AGENDA ITEM WORDING: Authorization to initiate litigation against Ray W. Thompson Jr and Robert C.
Thompson and their property located at 118 Buttonwood Avenue, Key Largo Florida, to seek compliance with the
County Code and enforce a lien arising from code compliance case number CE12110065.
ITEM BACKGROUND: This property has been the subject of a code compliance case for failure to maintain the
property in a clean, safe and sanitary manner and for habitation of recreational vehicle where prohibited. The fines
total $262,700.00 as of August 18, 2014 and will continue to accrue at $600.00 per day until compliance is
achieved. The current outstanding costs are $671.74
CE12110065: On May 23, 2013, the Code Compliance Special Magistrate found the property owner in violation of
4 violations: fences must be maintained and kept in good condition (MCC 114-20(9); habitation of recreational
vehicle is prohibited in an urban residential mobile home land use district (MCC 130-99(a); premises to be cleaned
of enormous amounts of trash and debris littered throughout the entire property (MCC 21-20(a); and causing the
property to be an unsanitary nuisance according to the Florida Department of Health. The Special Magistrate
imposed fines in the amount of $600.00 per day ($150.00 per violation) if compliance was not achieved by June 6,
2013. Additionally the Special Magistrate imposed a onetime fine of $500.00 and costs. Also an immediate cease
and desist of habitation of the recreational vehicle and mobile home was ordered as of May 24, 2013.
The current amount of the daily fines and the one time fine is $262,700.00. The current amount of the costs is
$671.74. The total current value of the county's lien is $263,371.74. The code case remains open for non-
compliance and failure to pay outstanding fines and costs.
No homestead exemption has been asserted to date and there are no pending foreclosure actions at this time.
Under the policy adopted in Resolution 057-2014 the available legal options in regard to the County's lien on this
property are:
1. Initiate litigation against the property owner for injunction, foreclosure, money judgment and writ of
execution;
2. Allow the liens to remain against the property owner, the subject property and any other property owned
by the property owner; and/or
3. Reduce the amount of the fines.
County staff recommends initiating litigation (option 1) against the property owner for injunction, foreclosure,
money judgment and writ of execution.

On November 25, 2012, the Monroe County Health Department received a sanitary y
nuisance complaint concerning the property located at 118 Buttonwood Ave Ke arg
FL. The nature of the complaint is that is a volume of items that have been collected
and stored in and around the property, which are contributing to a rat infestation. I
visited the property on November 26, 2012. 1 was able to see an abundance of rrando
items, exposed to the elements, stacked and collected throughout the property. These
items are not easily accessible and provide harborage for rats to live and reproduce;
thus creating a sanitary nuisance. I
