petitioner's property. (2) the right -of -way provides access to the public to land on open water; or • The platted, undeveloped right -of -right does not provide access to the public to land on open water. (3) the abandonment would preclude a way for the public to maintain access to the water. • The abandonment would not preclude a way for the public to maintain access to water as there is no public access to the water through this right of way. (c) In all other cases of abandonment, no right -of -way shall be abandoned unless there is an agreement to do so by all affected property owners. For purposes of this subsection, an affected property owner is the owner of property which, if the right -of- way is abandoned, will: (1) Have access that is currently used by that property owner eliminated; • The requested abandonment is for a portion of unimproved right - of -way that is contiguous the petitioner's property. All adjacent properties will continue to utilize Magnolia Street, Atlantic Drive, and Oleander Drive. • The Florida Department of Environmental Protection, Bureau of Public Land Administration issued a letter dated June 20, 2016, stating there is no objection to the proposed abandonment. (2) Have the only platted access eliminated; • The requested abandonment is for a portion of unimproved right - of -way contiguous to the petitioner's property, which is not used for access by other properties. • The Florida Department of Environmental Protection, Bureau of Public Land Administration issued a letter dated June 20, 2016, stating there is no objection to the proposed abandonment. (3) Have the paved area adjacent to that property increased for turn- around purposes; or • A T- turnaround is not required by Engineering Services. (4) Be increased in size. • The affected properties (County property and DEP property) will be increased in size by 3,225.0 square feet, more or less; however, there is no objection to this increase. • The Florida Department of Environmental Protection, Bureau of Public Land Administration issued a letter dated June 20, 2016, stating there is no objection to the proposed abandonment. If required for safety purposes, as determined by either Fire Marshal or County Engineer, a dedicated turn- around area shall be shown on the submitted survey and shall be agreed to in writing and constructed with payment by the property owner(s) requesting abandonment. • No objections or conditions were given from Monroe County Fire Marshal or Engineering Services. (e) A right of way may be abandoned only at the terminal portion of the road and in its full width unless one of the following applies; 1. An adjacent lot owner has on the platted right -of -way or within a setback a substantial structure which predates the Special Session Law 59 -1578 pertaining to maps, plats and right -of -way. The term "substantial structure" specifically does not include wood or metal fences, sheds or tiki huts or other items not listed which are accessory structures; or 2. The abandonment is requested by a County department or governmental agency for a public use; for purposes of this subsection public use is a public facility and /or public /private utility; or 3. The right of way area is unusual in size or shape and after abandonment the remaining right of way width will be the same on both sides of the abandonment as shown in Example 1. • The petition is by a County department for a public use. The requested abandonment meets the criteria in Section 19 -1 (Abandonment of rights -of -way) and is therefore suitable for abandonment. RECOMMENDATION Staff recommends approval of the requested abandonment. No. 7700 Packet Pg. 1352 ;G 2 ,t 3 4 5 6 7 ORDINANCE 026 -2015 8 9 AN ORDINANCE BY THE BOARD OF COUNTY 10 COMMISSIONERS OF MONROE COUNTY, FLORIDA 11 AMENDING SECTION 19 -1 OF THE MONROE COUNTY CODE 12 OF ORDINANCES CONCERNING ROAD ABANDONMENTS; 13 PROVIDING FOR SE ILITY; PROVIDING FOR REPEAL 14 OF CONFLICTING PROVISIONS; PROVIDING FOR AN 15 EFFECTWE DATE. 16 18 19 WHEREAS, staff has received requests and the Board of County Commissioners has considered 20 requests to abandon portions of the County's right of way which are not for the full width of the road, but 21 only a portion of the road or right of way which will be usable to the applicant; and 22 23 WHEREAS, granting of such requests does not relieve the burden of maintenance or upkeep by 24 County staff and lessens the potential for use of the right of way for utilities or other public uses for 25 public benefit; and 26 27 WHEREAS, the BOCC approved Resolution No. 250 -1998 on June 10, 1998, to address 28 concerns with abandoning irregular pieces of the road that could result in confusion in the future with 29 respect to paving and maintenance, and that such an abandonment will prompt numerous petitions to 30 carve irregular sections out of roadways; and 31 32 WHEREAS, BOCC Resolution No. 250 -1998 did not allow partial abandonments to be 33 considered and it was determined in 2010 that the criteria of Resolution No. 250 -1998 were more 34 appropriately placed in an ordinance and codified; and 35 36 WHEREAS, the BOCC approved Ordinance 017 -2010 amending Section 19 -1 to include the 37 criteria from Resolution No. 250 -1998; and 38 39 WHEREAS, Florida Statute Section 336.09 provides authority to allow for partial right of way 40 abandonments; and 41 42 WHEREAS, certain circumstances may allow for consideration of partial right of way 43 abandonment and clarification of the road abandonment process is necessary. 44 45 46 NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS 47 OF MONROE COUNTY, FLORIDA: 48 49 Section 1. Section 19 -1 of the Monroe County Code shall be amended as follows: 50 I Sec. 19 -1. - Abandonment of Rights -of -Way. 3 (a) All applications for the abandonment of public rights of way shall demonstrate the right of way is 4 no longer required for public use and convenience. Any proposed abandonment must demonstrate 5 that such action will not adversely affect public safety or convenience or otherwise have a 6 negative impact on the County system of streets or public or private utility facilities. 7 (b) No dedicated and accepted right -of -way in the county shall be abandoned where: 8 r i 1) The right -of -way terminates on a body of open water, or 9 W 2) The right -of -way provides access to the public to land on open water; or 10 vir 3) The abandonment would preclude a way for the public to maintain access to the water. 11 (c) U all other cases of o ' ent, no -of= slssll Boned unless them is an 12 r o' by 1 t o „;,v or purposes of this subsection, an 13 affected property owner is the owner of property which . c ` i - , � the area subject to 14 abandonment or, if the right -of -way is abandoned, will: 15 1) Have access that is currently used by that property owner eliminated or diminished; 16 2) Have the only platted access eliminated; 17 3) Have the paved area adjacent to that property increased for turn -around purposes; or 18 Vf 4) Be increased in size. 19 (d) All right of way abandonments shall comply with the County Code and Standard Engineering 20 requirements for road, turn- around and fire - rescue access. If required for safety purposes, as 21 determined by either Fire Marshal or County Engineer, a dedicated turn - around area shall be 22 shown on the submitted survey and shall be agreed to in writing and constructed with payment 23 by the property owner(s) requesting abandonment. 24 (e) A right of way may be abandoned only at the terminal portion of the road and in its full width 25 unless one of the following applies; 26 1. An adjacent lot owner has on the platted right - of - way or within a setback a substantial 27 structure which predates the Special Session Law 59 -1578 pertaining to maps, plats 28 and right -of -way. The term "substantial structure" specifically does not include wood 29 or metal fences, sheds or tiki huts or other items not listed which are accessory 30 structures; or 31 2. The abandonment is requested by a County department or governmental agency for a 32 public use; for purposes of this subsection public use is a public facility and/or 33 public /private utility; or 34 3. The Planning Director and County Engineer may elect to waive elements of the survey requirements in cases where it is determined that inclusion of an element on the survey is not necessary for the evaluation of the application. Applicant must submit a copyof the recorded plat with the application. All applications require a title certification, prepared not more than 90 days prior to submission of the application specifying language from the plat that dedicated the right of way and the County's interest in the right of way. to the date of submission of subject property - cl Upon the filing of a complete application, as determined by the Planning Director the petition shall be reviewed by affected County departments as follows: 1) Review for consistency with the Comprehensive Plan by the Department of Planning. 2) Review for impact on public safety and convenience by the County Engineer, Sheriff, and Fire Marshal or designees. 3) Review for impact on transportation system and drainage by the County Engineer, or designee. 4) Review for title interest by County Attorney. The Board of County Commissioners considers these a restriction on the rights of individuals who desire to abandon properties in accordance with F.S. § 336.09. 35 Section _2. ' _ _Sevembi :. 36 If any portion of this ordinance is for any reason held invalid or declared to be unconstitutional, 37 inoperative or void, such holding shall not affect the remaining portions of this ordinance. If this 38 ordinance or any provision thereof shall be held to be inapplicable to any person, property or 39 circumstances, such holding shall not affect its applicability to any other person, property or 40 circumstances. 41 42 Section 3. Section 5. Transmittal and Effective Date. This Ordinance shall be filed with the Department of State and shall be effective as provided in section 125.66(2)(b), Florida Statutes.
