AGENDA ITEM WORDING: Approval of a refund for impact fees to Homes by Warren, Inc. in the
amollllt of $6,229.09 that are no longer required due to plan design changes modifying an approved
warehouse with office space to a warehouse without any office space.
ITEM BACKGROUND: This action will refund the difference of $6,229,06 paid for impact fees by
Homes by W arre~ Inc. for Building Permit 081-0417. Building Permit 081-0417 was issued on August
17, 2009 for the construction of a 2,312 square foot building that consisted of 1,077 square feet of
general office space area and 1,235 square feet of warehouse area, Impact fees of $6,920.04 were paid
and collected on the date the permit was issued as part of receipt number 126388. The applicant applied
for Revision A on November 13,2009 to change the building footprint and the use to a 1,665 square foot
warehouse with no office. No construction had commenced on the building; therefore, pursuant to ~126-
6 the applicant is eligible to apply for a refund of impact fees.

Dear Mr. Schwab:
In reference to the above, we have made changes to our plans from constructIng an office with
warehouse to only a warehouse. We have not commenced work nor have we picked up the permit. It is
my understanding that we may be due a refund since we have already paid for the fees based on the
initial set of plans for warehouse and office and since changing the plans we are not going to have the
same impact for useage or traffic.
Times are tough in our industry and we certainly appreciate your input as to how we need to initiate
