ITEM BACKGROUND: A building permit was applied for on 12/16/2004 and a ROGO application was applied for on 4/26/2005. The applicant applied for administrative relief on 8/7/2009 and is within the allowable time frame to be eligible for administrative relief under Section 138-27 of the Monroe County Code. Staff recommends that administrative relief be awarded in the form of a purchase offer by the Monroe County Land Authority. Since the December 16, 2009 BOCC meeting, staff performed an evaluation of this site to make sure the parcel is appropriately classified in the Tier System based on written policy (criteria) as amended by the Department of Community Affairs final order DCA07-GM-166A. PREVIOUS RELEVANT BOCC ACTION: The Board of County Commissioners continued this item from the December 16,2009 meeting. Lot 1, Block 12, Harris Ocean Park Estates 1 st Add, Key Largo, Real Estate No. 00450910.000000 1 We have re-evaluated the Sunshine Framing, Inc. property based on Mr. John O'Brien's 2 statements at the December 16, 2009 meeting of the Board of County Commissioners. Please see 3 attached letter dated January 22,2010 to Sunshine Framing, Inc. 4 5 This site is designated Tier IlIA and after staff s re-evaluation to determine whether it would be 6 eligible for Tier III designation, we have come to the conclusion that the habitat and existing site 7 conditions qualify as a Tier IlIA and do not recommend re-designation. Under Section 138- 8 27(f)(1) and Comprehensive Plan Policy 101.6.5. 9 10 Monroe County under Section 138-27(f)(1) - Administrative Relief which indicates: 11 12 "(f) Board's action. At the conclusion of the public hearing, the board may take any or a 13 combination of the following actions: 14 (1) Offer to purchase the property at its fair market value as its preferred action if the 15 property is located within: 16 a. A designated tier I area; 17 b. A designated tier II area (Big Pine Key and No Name Key); 18 c. A designated tier III-A area (special protection area); or 19 d. Refusal of the purchase offer by a property owner shall not be grounds for the granting of a ROGO or NROGO allocation award. The preferred method of Administrative Relief for this site is to purchase the property for preservation of important habitat. (c) Amendment The Tavernier Creek to Mile Marker 97 U.S. Highway 1 Corridor Development Standards and Guidelines may be amended by resolution of the board of county commissioners upon recoin- mendatlon of the planning commission and the director of planning. The purpose of the Tavernier historic district overlay Is to Implement the policies of the comprehensive plan and Tawrnier Creek to Mile Marker 97 LIvable CommuniKeys Master Plan to protect the historic resources of the community and to encourage development that Is sensitive and compatrble with the hlstorlccharacter of the Tavemler hlstorlcdlstrlct as identified through the Tavernier Creek to Mile Marker 97 Livable CommuniKeys Master Plan. (b) Application. The Tavernier Historic District Preservation Guidelines are hereby adopted by reference and declared part of this chapter. Within the overtay district. the county historic preservation commis- sion shall review new development, remodeling or redevelopment of uses permitted as of right and uses requiring a minor or major conditional use permit. based on the "tavernier Historic District Preservation Guidelines. (c) Amendment. The Tavernier Historic District Preservation Guidelines may be amend~ by resolytion of the board of county commissioners upon recommendation of the pjannlng oommrsslon and the'd'nctor of planning.
