Monroe County v. Atlantic Trash & Transfer, LLC /Magnolia 101, LLC. CAP 13- 945. Assistant County Attorney Peter Morris successfully tried this code lien collection and injunction case before Judge Garcia on 2/2/17. The Court entered a judgment in favor of the County on 5/2/17. The Court still needs to rule on the amount of fines and other relief at a subsequent hearing. The Final Judgment is attached. 2. Key West Resort Utilities (KWRU) Rate Application — On March 13, 2017, the PSC approved a final order on the rate application. On March 14, 2017, KWRU filed a motion for reconsideration which has yet to be ruled upon. The next PSC meeting is scheduled for 6/6/17 so a vote on the motion is expected that day, with an order to follow within 20 days. Once those motions are resolved, interested parties will have 30 days to file an appeal. 3. IRS Employment Tax Examination — Assistant County Attorney Cynthia Hall successfully resolved an IRS Tax Examination of the County in the County's favor. The IRS's initial demand of payment of $138,000 in penalties and interest for allegedly unpaid employment taxes was reduced to a mere $7,040 or just over 5 cents on the dollar. Much of the IRS claim was based upon the mistaken allegation deputies working off duty details for the County were BOCC employees as opposed to independent contractors and thus should have had taxes withheld. The one allegation that was determined to have merit involved a settlement of a payout of a Teamster's employee from which taxes were not withheld. This is a personal injury suit against the County arising from claims that a contractor's employee was injured when stepping into a hole on the grounds at the Big Coppitt Fire Station. A closed session is scheduled for 5/17/17 and a jury trial is currently scheduled for 8/14/17. 5. Sheila Walter v. Gianetti Contracting Corp, FKAA, and Monroe County, CA K 13 -801. This a personal injury suit filed by a motorcyclist who claims to have injured herself when she hit a manhole for a sewer project being conducted by the FKAA on the county's behalf. On 5/17/17, the County Attorney will be requesting a closed session to be held at the 6/21/17 meeting. A jury trial is scheduled for 8/21/17. 6. Delaney v. FKAA & Monroe County — CAK 16 -439 - Grinder pump easement litigation — A property owner in the Cudjoe Regional Wastewater System service area filed suit against the County and FKAA seeking a judicial declaration that she is not obligated under state law and county ordinance to connect to the CRWS unless the grinder pump is located in the right of way. In late February, after the Circuit Court granted a motion to dismiss filed by the County and FKAA, the sole remaining plaintiff (Gail Kulikowsky) filed an amended complaint. The County and FKAA filed an answer to the complaint. The parties are now starting to engage in discovery. A bench trial is currently scheduled for 9/5/17. 7. Galleon Bay Corp. v. Monroe County and State of Florida — 3d16 -1502. The developer /property owner appealed a final judgment in the amount of $480,511 in her favor to the Third DCA. Her counsel filed his initial brief on 2/23/17. The County and the State's joint brief is due on 7/14/17. 8. Donald Davis (Collins) v. Monroe County & State of Florida — 3D17 -500. On 2/15/17, Judge Jones entered a final judgment in favor of Mr. Davis in the amount of $347,475. The County and State filed a notice of appeal of that judgment on 3/7/17 to challenge the underlying liability judgment before the Third DCA. The County's brief is due 7/17/17. 9. AirBnB. At the June 2016 meeting, the Board gave direction to work with the Tax Collector to seek full payment of tourist development taxes by AirBnB customers in a manner that does not conflict with or encourage violations of the County's vacation rental ordinance. Included within that direction was to consult with outside counsel to gauge the interest of other counties to join us in a suit against AirBnB but also to negotiate with AirBnB to see if we can avoid litigation. Those efforts are ongoing. Due to the sensitive nature of these efforts, Commissioners are invited to contact the County Attorney for further details. 10. FPL /Turkey Point impacts on FKAA's wellfields. The Board directed legal to research options for taking legal action against FPL and others entities due to the threat to FKAA's wellfields in Florida City posed by the hypersaline plume emanating from the cooling canals at FPL's Turkey Point facility. We are continuing to monitor the situation closely. Packet Pg. 2639 0.1.a 11. Code Compliance Lien Collection cases. Through the first seven months of FY17 (10/1/16 to 4/30/17), code compliance and legal staff collected $1,117,902.13 in fines and costs, which is approximately 95% of the amount collected during all of FY16. As the attached spreadsheet indicates, in prior years the collections were as follows: FY12 FY13 FY14 FY 15 FY16 FY17 to date $370,272 $427,458 $469,676 $552,408 $1,110,726 $1,117,902.13 12. Vacation Rental Prosecutions. The Code Compliance Department presented 9 vacation rental cases to the Special Magistrate in April 2017. Of those 9 cases, 6 were found in violation (including 3 stipulated agreements) and 3 were continued. The Special Magistrate imposed fines of $33,100.00. 13. Code Compliance Fine Reductions — The Board requested periodic updates on fine reductions granted by the Special Magistrate. See attached report. 14. Judicial Nominating Commission Update — On 5/8/17, County Judge Wayne Miller sent a letter to Governor Scott tendering his resignation of his position effective 8/31/17. As a member of the JNC, the County Attorney will be participating in the constitutionally established process for screening applicants and making a recommendation of 3 to 6 nominees to the Governor. This will be only the third time the JNC -16 Circuit will have convened since 2000. Packet Pg. 2640 0.1.b IN THE CIRCUIT COURT OF THE 16 JUDICIAL CIRCUIT IN AND FOR MONROE COUNTY, FLORIDA BOARD -OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, a political subdivision of the State Case No.: 2013 -CA -945 -P of Florida Plaintiff, V. MAGNOLIA 101, LLC, and BRIAN LINDBACK AS OFFICER OF MAGNOLIA 101, LLC, Defendants. ORDER GRANTING FINAL JUDGMENT IN FAVOR OF PLAINTIFF THIS CAUSE came before the court for a non -jury trial on February 2, 2017. The Court, having considered the evidence and testimony, having heard argument of counsel, having reviewed the file, and being otherwise fully informed in the premises, finds and orders as follows: Factual Background 1. This is an action brought by Plaintiff, Monroe County, Florida, (County) to foreclose on code enforcement liens asserted against three properties owned by Magnolia 101, LLC (Landowner). Plaintiff also seeks injunctive relief (Count I), money judgment for the fines accrued on the properties (Count III), and a Writ of Execution (Count IV). 2. On February 11, 2013, the County issued Notices of Violation of the County's Code of Ordinances regarding Landowner's lots 1, 4, and 20. A hearing before a special magistrate was scheduled for February 28, 2013. Packet Pg. 2641 0.1.b 3. On the same day that the Notices of Violations were given, Landowner provided to the County his own executed stipulation agreements in all three Code Enforcement Cases. In the stipulation, the Landowner swore that he was served with the Notices of Violation, and that he understood that he could appear at the hearing to contest any evidence to be submitted by Code Enforcement. Landowner agreed that the violations existed, and stipulated to the entry of the findings against him. The stipulations allowed until December 17, 2013 to cure all the violations or fines would accrue. Landowner acknowledged that his property would be checked for compliance on that date, and that the stipulated agreement would be recorded as a lien against the property if the property were not brought into compliance. 4. The violations were not cured, and the stipulations were recorded as liens in the public record. 5. The County takes the position that the stipulation agreements became liens by operation of their plain terms after the compliance deadline expired and numerous violations remained uncured. 6. Landowner takes the position that the stipulations are not enforceable code liens because the County failed to strictly adhere to Chapter 162 Florida Statutes, and deprived him of due process of law. Discussion U U O 7. Legal service of process has been had upon the Defendants, and this Court has trial °0 a� jurisdiction over the parties and the subject matter of this case. E 8. The landowner has not invoked the circuit court's appellate jurisdiction to review the a constitutional and procedural infirmities alleged at trial. Since the Landowner has failed Packet Pg. 2642 O.1.b to exhaust his administrative remedy of taking an appeal, these allegations are improperly before the court as affirmative defenses. 9. While this is not an appeal, the County has made a sufficient showing that it complied with the requirements of procedural due process, observed the essential requirements of law, and its case -in -chief is supported by competent substantial evidence. 10. Due process was provided in this case. The County provided Landowner with Notices of Violation and the opportunity for a hearing. Each Notice of Violation /Notice of Hearing entered into evidence explicitly provided an itemized list of violations. Landowner chose to waive his right to a hearing and his opportunity to contest the County's allegations in the stipulated agreement that he submitted to the County on February 11, 2013. 11. Landowner failed to cure the violations and significant fines accrued. The three stipulation agreements became liens based on the agreed -upon plain terms of the stipulations. The fact that a hearing before a special magistrate was not scheduled after the expiration of the cure period does not make these liens unenforceable. 12. The Florida Constitution and Florida's statutory code enforcement scheme affords cities and counties a measure of latitude to shape sensible remedial schemes to enforce their land development codes. Section 6.3 of Monroe County Ordinance 50 -2000 (codified at MCC § 8 -36) authorizes enforcement of its codes "by any other lawfully available means." A mutually agreeable stipulation agreement whereby an extended compliance period is granted in exchange for an economized judicial lien enforcement process is one such lawful means. 13. The County has shown that the Landowner's violations currently exist and date back many years. Ms. Windsor (Senior Code Compliance Research Analyst), Mr. Roberts 1 Packet Pg. 2643 0.1.b (Senior Administrator for the Environmental Resources Department), and Ms. Schemper (Monroe County Comprehensive Planning Manager) testified extensively as to the scale, duration, and the evolving, worsening nature of Landowners violations. These violations constitute irreparable harm to the County and its interest in safeguarding public health, safety and welfare for which no alternate legal remedy is available. 14. The County has demonstrated a prima facie entitlement to permanent injunctive and complete monetary relief up to the full amount of the landowner's three stipulated liens' amounts. Upon the landowner's bringing all three of his lots into compliance with the Monroe County Code, a post - judgment hearing shall be held to calculate the total fines due under the three stipulated liens. WHEREFORE, it is ORDERED AND ADJUDGED as follows: 15. The Defendant's Motion for Directed Verdict is DENIED. 16. The County's liens are affirmed, and Final Judgment is GRANTED in favor of the Plaintiff. 17. A final money judgment, Writ of Execution, and permanent injunction are hereby entered in favor of Plaintiff and against Defendants with amounts to be determined in accordance with Paragraph 14 of this Order. Upon the permanent injunction's rendition, the Defendants shall be enjoined from further use or development of Lots 1, 4, and 20, until all the property's violations are brought into compliance. 18. A final judgment of foreclosure is granted in favor of the County exclusively as an alternate remedy to collect its three unsatisfied stipulated liens. 19. Jurisdiction is retained to hold further hearings and enter further orders that are proper including, but without limitation, evidentiary hearings to determine and reduce to a U U O M r c a� E r r Packet Pg. 2644 0.1.b written rendered order the scope of the permanent injunction, and to determine the final code enforcement fine amounts due once the Defendant's properties are rendered fully compliant, and orders authorizing a deficiency judgment, writ of possession, and award of attorney's fees.
