ITEM BACKGROUND: The County is in the process of redeveloping Bernstein Park. At its April 17, 2017, meeting, the Parks and Recreation Advisory Board made several recommendations, which include a change in hours, no adults in children's area unless accompanying a child, pet restrictions, and other suggestions as noted in the attached Board meeting Minutes. Staff is seeking input from the BOCC on these recommendations and the Board's direction as to the actual and proposed usages of the Park once the redevelopment is completed. A copy of Monroe County Code Sec. 18 -27, "Rules of conduct and operational procedures for certain parks," is attached as some changes suggested may require amending the Code. PREVIOUS RELEVANT BOCC ACTION: On 1/18/17, the BOCC approved an amendment to the architect's contract for the Redevelopment of Bernstein Park. (a) Definitions. The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning: Bay Point Park means the area described as follows: Lots 13, 14, 15, 16, 17, 18, 19 and 20, Block 2, Bay Point Amended Plat, Bay Point Key according to the Plat thereof as recorded in Plat Book 3, Page 75 of the Public Records of Monroe County, Florida, RE #'s 00160060, 00160070, 00160080, 00160090, 00160100- 0160130. N 00 (c) Park hours. r ci (1) The parks and beaches listed above are open to the public, Monday through Sunday, for 7:30 in a.m. until sunset with the following exceptions: 0 • Bay Point Park and Bernstein Park are open every day from 7:30 a.m. until 10:30 p.m.; U Z.; • Big Coppitt Volunteer Fire Department is open every day from 7:30 a.m. until 10:00 p.m.; E • Burr Beach Park is open every day from sunrise until sunset; m r r • Friendship Park is open every day from 7:30 a.m. until 8:30 p.m.; Q • Key Largo Community Park is open everyday from 7:00 a.m. to 9:00 p.m.; Page 2 Packet Pg. 28 C.1.a • Murray E. Nelson Government Center Park is open every day from 7:00 a.m. until 9:00 p.m. • Big Pine Key Park is open everyday from 7:30 a.m. to 8:30 p.m.; • Watson Field Park is open everyday from 7:30 a.m. to 10:00 p.m. a (2) All persons and their vehicles that enter the parks during the open hours must leave the parks c by closing time, unless prior approval has been granted by the Monroe County Public Facilities y Maintenance Director or his /her designee, by way of a use form for a specific event. Any i vehicles in the parks when the parks are closed will be towed away at the vehicle owner's m expense. 4­ 0 (3) Park hours, as set forth herein, may be temporarily modified for a period of up to 90 days by the county administrator or his /her designee by memorandum. Such memorandum shall set forth the revised hours of operation and the beginning and ending dates for the revised hours. The memorandum shall be presented to the BOCC during the county administrator's report at the next available regularly scheduled board meeting and recorded in the meeting minutes. c (d) Special events and assemblies. 0 n (1) Any person or organization that holds or conducts at any of the parks listed above, a public - assembly that is subject to Ordinance No. 030 -1996 (ch. 10.5, art. II) must obtain approval under the provision of that ordinance. 0 (2) Any person or organization who holds or conducts any special events or assembly not subject to Ordinance No. 030 -1996 (ch. 10.5, art. II) must obtain approval and scheduling through the parks and recreation coordinator (the coordinator) subject to already scheduled activities. A 0 complete application and proof of insurance (if required) must be submitted to the coordinator at m least seven days prior to the event or assembly. m (3) Athletic activity organizers who wish to use the recreational playing field on multiple occasions during a sports season must obtain approval from and schedule their activities with the coordinator before the beginning of the season. 0 (4) Athletic activity organizers who wish to use the tennis courts for tournaments, etc., must c schedule their activities with the coordinator before the beginning of any such event. ., Events charging admission shall only take lace in the area designated b the count arks and ( ) 9� 9 Y p 9 Y Y p o recreation division and the admission fees shall be collected only at such area as the coordinator designates. 00 (e) Tennis court, basketball court, and ballfield lights. Tennis court, basketball court and ballfield lights may be used Monday through Sunday from ten minutes before sunset until closing time. Only public y works employees may operate the lights. The use of the ballfield lights must be approved by the county parks and recreation coordinator in advance. Requests for the use of ballfield lights must be a in writing, submitted to the coordinator no later than 48 hours for weekdays and 72 hours weekend N use prior to the intended dates, on an approved county use form. ao r (f) Fires permitted only in designated areas. No person shall cook or light or maintain any cooking fire, campfire, or other fire at any park except in county - provided permanently installed grill structures or cn personal barbecue grills in designated areas. 0 (g) Signs. The director of facilities maintenance must post each park entrance with a sign briefly v summarizing the park rules established by this chapter. c m (h) Admission fees (noncounty residents only). Federal holidays and weekends. Admission fee for Harry E Harris Park is $5.00 per person plus an additional $10.00 boat ramp fee for watercraft vessels with trailers. r Q Golf balls. No person may hit or otherwise propel, place or leave golf balls in any county park Page 3 Packet Pg. 29 C.1.a Q) Commercial activities. There shall be no commercial activity of any type on any county beach or park, including, but not limited to, those listed in this section, without a lease or license from the county. (k) Prohibited domestic animals; exceptions. Except for animals that assist disabled persons, and except as provided in subsections (1) and (m) of this section, domestic animals are prohibited from all county parks. No person may cause or allow any domestic animal (of whatever size), other than an animal that assists a disabled person, to be brought to, or remain on, any county park other than those listed in subsection (1) and (m) of this section. (1) Pet regulations. (1) Pets are allowed at Key Largo Park, Old Settlers Park, Wilhelmina Harvey Park, Sunset Point Park, Big Pine Key Park, Murray E. Nelson Government Center Park and in those parts of Harry Harris Park, Higgs Beach County Park, and Watson Field Park specified in subsection (1)(2) of this section, subject to the following regulations: a. Pets must be leashed on a leash no greater than eight feet long, unless and while in the water and wet sand area of Sombrero Beach Park; b. Owners must clean up after pets and properly dispose of waste. The county shall provide Mutt Mitts and Doo -Drop in stations for this purpose; and c. Pets exhibiting aggressive behavior or creating a nuisance must be immediately removed from the park. (2) Pets are allowed at Higgs Beach County Park in Key West on paved surfaces and on the open spaces lying southerly and easterly of West Martello Towers, and southerly and easterly of the fence surrounding the FAA tower parcel. In Harry Harris Park, pets are allowed in the green area north of the boat ramp with the exception of the ballfield. In Watson Field Park, pets are allowed in the fenced area east of the softball fields, west of the tennis courts and south of South St. (3) Pets are allowed at Ramrod Park subject to the following regulations: c a. Owners must clean up after pets and properly dispose of waste; c b. Pets exhibiting aggressive behavior or creating a nuisance must be immediately removed by the owner; 0 c. All dogs must have current rabies vaccinations and county licenses and be wearing their tags while in the park; N d. Dogs in heat, ill and having excessive fleas, ticks, or other internal or external parasites are not allowed; e. All dogs must be accompanied at all times by an adult human owner or handler; a f. There shall be no more than three dogs per owner or handler per visit; 00 g. Puppies under four months are not allowed; and m h. If a dog digs, the dog must be stopped immediately and the owner /handler must fill the cn hole. 0 (m) Greenspace. An open greenspace may be enclosed at Higgs Beach County Park, located as set v forth in attachment A to the ordinance from which this section is derived, provided that the enclosed greenspace shall meet the following minimum requirements: E (1) There shall be a fence four to six feet high with a minimum access of a double entry gate and one maintenance gate. a (2) There shall bean area partitioned off for use by small dogs (under 25 pounds). Page 4 Packet Pg. 30 C.1.a (3) There shall be a waste disposal station with plastic bags and a covered garbage can by each entry gate. (4) Lighting and water utilities shall be provided. (5) There shall be signage with rules for enclosed greenspace use. Such rules shall include, but not be limited to: a. Owners must clean up after pets and properly dispose of waste; b. Pets exhibiting aggressive behavior or creating a nuisance must be immediately removed from the enclosed greenspace; c. Children under age six are not allowed. Children under age 16 must be accompanied by an adult; d. All dogs must have current rabies vaccinations and county licenses and be wearing their tags while in the enclosed greenspace; e. Dogs in heat, ill and having excessive fleas, ticks, or other internal or external parasites are not allowed; f. All dogs must be accompanied at all times by an adult human owner or handler; g. There shall be no more than three dogs per owner or handler per visit; h. Puppies under four months are not allowed; If a dog digs, the dog must be stopped immediately and the owner /handler must fill the hole; Park gates may not be left open at any time; k. No rollerblades, skateboards, or bicycles are allowed in the enclosed greenspace; The hours shall be from 6:00 a.m. to 11:00 p.m. daily; and m. The board of county commissioners may establish additional rules governing the enclosed greenspace by further ordinance. n. Pets are allowed at Key Largo Park, Old Settlers Park, Wilhelmina Harvey Park, Sunset Point Park, Big Pine Key Park, Murray E. Nelson Government Center Park and in those parts of Harry Harris Park, Higgs Beach County Park, and Watson Field Park specified in subsection (o), subject to the following regulations: 1. Pets must be leashed on a leash no greater than eight feet long. 2. Owners must clean up after pets and properly dispose of waste. (n) Skating, rollerblading, skateboarding, and bicycling. (1) No person shall skate, rollerblade, skateboard, ride a bicycle, or perform any similar activity in any area of Key Largo Community Park except where designated by posted signs. Rules regulating the use of the skate and bike park at Key Largo Community Park shall be established by resolution of the board of county commissioners, shall be provided to users, and shall be posted at the skate and bike park. Only use of skateboards, inline skates, and freestyle bicycles are permitted in the designated skate and bike parks facility of Key Largo Community Park. The skate and bike park is not intended for mountain or off -road bicycling. (2) No person shall skate, rollerblade, skateboard, play racquetball, handball, roller hockey, use the multi - purpose courts, fitness stations, ride a bicycle, or perform any similar activity in any area of Big Pine Key Park except where designated by posted signs. Rules regulating the use of the Page 5 Packet Pg. 31 C.1.a skate and bike park at Big Pine Key Park shall be established by resolution of the board of county commissioners, shall be provided to users, and shall be posted at the skate and bike park. Only use of skateboards, inline skates, and freestyle bicycles are permitted in the designated skate and bike parks facility of Big Pine Key Park. The skate and bike park is not intended for mountain or off -road bicycling. (3) No person shall skate, rollerblade, skateboard or perform any similar activity in any area of the Murray E. Nelson Government Center Park. (o) Alcohol prohibited. (1) No person shall possess any container containing any alcoholic beverage while at the Murray E Nelson Government Center Park. (2) The board of county commissioners may waive the provisions of this section by license agreement or upon a resolution of the board. However, any such waiver may only be granted to a nonprofit organization, shall require the presence of security guards in the number the board determines necessary to preserve the public order, and shall require liability insurance naming the county as an additional named insured in a form and amount satisfactory to the county administrator. (p) Penalties. A violation of any of the provisions set forth in this section shall be punishable as provided in section 1 -8 of the Monroe County Code of Ordinances. (Code 1979, § 13.5 -5; Ord. Motion made by Dr. Bolini and Seconded by Margie Smith. All approved. • Chris Rivera discussed Board members stepping down from with the Board. Informed board that they need to request to leave the board in writing. • Steve Miller asked to move the presentation from Coach Peter Triado to a later time as he was not present. All approved. • Johnnie Yongue asked the Board members to review a scope of work for the possibility of hiring a manager to run programs out of the Bernstein Park. Packet Pg. 33 C.1.b Discussion- Margie mentioned that there needed to be child care as a priority as it is much needed for working parents. After school programs and programs for vacation and school closed days. Gayle — Liked the thought of a manager having kids programs. Want to include the adults as this is a community center also. Had some concerns about a manager prioritizing their events and not allowing the community to have full use of the facility. Diane Beruldsen, a member of the audience spoke about the park. Diane is the president of the International Women's Flag Football Association. Diane made a strong suggestion of not giving the management position to organizations like the Boys and Girls club and the YMCA. She did speak of the need for someone at the park to prevent vandalism. Diane wanted to say that a person such as she should run the park. She is planning on responding to the RFP /RFQ. In addition, she said that construction is moving quickly but they need to do a better job keeping the dust down. Parking is an issue in the neighborhood. Diane asked why residents couldn't park in the parking lot overnight. There is a new low income development that does not have enough parking. It would help with when the neighbors have parties. It was explained that there was no overnight parking at the park and when the park closes all vehicles should be removed. Diane suggested that the neighborhood residents could have stickers and be able to park in the lot at night. Lastly, she asked if there was going to be a walking /running path at the park since there was one before. Johnnie Yongue responded and said Yes there will be a path. Dr. Bolini initially made a motion to proceed with an RFP to obtain a manger for the park. Gayle seconded the motion. The board had further discussion to not have the proposed scope be an RFP. Their recommendation is to put out a RFQ and choose from the qualified respondents and then negotiate a price with the best qualified respondent. Dr. Bolini amended his previous motion to have Project Management proceed with the RFQ. Margie Smith seconded. All approved. Coach Peter Triado gave a presentation on the Sugarloaf School Athletic Area /Park to the board. He asked that the board recommend further developing the Sugarloaf school park. The County could add exercise stations along the pathway and add a basketball court and some vegetation. He believes there is an ILA between the county and the school board for the park that is out of date and probably needs to be updated. Patricia Eables said she will look into the ILA. Coach proposed that the county would be able to split the funding with the school board to get this done. The Board asked if this is on school property how can it be a public park. Coach asked if it can be used after school for the public. The board said that is a hard sell and asked Patricia if is it possible to have an ordinance to only have this park be used during non - school hours. Patricia said she will look into it. Coach finished by stating that the Sugarloaf community needs a park and is supportive of the idea. Coach also advised that an architect is preparing some conceptual designs. Discussion of Park ordinances were brought to the board as a walk on and the Board approved Packet Pg. 34 C.1.b Discussion of Palm Villa park ordinance allowing dogs at the park. Project Management suggested that if the portion of the current Big Pine Park dog ordinance could be used for Palm Villa Park, then it would simplify the process. The Board agreed. Bernstein Park- Change the park hours. Board agreed to have park hours be 7am to 10pm. Pets in the park - Currently there are no pets allowed by ordinance. Discussion followed. It is an athletic field and you can't clean up all the dog waste said Dr. Bolini. What happens if someone does not clean up after their dog and there is a game scheduled. Should park staff have to clean up after people? Board recommended to leave it as No Pets. Children's play area - Project Management recommended an ordinance similar to Higgs Beach. No one over the age of 14 allowed in the play area without the accompaniment of a child under 14. Board agreed. Bathrooms. Have the inside bathrooms mirror the operational hours of the community center. Leave the downstairs bathroom open during Park hours. Board agreed. Parking. The board did not want to change this parking ordinance at this time. Dr. Bolini made a motion to adopt the approved ordinance as stated. Margie Smith seconded. All approved. Review of the parks. ■ Reynolds Street Pier is at 95% drawings and starting permitting. ■ The sand re- nourishment at Higgs Beach is being drawn up by TYLinn Engineering. It is for above and below mean high water. ■ Atlantic Street relocation has 100% drawings done and is in permitting • Pines Park- Working on parking lot drainage between the park and the East Martello. • Bernstein Park update was given by Johnnie Yonnuge. Park is moving along the fields have been raised. Irrigation is going in. The community center is just about done with concrete work. • Gulf View Park- Received FBIP Grant to construct new accessory pier. Have not received funding as of yet ■ Palm Villa Park- Legal is reviewing the policy on allowing dogs at this park ■ Blue Heron Park- Looking into placing pickle ball courts at this park. Dr. Bolini spoke and asked why not just make the whole basketball court pickle ball. No one uses those courts. Dr. Bolini made a motion to have Project Management remove basketball and have only pickleball Margie Smith seconded. All approved. Packet Pg. 35 C.1.b • Big Pine Swimming Hole- Construction documents about 95% complete. Working with County to change the zoning to allow it to become a park. Starting the permit process • Watson Field Park- Renovations being done to the Bark Park. Permitting to place pavers for a wet area for the dogs. • Veterans Memorial Park- Existing Aerobic Sewer system will be taken over, upgraded, maintained and operated by the FKAA as part of the County wide sewer project. A flag pole is being added and discussion was held on the various flags to fly. Dr. Bolini made a motion to include a POW /MIA flag. Margie seconded. All approved. • Harry Harris Park- Obtained a FBIP Grant for replacement of the ramp above mean high water. Have not received funding as of yet. • Rowell's Waterfront Park- Contracting with S &ME, formerly known as Little John Engineering, for the design. • Rowell's Bathroom- Have received $247,000 from the TDC for the design and demolition of the existing building at the park.
