C35 Second Amendment to the Amended and Restated Agreement with The Florida Keys Society for
Prevention of Cruelty to Animals, Inc. for operation of the Key West Animal Shelter reflecting a CPI -U
increase of 2.1 % effective May 1, 2017. The agreement amount will increase to $529,495.80/year or
$44,124.65 /month.

SIXTH AMENDMENT TO CONTRACT
(Operation of the Marathon Animal Shelter)
THIS SIXTH AMENDMENT TO CONTRACT is entered into this 17th day of May,
2017, between Monroe County Board of County Commissioners ( "County ") and Florida Keys
Society for Prevention of Cruelty to Animals, Inc., a Florida not - for - profit corporation,
( "FKSPCA ") ( "Contractor "), in order to amend the Contract entered into on April 20, 2011, as
amended on May 18, 2011, June 15, 2011, March 19, 2014, April 15, 2015, September 21, 2016,
and as assigned pursuant to the Consent to Assignment dated October 21, 2015, as follows:
WHEREAS, on November 1, 2015, the FKSPCA assumed operation of the Marathon
Animal Shelter and agreed to provide animal control services from Mile Marker 16.7 to Mile
Marker 70, pursuant to the aforementioned Contract and Consent to Assignment dated October
21, 2015; and
WHEREAS, the terms of the Contract provide that the contract amount may be adjusted
annually by the percentage change in the Consumer Price Index (CPI) for all urban consumers
(CPI -U) for the most recent twelve (12) months available ending in December of each year; and
WHEREAS, the FKSPCA has timely requested a CPI adjustment as allowed under the
Contract; and

I. In a i9dance with Paragraph V, RENEWAL, the contract amount is hereby adjusted by

2. In all other respects, the remaining terms of the Contract entered into on April 20, 2011,
as amended and as assigned, not inconsistent herewith, shall remain in full force and
effect.
